It is a corner lot with ingress/egress onto Drew Street and Cirus Street. The site consists of an existing 2,922 square foot building with nine off-street parking spaces to the north of the building. The rear of the property is not accessible by any drive and is largely an open green area with several mature oak trees. The building is set back 60 feet from the front property line along Drew Street, 21.2 feet from Cirus Avenue, and 29.1 feet from the southern property line. An unimproved alley right-of-way abuts the south property line and runs from Cirus Avenue to Hercules Avenue. To the south, on the opposite side of the alley are single family detached dwellings. To the north and west are more commercial uses ranging from retail sales and service, restaurant to automobile service station. To the east is a place of worship. Development Proposal: The application proposes to establish an office use (LaRocca Chiropractic Center) in the existing 2,922 commercial building. This office will only have one doctor and will not be a medical clinic. Previously this location was occupied by an retail sales and service use (Clearwater Schwinn Cycling, whom closed in December of 2007). Since then the subject property, which is non-conforming with regard to setbacks, has been vacant. This non-conformity has required the applicant to file an application as a Comprehensive Infill Redevelopment Project. The site conforms to current standards for minimum lot area, lot width, impervious surface ratio (I.S.R.) and floor area ratio (F.A.R.). Some of the existing building and pavement setbacks are nonconforming to current Code requirements. Improvements to the existing pavement setbacks will occur as a widened and enhanced landscape buffers to the north, south, and east are proposed. These improvements will not bring the site into full compliance with the landscape code; however they are compliant to the maximum extent practicable. The existing building height for this tenant space is less than the m�imum height for the minimum standard Code requirement. The applicant proposes to make improvement to the building's fa�ade by repainting the facade. Such a change should enhance the view of the building from the street. Other site improvements will include restriping the parking lot, ensuring handicap accessible routes comply with ADA requirements, adding landscaping, the addition of a sidewalk along Cirus, and modifying the drive access on Cirus to be one-way-in-only. The site has nine off-street parking spaces. The dimensions of the parking spaces are compliant with current standards for parking lot design. No additional off-street parking is proposed as part of this application and the addition of any further off-street parking would not be possible given the existing on-site improvements. The proposal's compliance with the applicable development standards of the Community Development Code (CDC) is discussed below. Floor Area Ratio: Pursuant to the Countywide Plan Rules and CDC Section 2-701.1, the maximum allowable FAR is 0.55. The overall proposed FAR is 0.21, which is consistent with the Code provisions. Community Development Board—April 17,2012 FLD2012-02004—Page 2 . Impervious Surface Ratio (ISR): Pursuant to the Countywide Plan Rules and CDC Section 2- 701.1, the maximum allowable ISR is 0.90. The overall proposed ISR is 0.586, which is consistent with the Code provisions. Minimum Lot Area and Width: Pursuant to CDC Table 2-704, there is no minimum required lot area or lot width for a Comprehensive Infill Redevelopment Project. However, for a point of comparison, the minimum lot area requirement for office is 10,000 square feet. The subject property has a lot area of 13,981 square feet. The minimum lot width requirement for office is 100 feet. The width of the subject property is 100 feet along Drew and 138.65 feet along Cirus Avenue. Minimum Setbacks: Pursuant to CDC Table 2-704, there are no minimum setback requirements for a Comprehensive Infill Redevelopment Project. However, for a point of comparison, the minimum front setback requirement for office can range between 15 and 25 feet and the side setback for office can range between zero and 10 feet. With regard to setbacks to the existing building, no changes are proposed to the building; however the setbacks to pavement are proposed to be improved. An increase in landscape buffer will improve the setback along Drew Street from 2 feet to 12 feet; along Cirus Avenue from 2 feet to 5 feet; and portions of the west property line from zero feet to 6 feet and 11 feet. The proposal improves the site to the maximum extent practicable and as such, the setbacks to pavement and building are acceptable to Staff. Maximum Buildin�Hei� Pursuant to CDC Table 2-704, there is no m�imum allowable height for a Comprehensive Infill Redevelopment Project. However, for a point of comparison, the maximum building height for office can range between 25 and 50 feet and the existing building height is 18 feet (to midpoint of pitched roo�. Minimum Off-Street Parkin�: Pursuant to CDC Table 2-704,the minimum required parking for a Comprehensive Infill Redevelopment Project is determined by the Community Development Coordinator based on the specific use and/or ITE Manual standards. The off-street parking requirement for office uses is between 3 and 4 spaces per 1,000 square feet of gross floor area, which for a 2,992 square foot building would result in a requirement between 9 and 12 spaces. The site has 9 parking spaces; which is consistent with the Code provisions. Landscapin� Pursuant to CDC Section 3-1202.D.1, this site is required a fifteen-foot wide landscape buffer along Drew Street, a ten-foot wide landscape buffer along Cirus Avenue, a five- foot landscape buffer on the west, and a twelve-foot wide buffer on the south. An increase to the currnet landscape buffer is proposed along Drew Street from 2 feet to 12 feet, and along Cirus from 2 feet to 5 feet, and on a portion of the west property line from zero to 6 feet and from zero to 11 feet. The request is for flexibility for a reduction to the front landscape buffer from 15 feet to 12 feet (along Drew Street), a reduction in the front landscape buffer from 10 feet to 5 feet (along Cirus Avenue), and a reduction in the side (west) landscape buffer from 5 feet to zero feet. Although the side setback is requested to zero feet, this does not accurately reflect the proposed conditions. A 6 foot wide and an 11 foot wide landscape area axe proposed along the west side; however it does not run the entire length due to the need for a parking back-out area. Due to the existing site conditions the front and side perimeter buffers cannot be increased any Community Development Board—April 17,2012 FLD2012-02004—Page 3 more without altering the parking lot dimensions resulting in a reduction to the number of parking spaces. To mitigate for the deviations to the landscape buffer requirements along the front, side, and rear setbacks, the applicant has proposed adding trees and groundcover. The proposal of retaining the existing trees will be revised as the existing ear tree, Enterolobium cyclocarpum, to the south of the building, is a weak species and the tree exhibits girdling roots, rot and cavities, dead branches and co-dominate branches. Removal is recommended. The existing oak tree is not located on the subject property but is in the adjacent alley. Further to the west of the building, the existing tree is shown to be retained; however there is no tree on the west side of the property. All existing trees to remain are recommended to be removed, have been removed, or not on the subject property. A revised landscape plan shall be required prior to issuance of building permits. Additional accent trees to comply with the requirements of the landscape buffers will be required. As the oak in the alley has a large canopy and overhead wires pass through the alley, additional shade trees on the rear property line would be inappropriate and are not required. The rear property line, adjacent to residential, will comply with all landscape buffer requirements. Pursuant to CDC Sections 3-1202.E.1 and 3-1202.E.2,ten percent of the gross vehicular use area shall be provided as landscape islands a minimum of eight feet wide and 150 square feet in size and foundation plantings shall be provided for 100 percent of a building farade with frontage along a street right-of-way. The foundation plantings must be within an area that is a minimum of five feet wide and consist of at least two accent trees or three palm trees for every 40 linear feet of building fa�ade and one shrub for every 20 square feet of required landscape area. A minimum of 50 percent of the area shall contain shrubs with the remainder to be ground cover. As built, green space on site is scarce to provide the required plantings around the building. Due to the site constraints staff supports the requested landscape reductions. Comprehensive Landscape Program: Pursuant to Section 3-1202.G of the Community Development Code, the landscaping requirements contained within the Code can be waived or modified if the application contains a Comprehensive Landscape Program satisfying certain criteria. The following table depicts the consistency of the development proposal with those criteria: Community Development Board—April 17,2012 FLD2012-02004—Page 4 Consistent Inconsistent 1. Architectural theme: a. The landscaping in a comprehensive landscape program shall be designed as a N/A N/A part of the architectural theme of the principle buildings proposed or developed on the parcel proposed for development;or b. The design, character, location and/or materials of the landscape treatment X proposed in the comprehensive landscape program shall be demonstrably more amactive than landscaping otherwise permitted on the parcel proposed for development under the minimum landscape standards. 2. Lighting: Any lighting proposed as a part of a comprehensive landscape program is X automatically controlled so that the lighting is turned off when the business is closed. 3. Communiry character: The landscape treatment proposed in the comprehensive X landscape program will enhance the community character of the Ciry of Cleazwater. 4. Properry values: The landscape treatment proposed in the comprehensive landscape X program will have a beneficial impact on the value of property in the immediate vicinity of the parcel proposed for development. 5. Special area or scenic corridor plan: The landscape treatment proposed in the N/A N/A comprehensive landscape program is consistent with any special area or scenic corridor plan which the City of Cleazwater has prepazed and adopted for the area in which the parcel proposed for development is located. Solid Waste: The applicant has proposed to use black barrels for service due to limited space and type of business. The proposal has been found to be acceptable by the City's Solid Waste Department. Si�ht Visibilitv Triangles: Pursuant to CDC Section 3-904.A, to minimize hazards at the driveways, no structures or landscaping may be installed which will obstruct views at a level between 30 inches above grade and eight feet above grade within 20-foot sight visibility triangles. No structures or landscaping is proposed within the site triangles. Si na e: The applicant is not proposing any signage concurrent with this development proposal. It is noted that pursuant to Section 6-104 of the Community Development Code, in the event a building permit is required for the redevelopment of a principal use/structure nonconforming signs on the parcel proposed for development shall be brought into compliance. The most recent submittal does not include this information. Without a sign inventory of existing signs located on the subject property it cannot be determined whether this Code is met. It has been attached as a condition of approval that all existing and future signage must meet the requirements of Code. Code Enforcement Analysis: There are no active Code Enforcement cases for the subject property. Community Development Board—April 17,2012 FLD2012-02004—Page 5 COMPLIANCE WITH FLEXIBILITY CRITERIA: The following table depicts the consistency of the development proposal with the Flexibility criteria as per CDC Section 2-703.0 (Comprehensive Infill Redevelopment Project): Consistent Inconsistent 1. The development or redevelopment is otherwise impractical without deviations from X the use and/or development standards set forth in this zoning district. 2. The development or redevelopment will be consistent with the goals and policies of X the Comprehensive Plan, as well as with the general purpose, intent and basic planning objectives of this Code, and with the intent and purpose of this zoning district. 3. The development or redevelopment will not impede the normal and orderly X development and improvement of surrounding properties. 4. Adjoining properties will not suffer substantial detriment as a result of the proposed X development 5. The proposed use shall otherwise be permitted by the underlying future land use X category, be compatible with adjacent land uses, will not substantially alter the essential use characteristics of the neighborhood;and sha11 demonstrate compliance with one or more of the following objectives: a. 'The proposed use is permitted in this zoning district as a minimum standard, flexible standard or flexible development use; b. The proposed use would be a significant economic contributor to the City's economic base by diversifying the local economy or by creating jobs; c. The development proposal accommodates the expansion or redevelopment of an existing economic contributor; d. The proposed use provides for the provision of affordable housing; e. The proposed use provides for development or redevelopment in an area that is characterized by other similar development and where a land use plan amendment and rezoning would result in a spot land use or zoning designation; or f. The proposed use provides for the development of a new and/or preservation of a working waterfront. 6. Flexibility with regard to use, lot width, required setbacks, height and off-street X parking aze justified based on demonstrated compliance with all of the following design objectives: a. The proposed development will not impede the normal and orderly development and improvement of the sunounding properties for uses permitted in this zoning district; b. The proposed development complies with applicable design guidelines adopted by the City; c. The design, scale and intensity of the proposed development supports the established or emerging character of an area; d. In order to form a cohesive, visually interesting and amactive appearance, the proposed development incorporates a substantial number of the following design elements: O Changes in horizontal building planes; ❑ Use of architectural details such as columns, cornices, stringcourses, pilasters,porticos,balconies,railings,awnings,etc.; ❑ Variety in materials,colors and textures; ❑ Distinctive fenestration patterns; ❑ Building step backs;and ❑ Distinctive roofs forms. e. The proposed development provides for appropriate buffers,enhanced landscape desi and a ro riate distances between buildin s. Community Development Board—April 17,2012 FLD2012-02004—Page 7 COMPLIANCE WITH GENERAL STANDARDS FOR LEVEL TWO APPROVALS: The following table depicts the consistency of the development proposal with the General Standards for Level Two Approvals as per CDC Section 3-914.A: Consistent Inconsistent 1. The proposed development of the land will be in hazmony with the scale, bulk, X coverage,density and character of adjacent properties in which it is located. 2. The proposed development will not hinder or discourage development and use of X adjacent land and buildings or significantly impair the value thereof. 3. The proposed development will not adversely affect the health or safety of persons X residing or working in the neighborhood. 4. The proposed development is designed to minimize traffic congestion. X 5. The proposed development is consistent with the community character of the X immediate vicinity. 6. The design of the proposed development minimizes adverse effects, including X visual,acoustic and olfactory and hours of operation impacts on adjacent properties. SUMMARY AND RECOMMENDATION: The Development Review Committee (DRC) reviewed the application and supporting materials at its meeting of March 1, 2012, and deemed the development proposal to be legally sufficient to move forward to the Community Development Board (CDB),based upon the following: Findin�s of Fact. The Planning and Development Department, having reviewed all evidence submitted by the applicant and requirements of the Community Development Code, finds that there is substantial competent evidence to support the following findings of fact: 1. T'he 0.32 acre subject property is located on the southwest corner of Drew Street and Cirus Street; 2. That the subject property is located within the Commercial (C) District and the Commercial General (CG) Future Land Use Plan category; 3. The site is currently improved with an approximate 2,992 square foot commercial building; 4. The application proposes to utilize the existing 2,992 square-foot commercial building previously retail sales and service as an office (LaRocca Chiropractic Center); 5. The subject property is presently non-conforming with respect to the existing building and off-street parking area not meeting the minimum required setbacks; 6. The applicant proposes to improve pavement setbacks and landscape buffers; 7. The proposed Comprehensive Landscape Program will provide additional landscaping within green spaces and create additional green space; 8. The proposal meets the development standards: F.A.R., I.S.R., minimum lot area/size and maximum building height; 9. No additional off-street parking is proposed as part of this application and the addition of any further off-street parking would not be possible given the existing on-site improvements; 10. Based on the existing character of the surrounding area, the proposed use is compatible and consistent with this character of the immediate area; and 11. There are no active Code Enforcement cases for the subject property. Conclusions of Law. The Planning and Development Department, having made the above findings of fact,reaches the following conclusions of law: Community Development Board—April 17,2012 FLD2012-02004—Page 8 l. That the development proposal is consistent with the Standards as per Sections 2-701.1 and Table 2-703 of the Community Development Code; 2. That the development proposal is consistent with the Flexibility criteria as per Section 2- 704.0 of the Community Development Code; 3. That the development proposal is consistent with the General Standards for Level Two Approvals as per Section 3-914.A of the Community Development Code; and 4. That the development proposal is consistent with the criteria of the Comprehensive Landscape Program as per Section 3-1202.G of the Community Development Code. Based upon the above, the Planning and Development Department recommends APPROVAL of Flexible Development application to permit 2,922 square feet of office in the Commercial (C) District with a lot area of 13,981 squaxe feet, lot widths of 100 feet (Drew Street) and 138.65 feet (Cirus Avenue), front (north) setbacks of 12 feet (to pavement) and 60 feet (to building), front (east) setbacks of 5 feet (to pavement) and 21.2 feet (to building), a side (south) setback of 29.1 feet (to building), side (west) setbacks of 6 feet (to pavement) and 9.8 feet (to building), a building height of 18 feet (to midpoint of pitched roo fl, and nine off-street parking spaces as a Comprehensive Infill Redevelopment Project under the provisions of Community Development Code Sections 2-701.1 and 2-704.C, as well as a reduction to the foundation landscape requirement on the front (north) fa�ade from five feet to zero feet, reductions of the front(north) landscape buffer from 15 feet to 12 feet, the front (east) landscape buffer from 10 feet to 5 feet, and the side (west) landscape buffer from 5 feet to zero feet, and a reduction of interior island landscaping from 10 percent to zero percent, as part of a Comprehensive Landscape Program under the provisions of Community Development Code Section 3-1202.G., subject to the following conditions: Conditions of A�proval: 1. That prior to the issuance of a certificate of completion or business t� receipt, whichever occurs first, all of the proposed landscaping shall be installed; 4. That prior to the issuance of building permits the landscape plan be revised to be accurate and to comply with the landscape buffer requirements; and 5. That prior to the issuance of any building permits, the Fire Department may require the provision of a Water Study performed by a Fire Protection Engineer in order to ensure that an adequate water supply is available and to determine if any upgrades are required by the developer due to the impact of the project. The water supply must be able to support the needs of any required fire sprinkler, standpipe and/or fire pump. If a fire pump is required, then the water supply must be able to supply 150%of its rated capacity. An existing commercial building is onsite. The building has open space on the east, west and south sides and an existing asphalt parking lot on the north side. The site has an impervious surface ratio of 0.65 in the pre- development condition and an impervious surface ratio of 0.59 in the post-development condition. Drainage collection is managed by drainage inlets currently in place. Therefore flow patterns and rates of discharge will remain unaltered. NARRATIVE General Applicability Criteria 1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density and character of adjacent properties in which it is located. The existing building is a former retail store and is surrounded to the west and north (north of Drew Street) by commercial properties, residential to the south, and an institutional use to the east. The parcel has an underlying land use designation of CG and "C" zoning. The 2,922 square foot building (FAR of 0.21) is pre-existing and is in harmony with the surrounding axea. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. Adjacent lands to the north and west are already developed with commercial uses. The property to the south is developed with residential homes and to the east (east of Cirus Avenue) there is the Skycrest United Methodist Church, therefore the re-use of this building as an office will not hinder or discourage the appropriate use of adj acent land. 3. The proposed development will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use. The proposed office re-use of this vacant building would not adversely affect persons living or working in the immediate area, as occupancy of the vacant building would be an improvement for the area. The residential properties to the south are well separated from this site by an alleyway and proposed landscape buffer. 4. The proposed development is designed to minimize traffic congestion. The re-use of this building as medical office space would result in 105 daily vehicle trips of which 10 would occur during the PM peak hour according to ITE Trip Generation, 8�' Edition LUC 720 (Medical/Dental Office). This is much less intense than the prior retail use. 5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The community character is primarily commercial and includes reta.il, offices, a school to the east and residential to the south. The building contains 2,922 square feet of space in a single story building. It is consistent with the single-story building to the north across Drew Street and the buildings to the east and west and the general commercial office character of the Drew Street corridor. Page 1 of 3 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. The existing building is an isolated commercial building fronting Drew Street in an older commercial area. The site itself is surrounded from the residential area to the south by open space and a 15-foot unimproved alleyway. Due to past road widening of Drew Street, the front landscape buffer is minimal. This will be improved as best possible and on-site parking will be adequate for the proposed medical office use. Therefore any adverse affects would be minimized. The reduction to on-site parking is not an issue as ITE Parking Generation, 4�' Edition confirms parking demand should not exceed nine(9)parking spaces. FLEXIBILITY CRITERIA OFFICES SECTION 2-704.I Project Criteria 1. Height. There is no flexibility request regarding height. The height limit is 25 feet and the existing building is less than 25 feet in height. 2. Signs. The applicant is not seeking any deviations fro the signage code and a11 signage will comply with CDC criteria. 3. Side and Rear Setback. A reduction in the 10-foot side setback criteria is necessary for the west side only. The building is 9.8 feet from the west property line, however, the paved parking axea extends to the property line, and is therefore "zero" feet. The applicant will landscape in the parking area where possible. The south side is considered a side-yard and the 10-foot criteria is easily satisfied. Rear setback is not applicable since there is no rear yard (2-fronts and 2-sides only) 4. Off-Street Parking. Flexibility is requested for off-street parking. According to the requirement of 4 spaces/1,000 square feet, the office project would require 12 spaces. The parking lot presently contains 10- spaces, however, the restriping to include a handicap space will reduce this to 9- spaces. Data from ITE Parking Generation, 4�' Edition suggests 9-spaces are adequate parking for this re-use. Page 2 of 3 The flexibility to not add pavement will allow for the impervious surface to be reduced and landscaping to be enhanced. 5. Lot area and Lot Width. No deviations to the required lot area and width are requested. The minimum 10,000 square foot lot size is exceeded and the lot is 100-feet wide. 6. Front Setback. Because it is a corner lot, the property has two fronts (North and East). The 25-foot requirement is impossible to meet on either of these fronts. The existing 2-foot landscape buffer along Drew Street will be increased to 12-feet where possible to the m�imum extent without impeding a 24- foot drive aisle. The building is setback approximately 60 feet from Drew Street. On the east side, the building is setback 21 feet from Cirus Avenue and landscaping is proposed in the buffer axea. The parking lot portion of the site directly abuts the property line and enhanced landscaping is proposed wherever possible. This dxiveway to Cirus Avenue will be converted to one-way inbound only as discussed with the traffic engineering department.
