The site in question is an existing residential lot with an existing structure on it. The proposed
project includes demolishing the existing structure and rebuilding a new house in its place. The
new design has a slightly larger footprint which will require the 15' -0" requested rear setback.
The existing grades surrounding the structure are to remain as is. The existing stormwater
drainage design for this parcel should not be affected by the proposed structure. The requested
15' -0" rear setback should have no impact on the drainage.

This letter constitutes a Development Order pursuant to Section 4 -202.E of the Community Development Code.
On June 7, 2007, the Development Review Committee (DRC) reviewed your Flexible Standard Development
application for a detached dwelling within the Low Medium Density Residential (LMDR) District / Island
Estates Neighborhood Conservation Overlay District (IENCOD) with a front setback reduction from 25 feet to
21 feet (to pavement) and a rear setback reduction from 25 feet to 15 feet (to building) as a Residential Infill
Project pursuant to Section 2- 1602.E of the Community Development Code. The DRC DENIED this
application based upon the following Findings of Fact and Conclusions of Law.
Findings of Fact
1. That the 0.258 -acre subject property is located at the northeast corner of Palm Island NE;
2. That the subject property is located within the Low Medium Density Residential (LMDR) District and the
Island Estates Neighborhood Conservation Overlay District (IENCOD);
3. That the subject property is located within the Residential Urban (RU) Future Land Use Plan category;
4. That the development proposal is subject to the requirements of the Island Estates Neighborhood Plan; and
5. That there are no active Code Enforcement violations associated with the subject property.
Conclusions of Law:
1. That the development proposal is inconsistent with the applicable portions of the Island Estates
Neighborhood Plan;
2. That the development proposal is inconsistent with the Standards and Criteria as per Section 2- 1602.E.2.a of
the Community Development Code;
3. That the development proposal is inconsistent with the Standards and Criteria as per Section 2- 1602.E.2.c of
the Community Development Code;
4. That the development proposal is inconsistent with the Standards and Criteria as per Section 2- 1602.E.2.f of
the Community Development Code;

1. Install over -sized gutters and downspouts to direct roof runoff to swales then to street or the
bay and not to the adjacent homes.
2. Garage shall have a minimum finished floor elevation of 3/4 foot above the crown of the
adjacentroad(s).
3. Site plan only shows the existing grade. Please show proposed grade elevations on plan.
Existing grade shall be maintained as pre- developed elevation to ensure on site run -off not
overflow to adjacent homes. Show swales along the east and west property lines to direct runoff

I . Pursuant to Section 3 -911 of the Community Development Code, all utilities, including
individual distribution lines, shall be installed underground.
2. Pursuant to Section 3- 1205.D.2 of the Community Development Code, single - family properties
between 10,001 and 15,000 square feet in size are required a minimum of six trees. The
proposed plan depicts only three unidentified palms (which given their placement would not
constitute a tree). Revise the proposed plan to depict the required trees. Please be advised that
all required trees must meet the standards set forth in Section 3- 1202.13.1 of the Community
Development Code.
3 . Objective A of the Waterfront and Canals goal of the Island Estates Neighborhood Plan states
that water views shall be preserved by maintaining established rear building setbacks, etc.
Provide evidence that the proposal is in compliance with this objective.
4. Objective D of the Neighborhood Appearance and Maintenance goal of the Island Estates
Neighborhood Plan seeks to maintain openness in rear setbacks, to preserve consistent
appearance in waterfront yards and to control building bulk. Provide evidence that the proposal
is in compliance with this objective.
5 . Objective G of the Neighborhood Appearance and Maintenance goal and the associated
Development Standards of the Island Estates Neighborhood Plan state that 35% of the area
between the principle structure and the right -of -way shall consist of vegitated landscaping in
order to preserve a landscaped appearance throughout the neighborhood. The proposal, while
denoting landscape areas, does not identify any proposed plantings. Provide evidence that this
objective and development standard will be met.
6. Objective L of the Neighborhood Appearance and Maintenance goal and the Development
Standards of the Island.Estates Neighborhood Plan address the screening of all mechanical
equipment from public rights -of -way, adjacent properties and the waterfront. The proposed plan
does not address how this objective is being complied with.
7. Objective B of the Utilities and Infrastructure goal of the Island Estates Neighborhood Plan states
that any existing overhead utility lines are to be relocated underground. The proposed plan
denotes that the existing overhead power lines are not to be relocated - this notation must be
revised.
8. Objective B of the Character of Redevelopment goal of the Island Estates Neighborhood Plan
states that setback requirements shall be consistent with deed restrictions. Provide evidence that
the application is consistent with any and all deed restrictions.
9. Pursuant to the Development Standars of the Island Estates Neighborhood Plan, the
rear /waterfront setback shall be 25' except where adjacent structures on either side of the lot are
setback 20', then the minimum rear /waterfront setback shall be 20'. The application does not
provide any evidence to support a deviation to 20' as per the above, much less a deviation to 15'
as proposed. Further, the proposed rear setback is inconsistent with the Plan.
10. Keyed Note #22 is for an existing 4' wide sidewalk. General Note #8 states the existing sidewalk
is to be removed and replaced to Code. Review the proposed plan to depict the new sidewalk
and revise Keyed Note #22 accordingly.
11 . Pursuant to Section 3- 913.A.1 of the Community Development Code, the proposed development
shall be in harmony with the scale, bulk, coverage, density and character of adjacent properties in
which it is located. The response provided discusses the proposed rear setback and states that it
is in harmony with surrounding structures; however the response does not discuss all of the
elements of the criteria and does not state how there is harmony between the existing and the
proposed. Provide a revised response.
12. Pursuant to Section 3- 913.A.2 of the Community Development Code, the proposed development
shall not hinder or discourage the appropriate development and use of adjacent land and
buildings or significantly impair the value thereof The response provided states the architectural
style of the proposed dwelling and that it is comparable to surrounding residences; however it
does not discuss the criterion. Provide a revised response.
13. Pursuant to Section 2- 1602.E.2.a of the Community Development Code, a written response is to
be provided that outlines how the redevelopment of the parcel shall be consistent with the Island
Estates Neighborhood Plan. The response provided to this criterion states that the proposed
residence has a high level of detailed Mediterranean architecture that is in keeping with other
residences in the community; however it provides no discussion on the proposals consistency
with the Plan.

14 . Pursuant to Section 2- 1602.E.2.c of the Community Development Code, a written response is to
be provided that outlines how the redevelopment of the parcel is otherwise impractical without
deviations from the development standards. The response provided states that the desired
architectural design of the residence would not be achieved without the requested deviations;
however it does not discuss how the redevelopment of the parcel would be impractical without
the requested rear setback deviation.
15. Pursuant to Section 2- 1602.E.2.f of the Community Development Code, a written response is to
be provided that outlines how the redevelopment of the parcel as a residential infill project will
upgrade the immediate vicinity of the subject property. The response provided references a
response to another criterion, and does not address how the proposed development will upgrade
the immediate vicinity.
16. Pursuant to Section 2- 1602.E.2.g of the Community Development Code, a written response is to
be provided that outlines how the design of the proposed residential infill project will create a
form and function enhancing the community character of the immediate vicinity. The response
provided states that the architectural style (i.e. building design) will do this; however the response
does not address how the site design (i.e. the reduced setbacks) will be an enhancement to the
community character.
17. Pursuant to Section 2- 1602.E.2.h of the Community Development Code, a written response is to
be provided that outlines how flexibility in regard to the required setbacks is justified by the
benefits to community character and the immediate vicinity. The response provided states that
many adjacent parcels demonstrate a similar /same rear setback to that requested. However, the
response does not actually provided any evidence to support this claim.

Notes: The DRC has found the application to be inconsistent with the IENCOD. The DRC further finds that the application has not
met the criteria as per Sections 3 -913.A and 2- 1602.E.2. Therefore, the DRC recommends denial of the application.

As a property owner within 500 feet of 470 Palm Island NE, the City of Clearwater Planning Department gives
notice that an application has been submitted for Flexible Standard Development approval for a detached
