Judge Castagna is the owner of a cemetery plot in the City of Clearwater Cemetery. Attached is a copy of the Cemetery Deed. There is a large mausoleum on the cemetery plot and Judge Castagna has maintained the mausoleum since he took title to the lots. Recently I created a trust which will govern how the mausoleum is to be maintained by the Castagna Family once Judge Castagna dies. I am planning to record a deed from Judge Castagna to him as trustee of the trust. The attached deed states: "This conveyance is subject to the condition that Grantee herein shall not assign or convey said property without the written consent of the Grantor, and to the further condition that said property shall be used only for cemetery purposes as human burial sites." Since Judge Castagna owns the cemetery lots and the trust has been created by Judge Castagna to insure the mausoleum will be maintained by the family, I feel certain the City of Clearwater would not object to the conveyance to the trust. The City Clerk's office maintains the records relating to the cemetery. Would the City Clerk be the person who could provide written approval of the transfer to the trust on behalf of the City?
