The following letter is a request for approval of the attached application for the project at the above
referenced address.
This project is part of a large parcel encompassing six lots. This parcel is bound on the north by
Cleveland Street, on the west by S. Myrtle Ave., on the south by Park Street, and on the east by town
homes and an auto repair and body shop.
The actual building in question is located at the corner of Cleveland Street and S. Myrtle Ave. This
building has been here for more than thirty years, being occupied by Avis Rentals for the past ten years.
The building is being remodeled to accommodate two tenants. We will be relocation Avis to the south
end of the building and creating a new space for a restaurant -cafe use, with an outdoor landscaped patio
along S. Myrtle Ave.
This application is intended to allow this building to be used for "A -2 Restaurant and Retail Sales &
Services (rental vehicles) ", as allowed in the Downtown District (D). This building and property
complies with all of the flexible standards for development as listed.
1. Height, we will be well below the maximum height of 30 -50, design is @ 18feet.
2. Off-street parking, allows for 5 -15 /1000 GFA for restaurant use and 2- 4/1000 GFA for retail sales &
services. The site plan is designed with 41 spaces at this time.
3. The remodeling of the building while complies with the City's guidelines.
This project will be a drastic improvement over the existing building. The drastic change of the exterior
building improvements along with a new Cafe tenant incorporating a landscaped outdoor patio on this
corner in the downtown will be a landmark.

The storm water narrative as requested in Section E of the application is as follows;
The existing site for the most part is 99% paved with a catch basin tied to the City's storm
drain system. There are also several curb inlets around the perimeter of the property.
Theses have been the means of control for over the past thirty years.
We are located in the Downtown District and we are not increasing the size of the
buildings that exist on the property but we will be reducing the overall impervious area.
As we remodel the various building on this property we will be addressing the increase of
landscape areas. It is our understanding that we would not be required to create a retention
area unless there was a substantial redevelopment of the site.
If you have any other questions or concerns please don't hesitate to contact me. We look

This letter constitutes a Development Order pursuant to Community Development Code (CDC) Section
4- 206.D.6. The Flexible Standard Development application to renovate the building exterior and to
establish businesses consistent with those specifically authorized uses. within the Downtown (D)
District pursuant to CDC Section 2 -902 of the Community Development Code and the Clearwater
Downtown Redevelopment Plan has been APPROVED based upon the following Findings of Fact and
Conclusions of Law and subject to the attached conditions of approval:
Findings of Fact
1. That the 0.313 -acre subject property is located at the southeast corner of Cleveland Street and.
Myrtle Avenue;.
2. That the subject property is located within the Downtown (D) District and the Central Business
District (CDB) Future Land Use Plan category;
3. That the development proposal is subject to the requirements of the Clearwater Downtown
Redevelopment Plan and the Design Guidelines contained therein as the parcel is located within the
Town Lake Residential character district;
4. That the subject property consists of existing back -out parking spaces along Myrtle Avenue that
are non - conforming with regard to CDC Section 3- 1402.C;.
5. That the development proposal is. compatible with the surrounding area and will enhance other
redevelopment efforts; and.
6. That there are no. outstanding Code Enforcement issues associated with the subject property.
Conclusions of Law:
1. That the development proposal is consistent with the Downtown Design. Guidelines;.
2. That the development proposal is. consistent with the Visions, Goals, Objectives and Policies of the
Clearwater Downtown Redevelopment Plan and the Town Lake Residential character district;
3. That the development proposal is. consistent with the Standards and Criteria as per CDC Section 2-
902 and the Clearwater Downtown. Redevelopment Plan;
4. That the development proposal is consistent with the General Applicability Criteria as per CDC
Section 3 -913; and
5. That the development proposal reduces the number of existing non - conforming back -out parking

Conditions of Approval:
1. That prior to the issuance of the first Certificate of Occupancy, all utility boxes, meters, etc. shall
be painted as part of the overall color scheme;
2. That prior to the issuance of the first Certificate of Occupancy, all utilities, including individual
distribution lines, shall be relocated underground;
1. That any /all wireless communication facilities to be installed concurrent with or subsequent to the
construction of the subject development must be screened from view and /or painted to match the
building to which they are attached, as applicable;
4. That any /all future signage must meet the requirements of Code and be architecturally integrated
with the design of the building with regard to proportion, color, material and finish as part of a
final sign package submitted to and approved by Staff prior to the issuance of any permits which
includes:
(a) All signs fully dimensioned and coordinated in terms of including the same color and font
style and size; and
- (b) All signs be constructed of the highest quality `materials which are coordinated with the
colors, materials and architectural style of the building; and
5. That the final design and color of the building shall be consistent with the architectural elevations
approved with this application.
I concur with the above findings and, through this letter, approve your application for Flexible
Standard Development with the above conditions. This approval is based upon, and must adhere to,
the application and development plans received June 11, 2008.
Pursuant to CDC Section 4 -303, an application. for a building permit shall be made within one year of
the Flexible Standard Development approval (byJune 18, 2009).. The building permit must be obtained
within six months. of the initial permit application.. This timeframe to obtain. the initial building permit
may be extended for an additional six months for cause by the Community. Development Coordinator.
All required. certificates. of occupancy must be obtained within two. years of the date of issuance of the
building permit..
The issuance of this. Development Order does not relieve you of the necessity to obtain building
permits or pay impact fees that may be required.. In order to facilitate the issuance of any permit or

have a distinct "base," "middle" and "cap." The proposed building has a substantial cap; however
lacks a clearly defined base and middle. The cap may need to be reduced in order to allow for
adequate space for the other architectural elements..
❑ Pursuant to the Design Guidelines of the Clearwater Downtown Redevelopment Plan, buildings on
corner lots shall emphasize their prominent location through the use of additional height, massing,
distinctive architectural treatment and/or other distinguishing features. The proposed building does
not take advantage of its prominent location and provide emphasis as per the above Guideline.
❑ Pursuant to the Design Guidelines of the Clearwater Downtown Redevelopment Plan, windows shall
create a consistent and cohesive fenestration pattern. The southernmost portion of the west elevation
and the south elevation are inconsistent with the balance of the building..
o Pursuant to the Design Guidelines of the Clearwater Downtown Redevelopment Plan, doors shall
enhance and support the architectural style of the building. The west elevation consists of several
doors, not all of which are necessary for access to interior spaces. These doors do not further the
architectural style of the building and are inconsistent with the above.
❑ Pursuant to the Design Guidelines of the Clearwater Downtown Redevelopment Plan, gutters,
downspouts, utility boxes, meters, etc. shall be painted as part of the overall color scheme.
• The proposed bulkheads have not been carried over to the south elevation.
• A portion of the bulkhead is not depicted on the north elevation.
• The northernmost storefront on the west elevation appears to depict sidelights inconsistent with the
balance of the building.
o The parapet cap for the west elevation appears to differ from the other three elevations.
❑ The architectural elevations denote something (by way of a small box with the letter "J ") on the
cultured stone columns. Clarify what is proposed. If the notation is to identify the locations of
outdoor lighting, then provide details as to how the proposed light fixture(s) comply with the
applicable Design Guidelines.
