The uses within the residential infill project are otherwise permitted in the City of Clearwater. 4. The uses or mix of use within the residential infill project are compatible with adjacent land uses. 5. The design of the proposed residential infill project creates a form and function that enhances the community character of the immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole. 6. The expansion of the swimming pool screen enclosure by 77' at the rear, bringing it to 5W, of the rear property line (5' setback) is essential to accomplish the purpose for which it should be expanded. The current setback of 10' would only allow for the enclosure to be 2'6" larger. Not enough to bother doing. The reason the expansion would be done is to allow adequate safe room for children around the pool, especially at the slide. You can see in the photo attachment (2 -204 a.) how tight it is right now. This puts the unutilized space just outside the enclosure to good use. 2. The slightly larger screen enclosure improves the home and will slightly increase its value and thereby the value of the abutting properties. The Pinellas County Tax Appraiser states the Just/ Market Value of this house at $793,500 and the screen enclosure at $5.00 a foot, new. The Just /Market Value of the house would increase to $794,590. It will cost more than that to build, but it does increase the value by $1,290 and it will be better for the children. And it will in reality increase the value of the house a bit more than using the Appraiser's math, since the enclosure will be noticeably improved in usefullness. 3. Yes. It's use is an enclosure for a residential swimming pool. 4.The use of it is compatible with adjacent land uses. The next door neighbor also has a swimming pool and they're common in Harbor Oaks. 5. The design creates a form and function that enhances the community character of the immediate vicinity and the City of Clearwater. It will be a nice, white alumininum screen enclosure, totally consistent with the existing enclosure it will be a part of, and it looks very upscale and consistent with the house and area. 6. It will benefit the community in that it makes this home a little better and this home is a part of the community. It does this without infringing on any uses by anyone of anything. D. 1. The proposed development will be in harmony with the scale, bulk, coverage, density and character of adjacent properties: There are 2 properties to the rear (this proposed development is at the rear). The one pn the west has a structure that is no more than 7' from its rear property line. See attachment photo D. 1.a. The one on the east has a structure that is 5' from its rear line. See D. 1.b. That one is directly behind the Feldman's screen enclosure. On the sides of the Feldman property, the home on the west has a structure that is 2'10" from the property line (see photo D.1.c.) and the home on the east a structure that is 8 or 10 feet from the line. (photo D.1.d.). The existing garage /guest house structure on the Feldman property, adjacent to the screen enclosure, is only 3'4" from the rear property line. (It's a 1914 house.) The proposed sceen porch extension doesn't make the Feldman property more densely covered than the adjacent properties in any respect. It changes no character. The tree within 25' is located on the survey. Rick Albee, arborist, of the Planning Department, came out and looked this site over. The tree within 25" of the screen enclosure he said is a mix, mostly live oak. He said a slab under the proposed 72" screen enclosure extension should not affect the roots and would be okay. Attached is his signature on the proposed job. Attached is a location map of the property. Parking demand is no -effect and inapplicable. Grading will remain the same.
