A. D., 1983, between the CITY OF CLEARWATER, FLORIDA, a municipal corporation
hereinafter called "City", and THE SCHOOL BOARD OF PINELLAS COUNTY, FLORIDA,
hereinafter called "Board";
WITNESSETH:
WHEREAS, the Board through the pinellas vocational Technical
Institute, wishes to use the City Fire Training Facility located at 1700
North Belcher Road, Clearwater, Florida, for the interim purpose of teaching
classes related to firefighting; and
WHEREAS, the Board is in need of a facility while a new facility
is being constructed; and
WHEREAS, the City desires to help the Board provide this public
service;
NOW THEREFORE, in consideration of the mutual covenants herein
contained, the parties hereto do hereby agree as follows:
1. The City will permit the Board and its agent, the pinellas
vocational Technical Institute, to use the City of Clearwater Fire Training
Facility located at 1700 North Belcher Road, Clearwater, Florida, for the
purposes and no other of making available course instruction in firefighting
which has been approved by the State Department of Education.
2. The term of this agreement shall be one (1) year commencing
on September 30, 1983 and ending September 30, 1984, unless terminated as
otherwise provided herein.
3. The Board understands that the City of Clearwater Fire
Department will also be using the facility and the Board agrees to coordinate
its activities with the Clearwater Fire Chief to the end that daily activities
carried on by the Clearwater Fire Department at the facility will not be
interrupted.
4, The Board agrees to be responsible for all janitorial care
made necessary during the time that the pinellas Vocational Technical
Institute is using the facility.

5. The pinellas Vocational Technical Institute will supply
training aids (such as L.P. gas, fuel oil, cars to be burned, and other
incidentals) in an amount equal to $1,200. Such materials will be used
by both the Clearwater Fire Department and students of P.V.T.I., and will
be stored at the Clearwater Training Facility.
6. The Board agrees to waive all tuition fees, books and other
related costs for the instruction of all Fire Academy courses provided to
the City of Clearwater Fire Department and its members.
7. The Board agrees to pay the sum of
$5,359.78
which constitutes 25% of the annual maintenance and utility charges for the
training tower and classroom facility. This sum will be tendered on or
before October 1, 1983 or upon the execution of this agreement, whichever
is later. This sum represents reimbursement to the City for expenses
actually incurred, and hence will not be included in the City's gross revenues;
consequently, these figures will not be included in assessing costs and dis-
bursements associated with the pinellas County Fire Control District.
8. The Board further agrees to structure such course work in
such a way that not more than thirty (30) people associated with such course
work are using the facility at anyone period of time.
9. The Board agrees to hold the City harmless and to that end
agrees to assume the defense of and save the City harmless from any and all
claims, actions or suits for personal injury, death or property damage
arising out of or occasioned by reason of the Board and its representative,
the pinellas Vocational Technical Institute using the fire training facility
during the term set out herein. In no way shall this provision or the
purchase of insurance be construed to waive in whole or in part the sovereign
immunity of either party to this agreement.
10. The Board agrees to make the City a named insured on any or
all policies of insurance it secures to comply with the requirement set
out in paragraph nine (9), and to provide the City with a copy of all such
policies.
11. This agreement may be terminated at any time upon either
party providing thirty (30) days written notice to the other party.
