MUTUAL TERMINATION AGREEMENT OF THE RADIO
DISPATCH SERVICE AGREEMENT BETWEEN THE CITIES
OF DUNEDIN AND CLEARWATER
THIS AGREEMENT is made this 411 day of ;)JEC&M8clf:.
A. D., 19 7.9, between the CITY OF CLEARWATER, FLORIDA, a municipal
corporation, (hereinafter referred to as "Clearwater"), and the
CITY OF DUNEDIN, FLORIDA, a municipal corporation, (hereinafter
referred to as "Dunedin");
WIT N E SSE T H:
WHEREAS, the parties entered into an Agreement, entitled
"Contractual Agreement for Radio Dispatch Service Between the City
of Clearwater, Florida, and the City of Dunedin, Florida, (herein-
after referred to as "Contractual Agreement"), on December 23,
1975; and
WHEREAS, the parties now desire to terminate said Agreement,
pursuant to Paragraph 15 of the Contractual Agreement, and extin-
guish all liabilities and rights under said Agreement;
NOW, THEREFORE, in consideration of the below stated
provisions, the parties agree as follows:
1. The Contractual Agreement is hereby terminated upon
execution and approval of this termination agreement by the parties
hereto.
2. Dunedin shall pay Clearwater One Hundred Six Thousand
Dollars ($106,000.00) as follows: The first one-half, totalling
Fifty-three Thousand Dollars ($53,000.00), shall be paid to
Clearwater within thirty (30) days after the execution of this
Agreement by both parties. The second one-half, totalling Fifty-
three Thousand Dollars ($53,000.00) shall be paid to Clearwater
on or before December 31, 1979.
3. Pursuant to Paragraph 4 of the Contractual Agreement,
Clearwater shall retain title and control of all radio dispatch
systems, components and facilities, except for mobile, portable
and remote control units assigned to Dunedin.

4. Pursuant to Paragraph 15 of the Contractual Agreement,
upon approval of the Division of Communications of the State of
Florida, Clearwater shall support Dunedin in acquiring an FCC
license for the operation of a police radio system on frequency
pair 460.025-465.025, said frequency pair being the pair presently
assigned for use by the City of Dunedin Police Department.
5. This termination agreement shall operate to completely
release the parties from any recourse for damages, penalties,
assessments, material and services available to each under the
Contractual Agreement.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be duly executed by the proper officials on the dates
stated below.
