I I ACCESS AND USAGE AGREEMENT FOR THE GEOGRAPHIC INFORMATION SYSTEM THIS AGREEMENT is made and entered into this .;J 3('J....day of August, 1999, by and between the CITY OF CLEARWATER, FLORIDA, a Florida municipality (hereinafter the "CITY"), on behalf of its Police Department, and EVERETT S, RICE, SHERIFF OF PINELLAS COUNTY, FLORIDA (hereinafter the "SHERIFF"). WITNESSETH WHEREAS, the CITY'S Geographic Information System (GIS) began in 1996 when the City entered into an Interlocal Agreement with Pinellas County on November 5, 1996 for Pine!!as County to provide the CITY guidance and support for the design, installation and implementation of a city-wide GIS; and WHEREAS, the same year, the CITY was awarded a grant from the Substance Abuse Advisory Board (SAAB) to purchase equipment and hire personnel to help develop and run the GIS; and WHEREAS, the CITY'S GIS was to be based in part on the system and data that Pinellas County already had in place; and WHEREAS, a major component of the CITY'S GIS project was the establishment of a shared database that contains crime data from the CITY and the SHERIFFbecause shared information often leads to more efficient law enforcement; and WHEREAS, the CITY and the SHERIFF have determined that a geographic information system access and usage agreement is necessary in order to establish the obligations and responsibilities of the parties hereto regarding the sharing and release of crime data; - NOW, THEREFORE, in consideration of the mutual covenants contained herein to be undertaken by the respective parties hereto, the parties agree as follows: 1. The CITY and the SHERIFF shall agree to abide by the provisions of a GIS policy to be completed and agreed upon by the parties hereto. 2. Each party shall be responsible for its own expenses incurred related to start up and maintenance of the geographic information system including any personnel expenses. 3. Each party agrees to allow access to information contained in the geographic information system to the other party. 5. In no event shall this Agreement confer upon any person, corporation or entity, whether private or governmental, the right to damages against either party to this Agreement, except as expressly provided in this Agreement. 6. The parties hereto agree to abide by the provisions of Chapter 119, Florida Statutes, concerning public records. In particular, the parties shall ensure that records containing exempt and confidential information are protected from unauthorized inspection. 7. The Agreement shall be binding upon the parties from the date of full execution hereof and shall continue in full force and effect for a period not to exceed one year from the date of full execution. However, either party may terminate this Agreement by providing written notice of termination to the other not less than thirty (30) days in advance of such termination.
