MEMORANDUM OF AGREEMENT FOR THE MAINTENANCE OF THE DITCH WEST OF OAK GROVE MIDDLE SCHOOLMemorandum of Agreement between the Pinellas County School Board and
City of Clearwater for the Maintenance of the Ditch West of Oak Grove Middle School
The purpose of this Memorandum is to identify the extent and scope of the shared responsibilities between the
Pinellas County School Board ("PCSB"), as the owner of the property commonly known as Oak Grove Middle
School, and a portion of Allen's Creek ditch ("Ditch"), and the City of Clearwater ("City"), as an easement
holder for the proper operation and maintenance of the ditch, as represented by attached Exhibit A. Allen's
Creek ditch is a stormwater conveyance mechanism, located on the west region of Oak Grove Middle School
campus.
Maintenance requirements of the Ditch, which drains, diverts, discharges into, or otherwise impact waters of the
state, to be implemented by PCSB to ensure proper functioning of the system are as follows:
1) Regular inspections conducted on quarterly basis and following major rain event. More frequent
inspections will be conducted as necessary during storm season.
2) Vegetated areas will be appropriately cleared and maintained.
3) Storm sewers, outfall pipe, control structure and skimmer will be periodically inspected and cleaned of
any collected debris, silt or vegetation to minimize the potential for impeding the flow. This will include
repairing or replacing said structures as necessary.
4) Provide easy access for other operating authorities.
Maintenance requirements of the Ditch which drains, diverts, discharges into, or otherwise impact waters of the
state, to be implemented by City to ensure proper functioning of the system are as follows:
1) Maintain the Ditch for hydraulic conveyance, in accordance with the City of Clearwater Stormwater
Management System Policy.
2) Inspection of the system following a major storm, or hurricane event, to identify and remove blockages,
and to perform maintenance to restore flow.
3) Maintain, repair or replace non-functioning City-owned drainage structures.
