SECOND EXTENSION TO VEHICLE TOWING SERVICE CONTRACTSECOND EXTENSION TO VEHICLE TOWING SERVICE CONTRACT
THIS AGREEMENT made and entered into on the day of ~ U , 2011, by
the City of Clearwater, Florida, a municipal corporation, hereinafter referr to as the "City,"
and Gator Towing and Transportation Services, Inc., hereinafter referred to as "Contractor," is
to extend the current Vehicle Service Contract entered into between the City and Contractor.
WHEREAS, the City entered into a Vehicle Towing Service Contract for the towing and
storage of vehicles and other services for a term of three (3) years, ending on July 31, 2010
with an option of an additional two years thereafter;
WHEREAS, the City entered into an agreement to extend the Vehicle Towing Contract for
an additional one (1) year with the understanding that the City would begin preparations to
obtain bids from Contractor and other towing companies for a new Vehicle Towing Service
Contract to begin on August 1, 2011, which would include all of the services being provided
under the current Contract as well as the towing of vehicles currently being towed by a number
of towing companies providing services on a rotation basis; and
WHEREAS, because the bidding process has taken longer than anticipated, the City and
Contractor agree to extend the current Vehicle Towing Contract for up to an additional (3)
three months so that the bidding process can be completed.
NOW THEREFORE, in consideration of the promises and the mutual covenants contained
in this Agreement, the Contractor and City hereby agree as follows:
The Vehicle Towing Service Contract between City and Contractor, which terminates on July
31, 2011, is hereby extended for up to additional (3) three months to October 31, 2011. All
other terms and conditions of the original Vehicle Towing Service Contract shall remain in
effect. The City and Contractor agree that the Contract may be terminated sooner than (3) three
months if a new Vehicle Towing Service Contract is awarded prior to October 31, 2011.
