Attached is information related to the request by C. Randolph Wedding, on behalf of Canterbury
Wedding & Stephenson, Architects, for an extension of time relative to the above referenced
project located at 1105 Druid Road. A one -year extension is being requested which would expire
on July 21, 2012.
Pursuant to Section 4 -407 of the Community Development Code, extensions of time "shall be for
good cause shown and documented in writing." The Code further delineates that good cause may
include but are not limited to an unexpected national crisis (acts of war, significant downturn in
the national economy, etc.), excessive weather - related delays, and the like." In this particular
case, the applicant has indicated that legal actions taken against the property which clouded the
title have been resolved and they are now ready to secure building permits. It should be noted
that, pursuant to Section 4 -407, the Planning Director has previously granted a one -year extension
to resolve the legal issues.
The Code further directs that the Community Development Board may consider whether
significant progress on the project is being made and whether or not there are pending or
approved code amendments which would significantly affect the project.

Due to circumstances beyond the control of my client, a disgruntled party filed a Lis Pendes
against this property, which has clouded the title and prevented the project from going forward.
The good news is that the case has finally been resolved.
While this provided a green light for the project to proceed, we still need several months to
complete the work necessary to secure a building permit and begin construction.
Since the attached Development Order will expire July 21, 2011, it is clear that we will be out of
time before we can complete the work necessary.
The purpose of this letter is to request an extension of this development order until July 21, 2012.

Time Extension Development Order
Dear Mr. Wedding:

On July 21, 2009, the Community Development Board (CDB) approved, subject to
conditions, the above referenced Flexible Development application to permit a 112 -bed
assisted living facility in the High Density Residential (HDR) District with a reduction to
the minimum off - street parking requirement from 71 spaces to 64 spaces, an increase to
the building height from 30 feet to 53 feet (to flat roof), a reduction to the front (north)
setback from 25 feet to 20 feet (to pavement), a reduction in front (west) setback from 25
feet to 15 feet (to pavement), a reduction in side (east) setback from 10 to three feet (to
pavement) and a reduction in side (south) setback from 10 to three feet (to pavement) as a
Residential Infill Project, pursuant to Community Development Code Section 2- 504.F;
and a reduction to a portion of the perimeter landscape buffer along the east and south
property lines from 10 feet to zero feet (to pavement) as part of a Comprehensive
Landscape Plan, pursuant to Community Development Code Section 3- 1202.G.
Pursuant to Community Development Code Section 4 -407, the application for a building
permit is required within one year of the date the CDB approved the request (by July 21,
2010). This same Section allows an extension of time to initiate a building permit,
provided good cause is shown and documented in writing within the original period of
validity. The Planning and Development Director may also consider whether significant
progress on the project is being made and whether or not there are pending or approved
Code amendments that would significantly affect the project.
On June 16, 2010, you submitted a request for a one -year time extension to apply for a
building permit to construct the improvements on this parcel. Your letter cited legal
actions against the subject property owner that clouded the title and prevented the project
from proceeding.
In accordance with the provisions of Community Development Code Section 4 -407, I
APPROVE a one -year time extension to July 21, 2011, to submit an application for a

building permit to construct the building and site improvements on your parcel at 1105
Druid Road.
In the event you are unable to proceed with the project by submitting for the building
permit, the CDB may approve one additional extension of time to initiate a building
permit application. Such extension shall not exceed one year, shall be for the project
originally approved (or as approved through the Minor Revision process) and shall be for
good cause shown and documented in writing. The CDB must receive the request for
this extension within the time frame granted by the Planning and Development
Director (period of validity after the original extension approved by the Planning
and Development Director, which means that any time extension request must be
submitted with sufficient lead time to be placed on the CDB agenda that precedes
the above expiration date). Good causes may include, but are not limited to, an
unexpected national crisis (acts of war, significant downturn in the national economy,
etc.), excessive weather- related delays, and the like. The CDB may also consider these
same Code amendments enumerated above, whether significant progress on the project is
being made and whether or not there are additional pending or approved Code
amendments that would further significantly affect the project.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In
order to facilitate the issuance of any permit or license affected by this approval, please
bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.
