Cemetery Committee comp- pleted the documentation of the Clear- water Cemetery in May. The Chairman wishes to acknowledge the hard work of Jean Lowe, former Chairman and Commitee members Jody Stanley, Gerda Birkholz, Martha Gibson, Shirley Onofrey and Virginia Smith. They gave many, many hours to recording,data from each mark- er in the Cemetery. W The Clearwater Cemetery, like many in the early days of Pinellas County was not well documented. The Clearwater City Clerk's Office provided the infor- mation that in 1914, 25 individuals formed "The Clearwater Association" and purchased land which they, in turn, sold to the City of Clearwater in 1916. This land became the Clearwater Cemetery The cemetery property west of Myrtle Ave.,,as far as the railroad,originally was part of an orange grove belonging to the Plumb family. The Plumb family sold this portion of the groves to the City of Clearwater. They also donated land which now is the site of the Care- taker's building. The first burial recorded was that of T.J. Barnes who was born Jan. 12,1846 and died Sept. 5, 1877. The area of the cemetery in which he was buried had belonged to the Roberts family whose daughter, Laura, was Barnes' wife. The names "Roberts", "Barnes" and "Harris", all of whom were related, are to be found in this, the oldest part of the cemetery. There are tombstones in the cemetery bearing dates earlier than 1877. This occurred when Ft. Harrison Ave. was put through and the road passed through an old cemetery located in the vicinity of North Ward School. It was necessary to move some remains to the Clearwater Cemetery. They included David B. Tur- ner, first Postmaster of Clear Water Harbor, born Dec. 27, 1819, deceased March 16, 1869 and John William Jef- fords, born Dec. 28, 1816, died Sept. 3, 1877. The Caretaker of Clearwater Ceme- tery, Mr. Perry, provided much helpful information and interest- ing anecdotes. He told of the early tombstones fashioned from sandstone which proved to be too fragile and did not weather well. This probably accounts for some of the graves which are unmarked. Later stones were usually carved from Georgia marble. On the west side of Myrtle Ave., near the street, there stands a tombstone which resembles a boul- der. It was commissioned by Ed- gar A. Roberts and is a replica of a North Carolina mountain that was the view from his home as a youth. His family had his remains moved to Sylvan Abbey but they would not accept his "mountain" which remains at Clear- water Cemetery. A section of the cemetery along the railroad, on the far west side, was designated as the "paupers' field." Another section of un- marked graves contains the re- mains of some workers from the Corps of Engineers who were killed while working on area bridges. Another anecdote, possibly apoc- ryphal, relates that the reason the section sold by the Plumb family to the cemetery has all flat tombstones is because Mr. Plumb did not want to see high tombstones from his windows which overlooked the cemetery. BACKGROUND: The above request is being made to provide better customer service. In evaluating some of our procedures, we felt that eliminating the requirement to pay the staking fee prior to the issuance of the burial permit and authorization to stake the grave site would be more convenient for funeral directors. Under the ordinance as it now exists, a funeral director must pay for the staking fee prior to City Clerk Department employees notifying the Parks Department of a need to stake a site. This often means someone from the funeral home must hand deliver the fee to the Clerk Department as they cannot rely on the mail to deliver it in time. A billing process will be instituted. We do not anticipate any problem with collection as we deal only with funeral directors. Should a problem arise the procedures will allow the City Clerk to require payment prior to issuance of burial permits to funeral homes with delinquent accounts. (4) {-}- Except when religious tenets preclude it, a minimum of 24 hours' notice shall be required prior to any interment. The cemetery groundskeeper shall locate and stake the space to be used. (5) { 4}- The funeral director shall be responsible for the opening and closing of the gravesite and the removal of excess dirt after-the closing. (6) 4-4 A casket shall require either a vault or an outside concrete receptacle. Section 2. This ordinance shall take effect immediately upon adoption. We should receive from the owner the original deed and have them sign a quit claim deed which we type and have recorded at the courthouse. An authorization for disbursement is typed and sent to finance dept. for having the check done. When transaction is complete adjust our records accordingly and this should go on the next cemetery monthly report and be added to spaces available for sale. If the owner we have listed on our records is not the same as the person(s) wishing to sell the space(s) we will need paperwork showing that person has the authority to do so, sometimes also including a death certificate copy. v CEMETERY MONTHLY REPORT- is done at the beginning of each month as an interoffice memo wit the original to Ream Wilson and a copy to ,3eek--t:??- Included in this report is the legal description of spaces sold with purchasers name and a running balance of current spaces available for sale. Deduct any spaces sold and add any repurchased. BURIAL OF SOMEONE WHO ALREADY OWNS A CEMETERY SPACE- When a funeral home calls to set up a burial get all information necessary: name of deceased, date of birth, date of death, name of funeral home and funeral director, date and time of funeral and legal description if they know it. Verify ownership of space (go to index and proper book to verify if they don't know legal description). Call for staking of the space at radio dispatch # and leave message for him to call you. When he returns your c 1 give him legal descrip- tion and tell him time and date of funeral. Put information in index if not already there and in proper cemetery book. Make out a burial permit form in duplicate and note the staking fee charge to be paid on duplicate copy. Staking fee is $15.00 during workdays and $25.00 for weekends and holidays. The staking fee is normally paid by the funeral home. PURCHASING A CEMETERY SPACE ON CONTRACT- A cemetery space may be pur- chased on contract with a minimum o T_$70.00 down payment per space and the balance to be paid over the next 6 months in equal installments. The recording fee must be paid at the time of the final payment:. We fill in the contract (on Jacquard as SPACE.DS), have the purchaser sign it, we witness their signature and route for signatures. After fully executed send the purchaser a copy and we keep original. Mark proper book as sold, do accounting record and put on monthly report as sold. The space cannot be used until paid in full. Aunspaugh who, in turn, deeded it in 1914 to the Clearwater Cemetery Association (a Florida corporation) who deeded it to the City of Clearwater on December 4, 1916. Over the years various additions have also been deeded to the City. There is no reference in our code book to the Clearwater cemetery. Attached are copies of R73-153 and R66-66, which are the oldest two references I have found relating to rules and regulations. The resolution does not authorize the Cemetery Superin- tendent to remove temporary markers after a permitted time frame. The temporary markers provided by the funeral homes create problems for the maintenance workers at the cemetery and the Superintendent has requested wording be incorporated into the resolution to specifically state violations will be removed by cemetery personnel after a specified time frame. Hr. Haute requested a time frame of one year for temporary markers. Paragraph 3(c)(d) addresses removal of flowers, wreaths, and flags and does state that they will be removed. Apparently, they have no problem removing those violations, but when they remove a temporary marker, they have been subjected to verbal abuse by the relatives. Many times the temporary markers are left on graves for many years and have deteriorated to such an exent they are not decipherable.- At the present time there are no Florida statutes on municipal cemeteries except for burial after a communicable disease. I understand there was a bill before the legislature last year that would have regulated municipal cemeteries, but it was not adopted. It might be to our advantage to consider creating a cemetery ordinance as soon as possible to pre-empt any state statues that may be forthcoming. The administration responsibilities are assigned to the City Clerk Department/Action Center to handle as the need arises. Because no written policies and procedures exist and we have a tremendous turnover of employees, records are inadequate and insufficient. This has created a problem and a great deal of frustration for employees assigned the task of the cemetery duties. It is very difficult with the current records to perform the duties effectively and efficiently. Although, it's agreed that problems do exist, and many attempts have been made to resolve some of the immediate ones, a permanent solution is still very necessary. The one solution discussed continuously is to have all functions of the cemetery under one staffed department. During the past weeks I have talked with employees in both departments. I also contacted Bill Shepard, Engineering Drafting Supervisor and Al Hicks, Engineering Field Supervisor. I talked with employees who have been in the Cemetery Division since they came to work for the city. Their combined employment represents over 30 years of service. The two major concerns to be addressed in this report with recommendations are: 1) Two departments sharing the cemetery responsibilities 2) updating/correcting records Two departments sharing responsibilities can be consolidated. The department assuming responsibilities would require additional manpower. The job duties would include answering the phone, showing lots, selling spaces, typing/routing deeds, filling out burial permits and keeping records. A part time employee to perform these duties would be adequate. Once the records are brought current it will be an easy task to maintain them. The salary of the employee can be paid through the Senior Community Service Employment Program. This is a federally funded program sponsored by the AARP Organization. During my conversation with the Project Director Joan Ceisel at 441-9925, she explained this is a temporary service (similar to CETA). The clients are encouraged to seek permanent employment; however, she stated there are employees that remain on the same job indefinitely especially with the city. Remodeling the office in the existing building for the part time employee will eliminate going to two different offices to purchase a space. It will also be more convenient for the citizen needing this service. To update/correct the records is the most essential part of this project. I suggest the Senior Community Service Employment Program be utilized. The records need to be compared with records at the cemetery and the actual grounds. The person will need to be at the cemetery a great deal of his/her time. In conclusion, this recommendation of changes will benefit the city and the citizens. The knowledge of these problems and potential problems can not be ignored. It is to the city's advantage to get our records updated and establish better procedures. V. MAINTENANCE, IMPROVEMENTS, AND DECORATIONS A. No permanent flower recepticles shall be placed on any grave or plot unless approved by the Superintendent and unless they be set wholly beneath the level of the lawn. The management is not responsible for floral pieces, baskets or frames in which or to which such floral pieces are attached, nor is it liable for lost, misplaced or broken flower vases. C. Holders containing flowers or other decorations will be removed as soon as the flowers fade or wither, and the right is reserved by the Superintendent to make such removal. Christmas wreaths will be removed by January Seventh, or when wilted. The Superintendent shall keep such holders at the risk of the owner for a period of 60 days and if the owner fails to claim them within that time he shall forfeit all right, title and interest in the holder and the Superintendent shall dispose of it as he sees fit. D. No fence railing, coping hedge embankment nor ditch shall be used to define a grave or plot. E. Floral Regulations: 1. Relatives and friends may place cut flowers on a grave or plot at any time and it shall be the duty of the Superintendent to remove them when they have become unsightly. a -2. No trees, shrubs, flowers or plants of any kinds shall be planted in the cemetery without the approval of the Superintendent. F. No boxes, shells, toys, metal designs, ornaments, chairs, benches or such article shall be permitted in any plot or grave. G. No appurtanances of any kind shall be permanently placed in any plot other than an approved memorial or recepticle. H. No lot shall be filled above the established grade, nor any obstruc- tion allowed which will interfer with the proper maintenance of the property. 1. The management reserves the right to have removed from any lot any- thing that conflicts with these rules and regulations. J. No signs notices or advertisements of any kind shall be allowed in the cemetery unless approved by the Superintendent. I V1. RULES OF CONDUCT A. The Superintendent shall have the power to exclude from the cemetery any person or persons whose conduct in the cemetery does not, in his opinion, meet with the accepted norms of propriety. - 3 - B. Speeds in excess of 10 miles per hour shall not be permitted and auto- mobiles shall not leave the designated roadways. C. Hunting shall not be allowed in the cemetery. D. Injury or defacement in any way of the memorials or trees and plants in the cemetery by any persons shall be prohibited. VII. ADDRESSES OF PLOT OWNERS A. It shall be the duty of the property owners to keep the City Clerk informed of their current address. Notices sent to the last address on file shall be considered sufficient and proper legal notification. Vlll. MEMORIALS A. The marking of each grave or plot is restricted and limited to flat bronze, marble, or granite tablets set flush with the turf, and of such dimensions, materials, design, finish and construction as approved by the Superintendent. Written approval by the Superintendent is required before any memorial may be delivered to the cemetery for installation. B. Foundations for Memorials shall be built by the management at the cost of the property owner. C. -All memorials shall be installed by the Superintendent at the expense of the person offering such memorial for installation. D. The charges for the building of foundations, installation and mainte- nance of memorials shall be reasonable and uniform. No memorial shall be installed until the charges due have been paid in full. IX. SPECIAL CARE A. Special care of any plot or grave may be arranged as desired with the Superintendent at the expense of the requestor. X. VISITING HOURS A. The cemetery shall be open to visitors from sunrise to sunset each day. XI. ELIGIBILITY A. Since the Dunedin Cemetery is a Municipal Cemetery and Is maintained at the expense of the taxpayers of the City, sale of cemetery property shall be limited to bona fide residents of the City of Dunedin or to relatives of persons now buried there. XII. EXCEPTIONS A; Provisions of Section V, paragraphs G and H, and Section Vill, paragraph A, do not apply to the sections of the cemetery in use prior to the adoption of these rules. - a - MEMORANDUM DATEs July 28, 1972 TO: City Clerk FROM: City Manager RE: Sale of Cemetery Spaces It has been brought to my attention that cemetery spaces have, in the past, been sold on an installment or tine basis, with so much being paid down and so much per month or quarter. There has never been any charge made for this service, although there is considerable administrative time in- volved in maintaining the records and in billing, etc. Effective August 1, 1972, cemetery spaces will be sold only on a cash purchase basis.
