BACKGROUND: The hotel originally approved in 2001, has gone through several modifications and upgrades to remain current in the market. While the expansion approved under FLS2005-11085 was under construction the developer, through FLS2006-09061 obtained approval to add an additional floor to the newly approved 28 room expansion. The approval of FLS2006-12071 allowed flexible development approval to modify the parking lot associated with an existing overnight accommodation use with a reduction to the required front (south) setback from 25 feet to 16 feet to pavement associated with parking and a reduction to the required building foundation landscaping from 5 feet to zero feet as a Comprehensive Landscape Program along the south elevation of the building addition. On September 18, 2008 under FLS2008-07015 a Flexible Standard Development application was approved to allow an accessory restaurant use to the existing overnight accommodations use as per Community Development Code (CDC) Sections 2-703 and 3-201. The approved site plan placed the proposed cafe along the western edge of the property in a somewhat remote location from the hotel. On October 6, 2011 under FLS2011-05009 a Flexible Standard Development application was approved to allow the cafe in the current location just west of the hotel structure. CURRENT REQUEST: This application contemplates a small expansion on the north end of the cafe structure for storage within the recently approved cafe structure including a small outdoor patio area for outdoor seating. GENERAL APPLICABLE STANDARDS: (Code Section 3-913.A) 1. Similar architectural elements have been incorporated into the design of the expansion to the accessory structure to provide a cohesive development. The proposed cafe structure and expansion including the patio area is located to meet the required setbacks; the proposed design is similar or less than the scale, bulk, coverage, density of many of the older surrounding sites. The proposed expansion to the accessory cafe structure and proposed outdoor seating area will not impair or discourage development or use of adjacent land as the proposal will continue to promote further development and investment in the area and along these main corridors. The hotel development will continue to fuel the local economy by providing new modern overnight accommodations, with this new cafe facility to further attract and maintain guests. 3. No health or safety concerns are anticipated with the minor expansion to the accessory use and structure, as the site design continues to adhere to all dimensional parking and drive aisle requirements, required visibility triangles and nicely landscaped yards along the street. 4. The smaller site added to the project for the original request for the 28 room expansion contained two access points along Gulf to Bay Blvd. in addition to the original existing access point near the northeast corner of the larger site. Through the review and approval process for the expansions substantial improvements were made to the site to better address congestion and to provide improved safety; the main access point along Gulf to Bay near the intersection of the service road/off ramp associated with U.S. 19 was deleted. Additionally, one of the two existing access points associated with the smaller site was deleted. All appropriate right-of-way work permits have been obtained and requirements met. There is an existing cross access agreement between the Sunshine Inn (located just north of the site) and the Holiday Inn Express to allow access and circulation of vehicles between the two developments. The continuation of this agreement is necessary for both sites to function and remain viable. The cafe upon completion (with the minor expansion) will provide food service to both hotels, the Holiday Inn Express and the neighboring Sunshine Inn; the availability of this service is necessary for the hotels to remain competitive with other area hotels. 5. The design of the expansion is consistent with the existing cafe and hotel development and will not be in conflict with the varying character established within the vicinity. The cafe structure and patio area fall in line with the existing set back of the hotel along Gulf to Bay Boulevard as is required by Section 3-201 of the Land Development Regulations. The cafe structure and exparision will appear as though it has always been apart of the site, rather than an after-thought. The accessory structure, the existing hotel and site design will present an inviting anchor to this major intersection and will continue to be a cornerstone for the Community. The existing hotel site, approved accessory structure and proposed expansion will continue to provide encouragement for redevelopment in the area. Further, overnight accommodation uses are permitted uses within the Commercial zoning district and are desirable along these major corridors. 6. No additional adverse effects relating to visual, acoustic olfactory or hours of operation issues will be created by the proposed accessory use as the hours of operation will be 10 am to 11 pm; the proposed hours of operations will not create negative impacts on the surrounding commercial properties. No visual obstructions are being created with the proposed expansion to the accessory structure and outdoor seating area as requested within this Level One Flexible Standard Development application. 2 FLEXIBILITY CRITERIA: (Code Section 2-703 M.) 1.
