04/05/2011 BUILDING/FLOOD BOARD OF ADJUSTMENT AND APPEALS MEETING MINUTES CITY OF CLEARWATER April 5, 2011 Present: John H. Logan, Jr. Chair Edward H. Walker, Jr. Board Member Pankaj Shah Board Member Gary Richter Board Member Absent: Arthur Shand Board Member Also Present: Leslie Dougall-Sides Assistant City Attorney Kevin Garriott Building Official Nicole Sprague ORLS Coordinator The Chair called the meeting to order at 2:00 p.m. at City Hall. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. 2 - Approval of Minutes – February 11, 2011 Member Shah moved to approve the minutes of the special Building/Flood Board of Adjustment and Appeals meeting of February 11, 2011, as submitted in written summation to each board member. The motion was duly seconded and carried unanimously. 3 – Continued Requests : None. 4 – New Request : 4.1. Case: MIS2011-03001 – 1 Windward Island – Legal Description: Island Estates of Clearwater Unit 4 Lot 18 – Agent: Katherine Cole, Esq.; Appellants: David & Aileen Bair – Request: Variance Relief from 18-foot setback to seawall to allow construction a accessory structure. Katie Cole, representing David & Aileen Bair, said the applicants requested relief from the requirement that accessory structures be built at least 18 feet from the seawall. She said the swimming pool is 13 feet from the seawall. She said the applicant intends to construct, within 10 feet of the seawall, a covered outdoor living space on two concrete pads. She said interlocking pavers will be installed, retaining access to the deadmen. In response to questions, Building Official Kevin Garriott said the City cannot locate information related to approval of installing the swimming pool in its location. The outdoor space will be similar to a covered patio. The City has no objections. Member Richter moved that the Building/Flood Board of Adjustment and Appeals approved the request to grant a variance to construct a covered patio living space within 18 feet of the seawall at 1 Windward Island, based on the design, as long as access to the deadmen is not restricted. The motion was duly seconded and carried unanimously.
