Missouri Avenue between Turner Street and Druid Road. The property consists of an existing 1,600 square foot, single -story building, which has historically been operated as a restaurant (Sunshine Restaurant/Costa Alegre Restaurant). On August 3, 2007, a Flexible Standard Development (FLS) application was submitted to reestablish the restaurant use on the subject property with a reduction to the side (north and south) setbacks from ten feet to zero feet (to pavement/parking) as per Community Development Code (CDC) Section 2- 703.P. The project, while requesting deviations for side setbacks, would result in the property being able to meet the minimum front and rear setback requirements, as well as providing substantial landscape and architectural upgrades. On September 6, 2007, the Development Review Committee (DRC) reviewed the application and forwarded a recommendation to the Community Development Coordinator that it be approved, subject to the submission of revised plans and application materials that would address several conditions of approval. Community Development Board — April 15, 2008 APP2008 -00004 — Page 1 t 0 0 Subsequently, on October 8, 2007, as well as on at least one other occasion, the assigned case planner met with Mr. Jon Gaudineer to discuss the conditions of approval as well as the progress being made on the revised plans; however no revised plans were actually submitted for review. On March 11, 2008, the applicant submitted revised plans to the Planning Department. However, it was determined that these plans did not address a majority of the conditions of approval made by the DRC. Those conditions are as follows: o All solid waste containers, recycling or trash handling areas and outside mechanical equipment shall be completely screened on'all sides from view from public streets and abutting properties [ref: CDC Section 3- 201.D.1]; • All utilities, including individual distribution lines, shall be installed underground [ref: CDC Section 3 -911]; • A five -foot wide landscape buffer is required along the north and south sides of the property [ref: CDC Section 3- 1202.D.1]; ❑ The landscape buffer along the Missouri Avenue right -of -way shall consist of one tree every 35 feet [ref: CDC Section 3- 1202.D.1]; ❑ Ten percent of the gross vehicular use area is required on site as interior landscape areas [ref: CDC Section 3- 1202.E.1]; ❑ One tree is required per 150 square feet of required interior landscape area [ref: CDC Section 3- 1202.E.1]; and ❑ All landscaping shall be separated from vehicular use areas by the installation of curbing [ref: CDC Section 3- 1204.D]. Further, the revised plans also included the following new insufficiencies: • The easternmost proposed parallel parking space encroaches into the required 25 -foot front setback [ref: CDC Section 2 -703]; • A ten -foot wide landscape buffer with one tree every 35 feet and 100% shrubs is required along the west proporty line [ref: CDC Section 3- 1202.D.1]; ❑ The six parallel parking spaces along the south property line do not meet the required minimum length of 23 feet [ref: CDC Section 3- 1402.A]; ❑ The drive aisle along the north side of the property does not meet the required minimum width of 24 feet where adjacent to perpendicular parking spaces [ref: CDC Section 3- 1402.A]; ❑ The site plan does not depict the existing overhead utilities and as a result depicts a parking space that would not actually exist; and ❑ The landscape plan and the "plant legend" are substantially inconsistent with each other. On March 14, 2008, the Community Development Coordinator issued a development order denying the application. The development order (copy attached) stated that positive findings could not be made with regard to the application, and the application was therefore denied based upon the following findings of fact and conclusions of law: Findings of Fact: 1. That the 0.38 -acre parcel is located on the west side of South Missouri Avenue between Turner Street and Druid Road; 2. That the subject property has a zoning designation of Commercial (C) District and a General Commercial (GC) Future Land Use Plan category; 3. That the proposal to reestablish a restaurant on the subject property with reduced side (north and south) setbacks requires the approval of a Level One (Flexible Standard) application; Community Development Board — April 15, 2008 APP2008 -00004 — Page 2 • • 4. That as a Level One (Flexible Standard) application, the development proposal must comply with all applicable development standards and flexibility criteria as set forth in Community Development Code Section 2 -703; 5. That as a Level One (Flexible Standard) application, the development proposal must comply with the provisions of Community Development Code Section 3- 913.A; and 6. That the development proposal must comply with all other applicable sections of the Community Development Code. Conclusions of Law: 1. That the revised plans are not consistent with the application as originally submitted to and reviewed by the Development Review Committee; 2. That the development proposal does not fully comply with the applicable development standards set forth in Community Development Code Section 2 -703; 3. That the development proposal does not meet the minimum. landscape requirements set forth in Community Development Code Sections 3- 1202.D.1 and 3- 1202.E.1; and 4. That the development proposal does not meet the minimum design standards for parking lots set forth in Community Development Code Section 3- 1402.A. An appeal from the above Level One (Flexible Standard Development) decision was filed on behalf of the property owner by Jon Gaudineer and Frank Marinelli on March 21, 2008, consistent with the timeframe established for an appeal to be initiated in CDC Section 4- 502.A. Pursuant to CDC Section 4- 501.A.3, the Community Development Board (CDB) has the authority to hear appeals from Level One (flexible standard development) decisions. Pursuant to CDC Section 4- 504.A, the CDB shall review the application, the recommendation of the Community Development Coordinator, conduct a quasi-judicial public hearing on the application, and render a decision in accordance with the provisions of CDC Section 4- 206.D.5 granting the appeal, granting the appeal subject to specified conditions, or denying the appeal. It is noted that pursuant to CDC Section 4- 504.13, in order to grant an appeal, overturning or modifying the decision appealed from, the CDB shall find that based on substantial competent evidence presented by the applicant or other party that each and every one of the following criteria are met: 1. The decision appealed from misconstrued or, incorrectly interpreted the provisions of this development code; and 2. The decision of the CDB will be in harmony with the general intent and purpose of this development code; and 3. It is not necessary to use these at locations where runoff enters the site. Silt fence is also used for inlet protection and within dry retention ponds to filter runoff prior to discharge. Do not use silt fence or hay bales in water bodies. Use turbidity barriers when the barriers must be placed in water bodies. 3.2.2 Straw Bales: A straw bale barrier is a temporary sediment barrier consisting of a row of anchored straw bales. The primary use and purpose of a straw bale barrier is the same as that of a silt fence. Refer to the previous section for recommendations. Straw bales can also be used in ditches as check dams. as check dams along ditches. Sediment deposits should be removed when the level of deposition reaches approximately 1/2 the height of the bale. The useful life of straw bales is about 3 months. Straw bales have less filtering efficiency than silt fence, but their flow capacity is greater. 3.2.11: Soil Tracking Device (STPD): An STPD is a bed of stones that vehicles travel over prior to leaving disturbed areas. The primary purpose of tha STPD is to reduce the amount of soil tracked off the site by vehicles. The rough surface of the stone will shake the soil off of the tires as the vehicle goes over the entrance.
