In this particular case the pavings up to the sidewalk will tend to dump rain water run off into the neighbor's grass, overwhelming it and doing damage to it. It will also set a bad precedent to allow property owners to go ahead and do the job and then expect it will get them the permission they might not have gotten had they done it the legal way to begin with. I ask that the request be denied. They are asking for no set back to their property between their property and their neighbor. This is wrong. Just because they violated the law and did the work already, they should not be granted this exception. The MINIMUM setbacks in the Clearwater rules are there for a reason and should be respected. Just because someone does the work and then says SORRY is no reason to grant an exception. I believe there is also a problem at this house with the minimum amount of green space needed in the front (35% I believe) They seem to have covered most of their property with pavers. Please deny this permit. Set back areas are for the utility companies and this is of utmost concern when these companies have to come out to repair items. The surrounding corner houses all have set back areas of porous content. Pavers are not porous. If the zero set back is allowed this could set a precedent for other properties nearby. This could result in a frontage of pavers or concrete up to and including the side walks on all corner houses. This is not in keeping with the residential area. All houses on this block of Eldorado have a 5ft set back. Many residents in the area have had to keep to the 5 ft set-back-area when putting in pools and pavers. To allow one house to have a zero set -back would be unfair to others who heave not been allowed a zero set -back and have had to keep to the 5 ft set -back If you do allow this zero setback please can you make sure that boats cars and other permanent or semi permanent items cannot be placed in the set back area.
