THIS AGREEMENT, made the 28th
day of January
AoD., 19~~, between the CITY OF CLEARWATER, FLORIDA, a municipal corporation,
hereinafter called "City", and THE SOiOOL BOARD OF PINELLAS COUNTY, FLORIDA,
hereinafter called "Board";
WITNESSETH:
WHEREAS~ the Board through the Plnellas Vocational Technical
Institute, wishes to use the CIty fIre traInIng facIlity located at 1700 North
Belcher Road, Clearwater, Florida, for the interim purpose of teaching classes
related to firefighting; and
WHEREAS, the Board is In need of a facII ity while a new facility
is being constructed; and
WHEREAS, the City desires to help the Board provide this publ ic
service;
NOW, THEREFORE, in consideration 01 the mutual covenants herein
contained, the parties hereto do hereby agree as fol lows:
I. The City will permit the Board and its agent, the Pinel las
Vocational Technical Institute, to use the City of Clearwater fire training
faci lity located at 1700 Belcher Road, Clearwater, Florida, for the purpose
and no other of making available course instruction In firefighting which
has been approved by the State Department of Education.
2. The term of this agreement shal I be one (I) year commencing
on August I, 1980 and ending July 31, 1081, unless terminated as otherwise
provided herei n.
3. The Board understands that the City of Clearwater Fire
Department wll I also be using the facility and the Board agrees. to coordinate
its activities with the Clearwater Fire Chief to the end that dai Iy activities
carried on by the Clearwater Fire Department at the facility wi II not be
interrupted.
4. The Board agrees to be responsible tor all janitorial care
made necessary during the time that the Pinel las Vocational Technical
Institute is us.tng the faci Ittv.

The Pilellas Vocational Technical Insltute will supply training
aids (such as L. P. gas, fuel oil, cars to be burned, and other incidentals) up
to an amount equal to $1,200. Such materials will be used by both the Clearwate r
Fire Department and students of P. V. T. 1. and will be stored at the Clearwater
T ra ining Facility.
6. The Board agrees to waive all tuition fees, books and other related
costs for the instruction of all Fire Academy courses provided to the City of
Clearwater Fire Department and its member s.
7. The Board further agree s to structure such c our se work in such
a way that not more than thirty (30) people associated with such course work
are using the facility at anyone period of time.
8. The Board agrees to hold the City harmless and to that end agrees to
assUl'Ile the defense of and save the City harmless from any and all claims, action,
or suits for personal injury, death or property damage arising out of or occasioned
by reason of the Board and its representative, Pinellas Vocational Technical

Institute using the fire training facility during the term set out he rein; except
that this provision shall not be deemed to expand, enlarge, or extend, but
rather shall be expressly subject to the limitations, protections, and requirements
set forth in Florida Statute 768. 28.
90 The Board agrees to make the City a named insured on any or all
policies of insurance it secures to comply with the requirement set out in
paragraph eight (8), and to provide the City with a copy of all such policies.
10. This agreement may be terminated at any time upon either party
providing thirty (30) days written notice to the other party.
IN WITNESS WHEREOF, the parties hereto have executed this agreement
