ADDENDUM NO. 2/LATENT FINGERPRINT/CRIME SERVICES " -Y'. , , !or'" r ,') ," , I . .~. -.:: ,,~ t.-., _'" J I ADDENDUM NO. 2 This is a continuance of the Agreement entered into by and between the City of Clearwater, a municipal corporation (herein- after "CITY") and EVERETT S. RICE, as Sheriff of Pinellas Coun- ty, Florida (hereinafter "SHERIFF"), dated August 27, 1996. It is the intent of the parties herein to renew the above- described Agreement with all terms and conditions of said Agree- ment remaining the same except as provided herein below: 1. Paragraph I I, page 3, is hereby amended to read as follows: II. The CITY shall pay to the BOARD OF COUNTY COMMIS- SIONERS the sum of SEVENTY THOUSAND SIX DOLLARS AND FORTY-NINE CENTS ($70,006.49) annually for the latent fingerprint services to be rendered pursuant to this Agreement. 2. Paragraph III.B., page 3, is hereby amended to read as follows: I III.B. The SHERIFF will provide to the CITY, storage, release and disposal for all evidence and property, except bicycles, which may lawfully come into the possession of the CITY Police Department or which may be obtained as the result of crime scene processing. This includes the packaging and trans- portation of such items to and from a lab or other testing facility as determined by the CITY Police Department. The SHERIFF shall be responsible for obtaining routine items of property or evidence from the CITY OF CLEARWATER Police Depart- ment and transporting same to secure storage facilities main- tained by the SHERIFF. However, where such items of property or evidence are large, voluminous, heavy or otherwise not compati- ble with transport by ordinary courier, it shall be the responsi- bility of the CITY OF CLEARWATER Police Department to transport such items to the SHERIFF's evidence and property storage facili- ty. The CITY shall pay to the BOARD OF COUNTY COMMISSIONERS the sum of THIRTY THOUSAND FORTY-FIVE DOLLARS AND EIGHTY-ONE CENTS ($30,045.81) annually for the evidence storage service. Paragraph III.D., page 3, is hereby amended to read as follows: III.D. The CITY shall pay to the BOARD OF COUNTY COMMISSIONERS the sum of $136.83 for each crime scene processed by the SHERIFF and shall guarantee a minimum of 2,000 calls for service during the period of this Agreement. For all requests for service in excess of 2,000 during the period of this Agree- ment, the CITY shall pay to the BOARD the sum of $136.83 for each crime scene processed pursuant to this Agreement. The CITY shall pay to the BOARD OF COUNTY COMMISSIONERS the sum of TWO HUNDRED SEVENTY-THREE THOUSAND SIX HUNDRED SIXTY DOLLARS ($273,660.00) for the 2,000 calls for service for the period of this Agreement. 4. Paragraph III.E., page 3, is hereby amended to read as follows: III. E. Billing for requests for service in excess of 2,000 calls during the period of this Agreement shall be in- voiced monthly at the rate of $136.83 per call. 5. Paragraph IV, page 4, is hereby amended to read as fol- lows: IV. The CITY agrees to pay to the BOARD OF COUNTY COMMISSIONERS on or before October 31, 1998, the sum of THREE HUNDRED SEVENTY-THREE THOUSAND SEVEN HUNDRED TWELVE DOLLARS AND THIRTY CENTS ($373,712.30) which reflects the minimum sum due for all services to be rendered during the term of this Agree- ment. 6. Paragraph VI, page 4, is hereby amended to read as fol- lows: VI. Either party may cancel this Agreement upon provid- ing notice of such cancellation in writing thirty (30) days in advance of the date of cancellation. In consideration for and CITY's knowledge of SHERIFF hiring and training additional staff to manage the requirements of this Agreement, should CITY termi- nate this Agreement prior to September 30, 1999 no funds will be reimbursed by the SHERIFF to the CITY. If the SHERIFF termi- nates the Agreement, the SHERIFF shall retain such sums from the payment set forth above as reflect actual calls for service at the rate provided herein and shall refund the remainder to the CITY. 7. Except as provided above, the terms and conditions of the Agreement dated August 27, 1996 is renewed for a period of one (1) year commencing October 1, 1998 and concluding September 30,1999. -2- ... .!'". -"' . ) .,,,"', '. . , I DONE AND EXECUTED this ~/ day of d~, 1998.
