THIS FIRST AMENDMENT TO THE TEMPORARY PARKING LEASE
AGREEMENT is made and entered into this �� day of .,�r��-�-- , 2012,
by and between PV-JK CLEARWATER BEACH, LLC, a Florida limited liability
company, 2901 Rigsby Land, Safety Harbor, FL 34695, as successor in interest to
C.L.E.M. Hospitality, LLC, herein called the "Lessor", and The City of Clearwater, a
Florida Municipality, 112 South Osceola Avenue, Clearwater, Florida, 33756, herein called
the "Lessee".
WITNESSETH:
WHEREAS, Lessor will have ownership and control of that property located at
400 East Shore Drive, Clearwater, FL 33767 (the "Property") after purchasing the
Property from C.L.E.M. Hospitality, LLC on or about April 10, 2012; and
WHEREAS, Lessor assumes the Temporary Parking Lot Lease with Lessee,
which was executed on September 9, 2009; and
WHEREAS, Lessor and Lessee agree to this First Amendment to the Temporary
Parking Lease Agreement pursuant to the terms described herein.
NOW, THEREFORE, in consideration of the premises and the mutual covenants
contained in this First Amendment to the Temporary Parking Lease Agreement, Lessor
and Lessee hereby agree as follows:
Paragraph 5 of the Temporary Parking Lot Lease shall be amended as
follows:
SECURITY DEPOSIT. Lessor acknowledges having in its possession, by
virtue of succeeding C.L.E.M. Hospitality, LLC's interest, a security deposit of
$�9AA:A8 2 800.00 securing Lessee's pledge of full compliance with the terms
of this agreement. Security due Lessee is to be returned within thirty (30) days
after the expiration of the Lease and vacating of Lessee; alternatively, Lessee
may choose to apply security deposit to the last month's rent.
2. All of the terms and conditions of the Temporary Parking Lot Lease are
incorporated herein by reference and shall continue in full force and effect
throughout the remaining month-to-month terms of the Agreement.
IN WITNESS WHEREOF, the parties have authorized the below signed officers
to execute this Amendment on the date first above written.
