ORDINANCE NO. 8300-11
AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, VACATING THAT CERTAIN DEDICATED 15-
FOOT WIDE ALLEY IN BLOCK 1 OF THE WALLACE
ADDITION TO CLEARWATER, FLA., AS SHOWN ON THE
MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK
3, PAGE 6, OF THE PUBLIC RECORDS OF
HILLSBOROUGH COUNTY, FLORIDA, OF WHICH
PINELLAS COUNTY WAS FORMERLY A PART, LESS THE
NORTH 30 FEET THEREOF FOR STREET PURPOSES,
SUBJECT TO SPECIAL CONDITIONS; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, FSH7, LLC, owner (the Owner) of real property located in the City of
Clearwater, Fla. (the City), has requested that the City vacate the alley depicted in Exhibit
A attached hereto; and
WHEREAS, the City Council finds that said alley is not necessary for municipal
street purposes, and it is deemed to be to the best interest of the City and the general
public that the same be vacated, subject to special conditions; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. The following:
That a certain dedicated 15-foot wide alley lying in Block 1 of the Wallace Addition to
Clearwater, Fla., as shown on the map or plat thereof, as recorded in Plat Book 3, Page
6, of the Public Records of Hillsborough County, Florida, of which Pinellas County was
formerly a part, less the north 30 feet thereof for street purposes shall hereby be vacated,
closed and released, and the City releases all of its right, title and interest thereto,
contingent upon the following conditions:
1. The Owner grants the City a blanket utility easement over the described property
for the installation and maintenance of any and all City utilities thereon;
2. The Owner grants easements for the maintenance of private utilities owned and
maintained individually by Verizon and Bright House located within the described
property; and
3. The site plan for the vacated property submitted under Flexible Development
Application Number 2011-10036 is fully approved.
4. This vacation ordinance shall be null and void if any of the preceding conditions
are not met within 45 calendar days of approval of the site plan as required in
condition 3 hereof.
Section 2. The City Clerk shall record this ordinance in the public records of
Pinellas County, Florida, following adoption.
