The proposed development of the land will be in harmony with the scale, bulk, coverage, density and character of adjacent properties in which it
is located.
Proposed alteration affects only the existing non - original, non - contributing, storefront. The design
aesthetic utilized is more in keeping with the character of the building and surrounding buildings than
the present storefront.

The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly
impair the value thereof.
Storefront improvements aim to increase the value of host building and surrounding neighborhood.
Increased foot traffic, concern for the pedestrian scale, and elevated level of design are in the best
interest of the tenant.

The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use.
The nature of business activities conducted at the real estate office does not generate physical, audible,
or olfactory byproducts deemed offensive or unsafe. Tenant's branch location in Tampa's "Old Hyde
Park Village" mixed use development is a model tenant with no complaints.

The proposed development is designed to minimize traffic congestion.
Tenant relies heavily on foot traffic. Occupants employed are much less than permitted per code.
Corporate image of the store is restrained.

The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development.

3 . Per the Clearwater Downtown Development Plan, exterior paint colors should always be
appropriate to the architectural style of the building. Traditionally muted earth -toned colors,
which are found in stone, brick, wood and terracotta, composed the basic color palette of
downtown areas. Furthermore the CDDP states that more than three different colors or color
shades used on a single building unless appropriate to the architectural style of the building is
inappropriate. The plans submitted reflect that all woodwork shall be gloss white. This color is.,
not consistent with the CDDP and increases the colors used on the building. Update plans to
better reflect the color palette desired of the Downtown Development Plan including colors that
compliment the building.
4. Per the Clearwater Downtown Development Code, windows and architectural elements shall
match the building architecture. All windows and architectural elements proposed need to match
the existing building window design and architectural elements.
5. Per the Clearwater Downtown Development Plan, existing storefront openings shall maintain
their original size and shape. Proposed storefront opening is not consistent with this standard.
6. It appears that unapproved work has been done to the storefront prior to approval to the
submitted application. As stated, this work is not approved and also is inconsistent to the
submitted plans. Update plans to reflect the work done and it is important to note that this work
is subject to approval.
7. Remove all signage from plans including foundation signage as they will be submitted through a
separate signage applciation.
8. Plans submitted reflect, "New canopy to match height profile and projection of adjacent tenant."

Thank you for your expedient review of our "Flexible Standard Development
Application" for Engel & Volkers - Clearwater located at 432 B Cleveland Street.
Below I have listed your zoning conditions and my responses. Please notify me if I
have not adequately addressed the conditions.
Zoning Conditions:
1) -Not Met- 1/9/2009 M.J.
Provide complete responses to the criteria found in the Clearwater Downtown
Redevelopment Plan.
Response: I need further clarification on this condition. Prior to submitting the
FSD application I reviewed all the sections with Mr. Tefft for applicability.
Numerous sections appear to represent an unnecessary burden for a storefront
replacement (i,e. survey requirement). If you can provide me with the sections I
have incorrectly omitted I will address them promptly.
2) "Not Met" 1/12/2009 M.J.

Per the Clearwater Downtown Development Code, windows and architectural
elements shall match the building architecture, All windows and architectural

Response: The only architectural elements remaining on the building is the
decorative frieze and brick columns on Cleveland Street and a portion of Harrison
Avenue. The remainder of the building is a stuccoed box. None of the windows
on the street facades Wt and 2 n floors) are original. All existing windows on these
facades are non- descript aluminum storefront systems with black frames.
Proposed design utilizes similar windows with architectural elements (period
correct pilasters and base panels) that enhance the remaining architectural
elements on the building.
6) "Not Met" 1/20/2009 M.J.
It appears that unapproved work has been done to the storefront prior to
approval to the submitted application. As stated, this work is not approved and
also is inconsistent to the submitted plans. Updated plans to reflect the work done
and it is important to note that this work is subject to approval.
Response: rojo Architecture was unaware of work being done to exterior of the
building. Per rojo's scope of work renovation documents were produced in two
phases: Phase 1- Interior renovations (permitted under BCP2008- 11087) Phase 2 -
Applied for under application FLS2008- 12030. Following notice from C.O.C.
regarding exterior renovations rojo contacted General Contractor, Per GC's
indication all work done to the exterior of the building was a temporary "band -
aid" to facilitate tenant occupation prior to approved renovations of exterior.
Alterations were limited to non- contributing storefront intended to be removed
during renovation.

Satin Finish / Cream: Main building body.
Matte Finish / Antique White: Frieze

Gloss white is the corporate image for Engel & Volkers. The tenant is open to
another "restrained color' for use on the storefront woodwork as long as they can
maintain the gloss finish.

shall maintain their original size and shape. Proposed storefront opening is not

Response: Existing storefront openings are proposed to remain the same size.
The new storefront (pilasters, entablature, and base panel) is to be placed within
the existing opening. Storefront opening is the same size.

The revised plans have been reviewed by staff and it was determined that the plans
submitted do, not address the following and previously provided staff conditions.
1. Per the Clearwater Downtown Development Plan, existing storefront openings .
shall maintain their original size and shape.. Proposed storefront opening is not
consistent with this standard.. The existing storefront contains two doors, not one.
2. Per the Clearwater Downtown Development Code, windows and architectural
elements shall match the building architecture.. All windows and architectural
elements proposed need to match the existing building window design and
architectural elements.. The submitted revisions do address the east window, but
the architectural style /colors and materials of the areas under the windows do not
match those of the rest of the building..
3. Remove all signage from plans including foundation signage as they will be
submitted through a separate signage application.. Resubmitted plans include
signage. Also, a non- permitted sign has been. placed on site..
4. Provide complete responses to the applicable criteria found in the Clearwater
Downtown Redevelopment Plan. Responses have yet to. be submitted..
5. Per the Clearwater Downtown Development Plan, exterior paint colors should
always be appropriate to the architectural style of the building.. Traditionally

discussion with. staff it was determined that again the colors proposed are not
consistent with the above condition/criteria.
To. gain approval for the submitted application all the aforementioned conditions must be
met. It is staff's recommendation that discussion should be made with the owner of the
building with regard to bringing the entire building into compliance with the design
guidelines of the Clearwater Downtown Development Plan..
Staff does understand that this application request was submitted for approval after work
was completed, but this does not constitute grounds for approval.. And as stated in the
February 5, 2009 DRC meeting, the design of the storefront must take into consideration
the architectural styles and colors of the entire building..
