The adjacent property to the east has a two story garage /apartment built within two feet of the lot line. This apartment has a metal fire escape -like stairway along the back of the building facing onto our property. Renters come and go with an eagle -eye view into our kitchen, office and along the east property line. The proposed deck and arbor will be smaller in scale, bulk, coverage and density of the character of that dwelling. SEE ATTACHMENT 1 The property to the north of the lot line is built to within three feet of the property line and the driveway of that dwelling is built to within inches of the north property line. The deck and arbor will be smaller in scale and bulk than that dwelling as well. SEE ATTACHMENT 2 The dwelling currently has a set of original doors opening on the north side of the house to a height of 2 feet above the ground with no deck or patio to enter or exit the door from. It appears that the dwelling was intended to have access along that side but that it was either not constructed or had a deck at one time that was removed. The house is clearly built with the purpose of having access before it was subdivided leaving that north and east side of the dwelling so close to the lot lines. The effect is that the dwelling is left unfinished without access to the north entry doors. The already existing patio on the north -east comer of the lot is at ground level. The natural grade of the lot pitches down approximately 15 feet as it looks west, gradually meeting with the street. The house being level is left with the north doors 2 feet above the ground with no way to enter or exit them if no deck is built to the level of the doors on the north side. SEE ATTACHMENT 3 2. The adjacent dwwellings are built to within inches of the north and east property lines and can not be further developed so no hindrance of development will result from this structure. I The deck and arbor will be of standard construction and pose no health or safety risks to the neighborhood. SEE ATTACHMENT 4 4. Yes. The structures have pedestrian access only and minimize access and congestion. 5: Yes. Most houses in the neighborhood have wooden decks and/or patio decks around the dwellings. The neighborhood is older and the character of the neighborhood is such that many of the dwellings are built to the property lines. SEE ATTACHMENT 5 6. Yes. The arbor will maintain privacy along the east lot line from the adjacent dwelling and their garage apartment renters. The deck along the north lot line improves the visual impact of the dwelling and as well as creating a satisfactory entrance and exit from the original French doors that open on the north side of the dwelling but are elevated 2 feet above ground with nothing to walk on to enter or exit the dwelling. The deck provides the proper entry and exit from the dwelling. The house was built in 1925 when the lot was much larger and was perched amid an orange grove from what I have learned of the history of the property. As the lot was subdivided over the years and houses built adjacent to the property, deviations were allowed for those properties to be built within inches and feet respectively along the north and east lot lines. The result was to leave this house built very close to the north and east lot lines and the north entry and exit doors of the dwelling open two feet above the ground with no patio to enter and exit onto. The original patio on the north east corner is built to the lot lines and faces onto the garage apartment of the adjacent dwelling 2 feet to the east lot line. There is no way to create privacy without building a structure to those same patio specs to secure and protect the patio from the adjacent dwelling. The proposed structure must be built to the already existing patio. The proposed deck structure will continue the patio along the north lot line and be elevated to the proper height so as to make the north doors of the dwelling accessible. The deck must be built to the already existing patio specs in order to make continuity of structure and prevent the north side of the house from being unusable. 2. No. The adjacent properties to the north and east are already built to within 2 feet of the lot line on the east and inches of the lot line on the north. 3. Yes. The deck and arbor structures are in use throughout the City of Clearwater. 4. Yes. The dwelling to the east already has a patio and staircase rising two stories within two feet of our lot line and is used as a traffic area for the only entrance and exit of her garage apartment. Renters regularly come and go along that lot line on the east side. SEE ATCHMENT 6 The dwelling to the north has a driveway and is the common traffic way for the north dwelling. The deck will be in keeping with the use of that property to the north. SEE ATCHMENT 7 5. Yes. The deck and arbor structures enhance the property and neighborhood, creating both visual aesthetic and proper use of the dwelling and patios which can not now be used without the added structures. Making the north side of the house usable enhances the already existing dwelling by creating form and function of those doors and patio. 6. Yes. The flexibility is required to allow the already standing dwelling, that is already built using deviations from the development standards, to. be used on the north and east sides of the property. Without the flexibility the north and east sides of the dwelling are unusable, depress the market value of the dwelling and the adjacent dwellings and make maintenance and use of those sides of the house virtually impossible. The dwelling was built before the lot was divided and was allowed to be divided in such a way that it left the north -east side of the house built up to the lot lines. There is no way to access the doors and patio on that corner without continuing to allow for flexibility in regard to the required setbacks. Flexibility to build the proposed structures. will restore the integrity of that side of the dwelling that was lost when the property was allowed to be subdivided decades ago.
