The subject property is being developed by Capel Properties and building
permits were issued by Pinellas County prior to annexation into the City
of Clearwater. Pinellas County has requested that we review the site
and determine if the City has any objection to issuance of a Certificate
of Occupancy without a sidewalk being installed.
We have reviewed the property and found that there are no sidewalks
within 200 feet of the property, it is not part of a school walk route,
and the absence of a sidewalk does not create a pedestrian hazard.
Since the City's requirements for a sidewalk waiver are met, and a
waiver would be granted if the property was developed in the City, we
recommend that the County not require the installation of a sidewalk.

Dear Mr. Dewey:
Building permits for the above referenced property were issued by Pinellas County
prior to annexation into the City of Clearwater. Since the requirements for a
sidewalk waiver as set forth in Section 138.09 of the Code of Ordinances of the
City of Clearwater are met, a sidewalk waiver would be granted if the property
was developed through the City's building permit process. We, therefore, have
no objection to the County issuing a Certificate of Occupancy without a sidewalk
being installed.
