ADDENDUM NO. 2 / LATENT FINGERPRINT SERVICES I I ADDENDUM NO. 2 This is a continuance of the Agreement entered into by and between the City of Clearwater, a municipal corporation (herein- after "CITY") and EVERETT S. RICE, as Sheriff of Pinellas Coun- ty, Florida (hereinafter "SHERIFFlt)~ dated April 5, 1994. It is the intent of the parties herein that this Addendum supersedes Addendum No. 1 dated December 29, 1994 and to renew the above-described Agreement dated April 5, 1994 with all terms and cond! t!ons of said Agreement remaining the same except as .provided herein below: 1. Paragraph I I, page 3, is hereby amended to read as follows: II. The CITY shall pay the SHERIFF the sum of SIXTY- ONE T~USAND TWO HUNDRED FIFTY-SIX DOLLARS AND FORTY-EIGHT CENTS ($61,256.48) annually for the latent fingerprint services to be rendered pursuant to this Agreement. 2. Paragraph I I I" A., page 3, is hereby amended to read as follows: A. The SHERIFF will provide to the CITY, upon request by the CITY, For-ensic Science Specialists to document, process and collect e\"idence at cr-irne scenes wi thin r.he CITY. Said se=vices shall include the photographing or otherwise document- ing said crime scene as such may be appropriate, wi thin the scope and capabilities of the SHERIFF. Any processing or test- ing outside SHERIFF'S capabilities shall be at the expense of the CITY. 3. Paragraph III.D., page 3, is hereby amended to read as follows: D. The CITY shall pay to the SHERIFF the sum of $120.68 for each crime scene processed by the SHER~FF and shall guarantee a minimum of 2,000 calls for service during the period of this Agreement. For all requests for service in excess of 2,000 during the period of this Agreement, the CITY shall pay to the SHERIFF the sum of $120.68 for each crime scene processed pursuant to this Agreement. However, in no case shall the SHER- IFF be paid less than TWO HUNDRED SI'XTY-EIGHT THOUSAND FIVE HUNDRED EIGHTY DOLLARS AND NINETY-THREE CENTS ($268,580.93) for forensic science and evidence storage services as provided in this Agreem~nt. ()(-/32 'DC. (JJ ., I I 4. Paragraph III.E., page 3, is hereby amended to read as follows: E. Billing for requests for service in excess of 2,000 calls during the period of this Agreement shall be invoiced monthly at the rate of $120.68 per call. S, Paragraph III.F., page 4, is hereby deleted. 6. Paragraph III.G., page 4, is hereby amended to read as follows: G. The parties agree that the term "call for services" as used herein shall be defined as an incident, event or offense that requires a report or offense number made, recorded or taken by a member of the CITY OF CLEARWATER Police Department for documentation purposes and which requires some action by a SHER- IFF I S Forensic Science Specialist. All services rendered under the same case number shall be deemed one call for service. Such offense numbers shall be used to calculate calls for service with each offense number which results in a request for services being deemed a call for services. 7. Paragraph IV, page 4, is .hereby amended to read as fol- lows: IV. The CITY agrees to pay to the SHERIFF on o~ before March 15, 1996, the sum of THREE HUNDRED TWENTY-NINE THOUSAND EIGHT HUNDRED THIRTY-SEVEN DOLLARS AND FORTY-ONE CENTS (S329,837.41) which reflects the minimum sum due fo~ all servic- es to be rendered during the term of this Agreement. 8. Paragraph V, page 4, is hereby amended to read as fol- lows: v. Either partyimay cancel this Agreement upon provid- ing notice of such cancellation in, writing thirty (30) daV5 in advance of the date of cancellation. In consideration fo~ and CITY's knowledge of SHERIFF hiring and training additional staff to manage the requirements of this Agreement, should CITY termi- nate this Agreement prior to January l, 1997 no funds will be reimbursed by the SHERIFF to the CITY. If the SHERIFF termi- nates the Agreement, the SHERIFF shall retain such sums from the payment set forth above as reflect actual calls for s.ervice at the rate provided herein and shall refund the remainder to the CITY, -2- ,- I I 9. Except as provided above, the terms and conditions of the Agreement dated April 5, 1994 is renewed for a period of one year commencing January 1, 1996 and concluding December 31, 1996.
