Dear Mr. Lam:
This letter constitutes a Development Order pursuant to Community Development Code (CDC) Section
4- 202.E. On February 5, 2009, the Development Review Committee (DRC) reviewed your application for
Flexible, Standard approval to permit a swimming pool and deck at a detached dwelling in the Low
Medium Density Residential / Island Estates Neighborhood Conservation ,Overlay :District (LMDR/
IENCOD) with a reduction to the rear (south) setback from ten feet to seven feet (to proposed swimming
pool deck) ' under the provisions of CDC Section 2- 1602.E.1. The DRC recommended approval of the
application with the following findings of fact, conclusions of law and conditions of approval:
Findines of Fact:
1. That the 0.217 -acre parcel is located on the south side of Palm Island SW. approximately 500 feet
west from the intersection of Island Way and Palm Island SW;
2. That the zoning of the property is Low Medium Density Residential / Island Estates
Neighborhood Conservation Overlay District (LMDR/IENCOD), which is consistent with the
underlying. Residential Urban (RU) land use category;
3. That the property is currently a detached dwelling; and
4. That the proposal is to reduce the rear setback from ten feet to seven feet to construct an
accessory in- ground swimming pool and deck at the existing detached dwelling.
Conclusions of Law:
1. That the proposal is consistent with applicable Standards & Criteria'under the provisions of CDC
Section 2- 201.1, 2- 1602.E; and
2. That the plan complies with General Standards for Level. One Approvals as per CDC Section 3-
913.A; and
3. That the proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That prior to the issuance of any building permits, the proposed finished grades of the deck and
area around the deck must be depicted on the site plan. Show the cross sections between the pool
deck and the two side property lines. Swales may be required along the two side property lines to
direct runoff to. the waterway; and

2. Prior to the issuance of a building permit, provide a signed and sealed topographical survey
showing spot elevations. Accessory in- ground pools cannot exceed 12 inches above grade per
Section 3- 201.13.10 of the Community Development Code.
I concur with the above findings and, through this letter, approve your application for Flexible Standard
Development with the above conditions. This approval is based upon, and must adhere to the application
and development plans received December 24, 2008.
Pursuant to CDC Section 4 -303, an application for a- building permit shall be made within one year of the
Flexible Standard Development approval (by February 12, 2010).. The building permit must be obtained
within six months of the initial permit application. This timeframe to obtain the initial building permit
may be .extended for an additional six months for cause by the Community Development Coordinator.
Time frames do not .change with successive owners. All required certificates of occupancy must be
obtained within two years of the date of issuance of the building permit.
Additionally, pursuant to CDC Section 4- 502.A, please be aware that in appeal of a Level One
approval (Flexible Standard Development) may be initiated within 7 days from the date of this
development order was issued by either the applicant or by property owners within the required
notice area who presented substantial competent evidence in the Level One review. The filing of
an application/notice of appeal shall stay the effect of the decision pending the final
determination of the case. The appeal board for your case expires on February 19, 2009.
The issuance of this Development Order does not relieve you of the necessity to obtain building permits
or pay impact fees that may be required. In ,order to facilitate the issuance of any permit or license
affected by this approval, please bring a copy of this letter with you when applying for any permits or
licenses.

As a property owner within 500 feet of 205 PALM ISLAND SW, the City of Clearwater Planning Department
gives notice that an application for Flexible Standard Development approval to permit a pool deck in the Island
Estates Overlay District (IEOD) with reduction to the rear (south) setback from 10 feet to seven feet (to new
pool deck) under the provisions of Section 2- 1602.E..
On February 05; 2009, the Development Review Committee (composed of the City's professional staff) will
review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determiniation, the Planning Director will issue a
Development Order approving, approving with conditions, or denying the application. The earliest date that
the City will make a decision on the application will be February 05, 2009.
