AGREEMENT MUTUAL AID THIS AGREEMENT is made and entered into by and between the City of Clearwater, Florida, a municipal corporat~on, and the City of Dunedin, Florida, a municipal corporation, in behalf of their various departments and agencies involved in emergency public safety services. THE CITY OF CLEARWATER and the CITY OF DUNEDIN are experiencing corrunon problems in those areas adjoining their contiguous bound- aries and other areas within their corporate limits which require mutual aid and cooperation between such Cities. It is desirable that each of the parties hereto should voluntarily. assist each other_in the event of disasters or emergencies by the interchange of law enforcement services and facilities, to cope with the problems of the emergency protection of life and property. It is necessary and desirable that a cooperative agreement be ex- ecuted for the interchange of such mutual aid on an inter-city basis. Chapter 163.01 Florida State Statutes, the Florida Interlocal Cooperation Act of 1969, permits a municipal corporation to enter into an agreement or compact with another municipal corporation for mutual assistance. THEREFORE, pursuant to the authority herein above s ,t forth and in consideration of the mutual benefits to be derived by the City of Clearwater and the City of Dunedin, it is hereby agreed by the City Corrunission of the City of Clearwater and the City Corrunission of Dunedin: I. The parties shall act under a corrunon plan or plans. Such plan or plans are a part of this agreement cover- ing the exchange of law enforcement mutual aid services, -1- 00 13- (b -') u..... I '" ....- <.- , '. I I resources, facilities, and related matters in behalf of and between the City of Clearwater and the City of Dunedin. II. Each party agrees to furnish law enforcement mutual aia . services, resources, and --facil-ities - in accordance with the provisions of the Clearwater-Dunedin Law Enforcement Mutual Aid Planas hereafter adopted and as it may be revised. III. Said Clearwater-Dunedin Law Enforcement.Mutual Aid Plan shall include, but not be limited to such matters as delineation of the law enforcement mutual aid procedures, functions, duties and responsibilities, that shall apply among the parties. IV. The signatory cities, their political sub-divisions, public agencies, and their officers or employees shall not be liable for the exercise or performance or for failure to exercise or perform a discretionary function or duty in carrying out the terms of this agreement. V. Inter.....city mutual aid requests will not be initiated unless the requesting entity is committed to the mitiga- tion of an incident or emergency, and other resources within the city are not immediately available. VI. It is understood that this agreement and the Clearwater- Dunedin Law Enforcement Mutual Aid Plan adopted pursuant thereto, shall not supplant existing statutes, ordinances, or existing agreements. VII. All law enforcement powers, all of the privileges and immunities from liability, exemptions from law, ordinances, and rules, all pension, relief disability, workman's compen~ation, and other benefits which apply to the activity of officers, agents, or employees when per- forming their respective political sub-divisions, shall -2- . _._____..l ,; :- II I I .~ . apply to them to the same degree and extent while engaged in the performance of any of their functions and duties extra- territorially under the provisions of this agreement. VIII. This agreement shall become effective when approved and executed by the parties and shall remain effective between the undersigned cities unless the City Manager, under the direction of the City Commis sion, of one of the signatory cities files written notice of termination of participation in this agreement with the City Manager of the other signatory city. This agreement and all common plans developed pursuant to this agreement will terminate immediately upon receipt of such notice.
