That the property is currently a detached dwelling; and 4. That the proposal is to reduce the rear setback from ten feet to five feet to construct an accessory in- ground swimming pool at the existing detached dwelling. Conclusions of Law: 1. The proposal complies with Flexibility criteria under the provisions of Section 2- 1602.E.1.c; 2. The plan complies with General Applicability Criteria under the provisions of Section 3 -913; 3. It is my understanding that this time period may not meet the requirements of proper notification. Especially over the holidays when many effected neighbors are out of town and the city offices) are closed for holiday with many staff members on holiday. While your note indicated that I am encouraged to participate in the review I will not be fully able to due to short notice and my travel obligations. In any event I would like to go on record in regards to my concern /objection about making this property an anomaly to the rule in regards to the set back being changed for a pool installation. I am confident when the current guidelines were adopted that they were designed /engineered with the safety of all homeowners' property and the integrity of the seawalls. Also it would set a precedent in place that could have long reaching effects of our development. Please take into consideration that many homes in our development do not have pools and many that do are smaller then the homeowners might have planned or desired. But they were build in accordance with the guidelines and one has to believe with the age of this subdivision that they have been followed for the safety of all who invest and live here. Also, it is my understanding that this home was purchased recently and the guidelines have not been changed /increased since the purchase of the property.
