PARKING AGREEMENT (2)AGREEMENT IN CONSIDE TI of the terms set forth in this agreement made and entered into this � day of 11, subject to all applicable pravisians of the Clearwater Community Redevelopm�nt Agency, a body politic and corporate under the laws of the State af Flarida (hereafter "CR.A"), and as an inducement to rErnain within, and to provide employment within the CR.A Business District of Dawntown Clearwater, a parking incentive (hereafter " Parking Agreement") to be made available to Sports Facilities Advisory. AS A PROVISION of the Parking Agreement, the parties agree as follows: l. Sports Facilities Advisory has located and wili maintain its headquarters inside the CR.A Downtown Business District for the term of this agreement. 2. The term af this agreement will not to exceed forty-eight rnonths (48) from the dat� of execution of the parking agreement. 3. Confirmation of at least seven (7) full-time employees at its business address within the CRA Downtown Business District is required priar to assignment of parking spaces. This is to be verified by a notarized letter from the Owner/COO of Sports Facilities Advisory and confirmed by payroll reports shawing corporate aruival payroll at $329,000. 4. The Parking Agreement will be reviewed semi-annually during the term of the agreement by CRA/Econarnic Development staff for compliance. At Year Qne (1) review, 2012, if staffing levels fall belaw eight (8) employees or corporate average annual wages aze below $369,724 the agreement shall be in default. Sports Facilities Advisory has three (3) months from date of review to bring the agreement into compliance. 5. At Year Two (2) review, 2013, if staffing levels fall below ten (10) emplayees or corporate average annual wages are below $463,390 Sports Facilities Advisory has three (3) months from date of review to bring the agreement into compliance. 6. At Year Three (3), 2014, if staffing levels fall below ten (10) employees or corporate average annual wages are below $463,390 Sports Facilities Advisary has three (3) rnonths from date af review to bring the agreement into compliance. 7. At Year Four (4) review, 201 S, if staffing levels fall below ten (1 Q) employees or corporate average annual wages are below $463,390 Sports Facilities Advisory has three (3) months from date of review to bring the agreement into compliance. 8. In the event that Sports Facilities Advisory fails to comply with the terms of this Parking Agreement or terminates its lease agreement, for any reason, the Parking Agreement with the CR.A shall be null and void without further obligation on the part of the CRA. 9. CR.A and the City parking system will provide three (3) parking spaces at a tax- exempt cost of forty-five dollars ($45.00) each where designated in the Garden Avenue Garage for a four-year periad. The estimated value of such spaces sha11 not exceed Six Thousand Four Hundxed and Eighty Dollars ($6,4$p.00). 1 Q. CRA will pay the parking system on a quarterly basis. 11. Sports Facilities Advisory agrees to pay for each refiu�►dable card deposit requir�d by the City pazking system. Each cardholder will be required to complete a standazd parking applicatian.
