8252-11�RDINANCE NO. 8252-11 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING THE FUTURE LAND USE PLAN ELEM�NT OF THE COMPREHENSIV� PLAN OF THE CITY, TO DESIGNATE THE LAND US� FOR C�RTAIN RE4L PROPERTY LOCAT�D ON THE SOIJTH SIDE OF NURSERY ROAD APPROXIMATELY 495 FEET WEST OF SOUTH HAVEN DRIVE, CONSISTING OF EAST 85 FE�T OF WEST 3dQ FEET OF NORTHWEST '/4 OF S�UTHWEST '/4 �F SOUTHEAST °/4 OF SECTION 19, TOWNSHIP 29 SOUTH, RANGE 16 EAST, LESS RIGHT �F WAY FOR NURSERY ROAD, WHOSE POST OFFICE ADDRESS IS 2419 NURSERY ROAD, UPON ANNEXATION INTO THE CITY OF CLEARWATER, AS INSTITUTIONAL (I) AND WATER/ DRAINAGE FEATURE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the amendment to the future land use plan element of the r.nmprehensive plan of the City as set forth in this ordinance is found to be reasonable, proper and appropriate, and is consistent with the City's comprehensive plan; now, therefore, BE IT ORDAINED BY TH� CITY COUNCIL OF THE CITY OF CL�ARWATER, FLORIDA: Section 1. The future land use plan element of the comprehensive plan of the City of Clearwater is amended by designating the land use category for the hereinafter described property, upon annexation into the City of Clearwater, as follows: PropertX The East Eighty-five (85) feet of the West Three Hundred (30�) feet af the Northwest Quarter (NW %4) of the Southwest quarter (5W'/4) of the Sautheast quarter (SE %4) of Section 19, Township 29 South, R�nge 16 East, Pinellas County, Flarida. L�SS any part of said Tract lying within right of way of Nursery Road. (LU P2Q 11-Q2003) Land Use Category From: Residential Urban (RU) Water/Drainage Feature Ta: Ins#itutional (I) Water/Drainage Feature Th� map or maps attached as Exhibit(s) are hereby incorporated by r�ference. Section 2. The City Council does hereby certify that this ordinance is consistent with the City's comprehensive plan. Section 3. This ordinance shall take effect immediately upon adoption, subject to the approval of the land use designation by the Pinellas Caunty Board of County Commissioners, and subject to a determination by the State of Florida, as appropriate, of compliance with the applicable requirements of the Local Gavemment Comprehensive Planning and Land Development Regulation Act, pursuant to § 163.31$9, Florida Statutes. The Community Development Coordinator is authorized to transmit to the Pinellas County Planning Council an application to amend the Countywide Plan in order to achieve consistency with the Future Land Us� Plan Element of the City's Comprehensive Plan as amended by this ordinance.
