Enclosed please find your executed copy of PSTA' s Bus Shelter
Agreement.
As stated in the agreement, PSTA is responsible for the
construction, maintenance, and upkeep of the bus shelter located on
your property.

BUS SHELTER AGREEMENT
The undersigned owner of the real property described as City of
Clearwater city Hall, Osceola Avenue, Clearwater, Florida 34618 for
and in consideration of $1.00 and other consideration hereby
acknowledged as received, does agree and consent to the placement
of a bus shelter and passenger amenities by the Pinellas Suncoast
Transit Authority (PSTA) on the above premises adjacent to and
facing Osceola Avenue. This Agreement shall continue unless
terminated by either party after giving thirty (30) days written
notice to the other party. All notices shall be sent to the
Pinellas Suncoast Transit Authority, c/o Roger Sweeney, 14840 49th
Street North, Clearwater, FL 34622-2893.
As a condition of this Agreement, PSTA shall be responsible for the
construction, maintenance and upkeep of the shelter; and, shall
indemnify city of Clearwater from any and all claims for personal
injury or property damage" arising out of PSTA's use of the premises
for the placement of a bus shelter for its passengers, except for
any claims resulting from the negligence of The City of Clearwater.
PSTA '5 obligation to indemnify the City of Clearwater is limited to
the same extent that PSTA would otherwise be obligated to such
third persons under existing law and PSTA does not waive any
immunity it may have under the doctrine of sovereign immunity or
section 768.28, Florida Statutes.
Upon termination of this Agreement, PSTA shall remove any or all of
its property from the premises at its cost.
