AMOS AND ANNA SHUGARS (2) .: ~.I . - 1:- REAL ESTATE CONTRACT THIS AGREEMENT, made and entered into this I ~ 7f:;tv day of April, A. D. 1972, by and between AMOS C. SHUGARS and ANNA SHUGARS, his wife, hereinafter referred to as lISeller", and the CITY OF CLEARWATER, FLORIDA, a municipal corporation, hereinafter referred to as"Purchaser11; WITNESSETH: That in consideration of the Mutual promises and covenants herein contained, and other valuable considerations passing between the parties hereto, the Seller agrees to sell and the Purchaser agrees to buy the following described property situate, lying and being in Pinellas County, Florida, to wit: South 326. 14 feet of North 821. 35 feet of West i of NW ~ of NW ~ of Section 16, Township 29 South, Range 16 East, AND start at SE corner of NW ~ of NW ~ and run North 730 feet to P. O. B. ; thence North 95 feet, West 669.05 feet, South 495.21 feet, East 469.05 feet, North 400. 21 feet, East 200 feet to P. O. B. subject to 10 foot alley at one end of tract and 30 foot right of way on North and less road on East, being ten acres plus. The total purchase price of said property shall be the sum of Sixty Thousand Five Hundred Dollars ($60,500.00), payable at the times and in the manner following: $1, 000. 00 binder paid to the Seller s at the time of the signing of this agreement, receipt of which is hereby acknowledged. Balance in full at time of closing, and possession to be given at closing. IN CONSIDERATION WHEREOF, the Seller agrees and promises to convey to the Purchaser by good and sufficient warranty deed containing full covenants of warranty a fee simple, marketable title to the real estate above described, free and clear of all encumbrances, except as herein otherwise provided. Purchaser shall at its expense obtain a commitment for title insurance in the amount of the purchase price, which commitment shall show a marketable, - unencumbered, fee simple title to said property in the Seller except as herein otherwise provided. The Purchaser shall have a reasonable time after the -I. );ZDLfg-3;z ) ~ (,. I I delivery of said commitment for the examination thereof, and within said period shall notify the Seller in writing of any objections to said title. If this notification is not given within a reasonable time, then said title shall be conclusively deemed to be acceptable to the Purchaser. In the event that the title of the Seller is not good and marketable, the Seller shall have a reasonable time thereafter to perfect the title; and if the defects are not cured within such time, the Purchaser may cancel this contract or waive the defects and accept the property without deduction on account of said defects. The Purchaser shall pay for the documentary stamps required to be affixed to the Deed and pay the cost of recording same. Taxes for the year 1972 shall be paid by the Purchaser. Subject to the foregoing, this transaction shall be closed on or before May 8, 1972, the exact date to be determined by the Purchaser. This contract supersedes and replaces the terms and provisions of the prior real estate contract between the same parties covering the same property dated and executed on January 7, 1972. The obligations and benefits under this contract shall extend to the personal representatives, heirs, successors and assigns of the parties hereto.
