Listed below are the responses to questions regarding rear setback. We are applying
for the rear setback of property listed above to be changed from 10' to 5'.
1) By allowing a reduction in the setback the retaining wall of the pool will create depth
and a pleasing rear elevation of the property. It will also create the opportunity for
vegetation and landscaping in setback below the retaining wall. This will enhance the
value of the property and those around it.
2) By allowing this reduction it will allow for a transition from the the retaining wall
to the landscaping below to the seawall. This will create a better transition from the house
to the pool to the seawall. This intention is to create the most pleasing view from the
water.
3) By allowing the 5' reduction it allows for walking and sitting area at the east side
of the pool and deck. This would not be possible without the reduction in the setback.
This will create a more functional use of the space as well as a beautiful pool deck and
rear elevation.
4) The scale %costs of this property will be visible in the properties landscaping & greenery
The owner will put much time and money into providing a pleasing landscaping
buffer on both sides of the property as well as a beautiful view from front and back
of property.
In closing, by allowing this setback reduction it creates better options for
the aesthetics of the project as well as the value of this house and the
houses around it. This reduction has no negative qualities attached to it.

This letter constitutes a Development Order pursuant to Section 4 -202.E of the Community
Development Code. On April 4, 2008 the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to allow reduction in rear setback from 10 feet
to 5 feet for pool deck and retaining wall. The DRC recommended approval of the application with the
following bases and condition:

1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2- 203.C;
2. The plan complies with General Applicability Criteria under the provisions of Section 3 -913; and
3. The proposed development is compatible with the surrounding area.

That the pool deck and spa not exceed 12 inches above existing grade
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above condition. The approval is based
on and must adhere to the application dated received February 26, 2008 and the revised site plan dated
received April 17, 2008.

As a property owner within 500 feet of 837 HARBOR ISLAND, the City of Clearwater Planning Department
gives notice that an application for Flexible Standard Development approval to permit a retaining wall and deck
at an existing detached dwelling in the Low Medium Density Residential / Island Estates Neighborhood
Conservation Overlay District (LMDR/ IENCOD) with a reduction to the rear (east) setback from ten feet to five
feet (to proposed deck and retaining wall) under the provisions of Section 2- 1602.E. 1.c. .
On April 03, 2008, the Development Review Committee (composed of the City's professional staff) will
review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determiniation, the Planning Director will issue a
Development Order approving, approving with conditions, or denying the application. The earliest date that
the City will make a decision on the application will be April 03, 2008.
The City encourages you to participate in the review of this application. You may contact me at 562 -4557 or
for further information, visit our office to review the files and /or submit written comments to be considered in
the City's review of the application. Please be advised that the applicant may submit additional or new

LIFTS. THICKER LIFTS ARE DIFFICULT TO COMPACT. OVERCOMPACTION OF
SMALLER LIFTS CAN CAUSE DECREASED COMPACTION DENSITY. MAKE 3 OR
4 PASSES WITH A PLATE COMPACTOR ON EACH LIFT. ADDING MOISTURE
