Rules and Regulations of the Planning & Zoning Board
November 25, 1986
Attached is the signed original of the Planning and Zoning
Board's Rules and Regulations which were amended from the
approved Ordinance enacted by the City Commission.

b. Abstention:
Each member shall cast an "aye" or "nay"
vote on each question before the Board,
except that if any member has a voting
conflict of interest, the member must
abstain from voting as required by
Chapter 84-357, Laws of Florida. In these
instances, the Board member, prior to the
vote being taken, is to publicly state the
nature of his interest in the matter and
is to file a Memorandum of Voting Conflict
with the City Clerk within fifteen (15)
days after the vote occurs for incorporation
in the minutes of the meeting.
c. In order for an action to be official, at
least four (4) members of the Board shall
vote on the application. For conditional
use applications, approval by at least
four (4) members of the Board shall be
required for approval, and any application
receiving a tie vote shall be rescheduled
to the next regular meeting of the Board,
at which time the application shall be
reheard. If at the conclusion of the
rehearing a majority of the members voting
do not approve the application, with or
without conditions, the application shall
be considered to be denied. For matters
other than conditional use applications,
approval by a majority of the members
voting shall be required for approval, and
any motion receiving a tie vote shall be
considered to have failed.
Section 7: Records:
All Regular and Special Meetings, hearings and
records of such meetings shall be open to the
public. Records of the proceeding shall be
maintained in the Planning Division of the
Department of Planning and Urban Development.
Section 8: Procedure:
Parliamentary procedure in Board meetings shall
be governed by Robert's Rules of Order, as amended,
and by the Rules and Regulations contained herein.

ARTICLE VI.
HEARINGS
The following procedures will be observed ln hearings before
the Planning and Zoning Board:
a. Persons speaking before the Planning and Zoning Board
on other than public hearing items shall be limited to
three (3) minutes. No person shall speak more than once
on the same subject unless granted permission by the
Planning and Zoning Board.
b. Public hearings for annexations, zonings and land use
plan and Code amendments shall have the following order
of presentation with specified time limits:
1) Statement of case by applicant - 5 minutes maXlmum
2) Presentation by staff - 5 minutes maximum
3) Comments from public in support/opposition:
individual - 3 minutes maximum
spokesperson for group - 10 minutes maximum
4) Rebuttal by opposition - 5 minutes maximum
5) Final rebuttal by applicant - 5 minutes maximum
6) Public hearing closed
7) Questions from Board members may be asked at
any time during a hearing
c. Public hearings for conditional uses shall have the
following order of presentation:
1) The Chairman reads from the Public Hearing Notice
each item as it is presented.

2) The Planning Director advises the Board of any
pertinent background information.
3) The applicant or his representative presents his
case.
4) Persons who support the application speak.
5) The Planning Director presents any supporting
written documents.
6) Persons who oppose the application speak.
7) The Planning Director presents any opposing
written documents.
8) Persons supporting the application (other than
applicant) may speak in rebuttal.
9) Persons opposing may speak in rebuttal.
10) The applicant has an opportunity for final rebuttal.
11) The Board makes a decision.
d. The Board may, at its discretion, adjourn or continue
an item or hearing for a period not to exceed thirty
(30) days at any time during the hearing, and request
further information from either party.
e. If a hearing on an item is adjourned, at the time the
hearing is reconvened, only those Board members that
have been present from the beginning of the hearing
on the item may participate in the deliberations and
decision-making process. (This requirement may be
waived by the consent of both parties.)
f. Upon completion of all the information, the Chairperson
shall close the hearing.
g. The Board may only consider that information which is
presented during the hearing before reaching their
decision. Information presented during a hearing shall
be in conformance with the applicable sections of the
Land Development Code as outlined in Section 137.019.
h. The Board shall immediately deliberate in open session
before the public.

1. The Board shall orally issue a recommendation which is
approved by a majority of the Board, such recommendation
to be forwarded to the City Commission. Action taken
by the Board on conditional use requests shall be final,
subject to appeal only as provided for in Section 137.013
of the Land Development Code.
ARTICLE VII. MISCELLANEOUS
Section 1: These Rules and Regulations may be altered in a
manner not inconsistent with the City Code during
a regular meeting by affirmative vote of a majority
of the members of the Board, provided notice of
the proposed change is given to the Board at a
preceding regular meeting.
Section 2: The provisions of these Rules and Regulations
shall be reviewed by the Board annually
immediately following election of the
Chairperson and the Vice-Chairperson.
