PLANNING FOR THE PINELLAS COMMUNITY
MEMORANDUM OF UNDERSTANDING
FOR
SPECIAL PLANNING PROJECTS AND LOCAL ASSISTANCE
This Memorandum of Understanding is based upon and executed pursuant to the lnterlocal
Agreement between the City of Clearwater and the Pinellas Planning Council dated March l,
2005. The terms and conditions of the lnterlocal Agreement that provide for Special Planning
Projects and Local Planning Assistance shall govern this Memorandum of Understanding,
subj ect to the specifics set forth herein.
SPECIAL PLANNING ASSISTANCE No. 2005-1- ANNEXATION REVIEW
A. Purpose - The purpose of this planning assistance is to review annexation applications
received by the City of Clearwater.
B. Scope of Services - The work to be performed includes review of all annexation
petitions that are submitted to the City of Clearwater, from receiving the application
to writing the staff report for the Community Development Board meeting and City
Council meeting, as well as required follow-up.
Major steps include:
· Setup application file with case number, meeting dates, applicant information.
· Enter case into the Permit Plan computer tracking system.
· Request legal description and maps from engineering department, review and
place maps into proper templates.
· Check zoning and land use maps of City and County.
· Check application for completeness and send notification letter to applicant and
any representatives.
· Notify affected parties (i.e., Pinellas Planning Council, Pinellas County,
Pinellas County Sheriff).
· Write draft staff report.
· Review draft ordinance for correctness.
· Prepare notice sign for applicant.
. Finalize staff report.
· After City Council meeting, update Permit Plan with result, notify customer
service and engineering on approved cases
C. Time Frame - This effort began in February 2005 and will continue for approximately
6 months (through the end of July 2005). This time frame can be extended, if
necessary, with the mutual agreement of both parties.
D. Fee - The fee for this study will consist of time charges based on the hourly rate
charges set f01ih in the lnterlocal Agreement (Schedule B). The City will be billed for

actual hours expended on the project, including mileage accrued during required site
visits at the rate of $OA05/mile.
E. Discontinuance - This Memorandu..lTI of Understanding may be discontinued by mutual
agreement at any time during the course of the study process that the City determines it is not
desirable or productive to continue.
SPECIAL PLANNING PROJECT No. 2005-2 - ANALYSIS OF COMMUNITY
DEVELOPMENT CODE PROCEDURES
A. Purpose - The purpose of this project is to assist the City in assessing their
development review process as set forth in the Community Development Code, with
the specific task of identifying any portions that may be unnecessarily complex to the
user, unnecessarily burdensome in terms of submission requirements, or unnecessarily
time-consuming with respect to obtaining development approval.
B. Proiect Focus - The study will focus on Article 4, "Development Review and Other
Procedures", and other related sections contained in the Community Development
Code (in place as of March 2005).
C. Scope of Services - The work to be performed shall include the following:
1. Survey of Frequent Users
This first phase will include a survey of frequent users (list provided by the City
with additional input from the PPC), including the development industry and City
staff to determine which development review approvals they seek and procedures
they use or are familiar with. It will identify their individual perspective of what
procedures work well and which are thought to be unnecessarily complex,
burdensome, or time-consuming, as well as their suggestions for improvement if
they perceive the development review process to be problematic.
2. Code Analysis and Comparison
This second phase will include the PPC's analysis of the current development
review process to determine if it is unnecessarily complex, burdensome, or time-
consuming. PPC staff will also conduct a comparison with the development
review processes of three other comparable cities in Florida (e.g., Gainesville, Ft.
Meyers, Sarasota, as mutually agreed upon), Pinellas County, and two other like
areas of the nation (as mutually agreed upon) to obtain ideas, as determined
relevant, on how to improve Clearwater's development review process. This work
effort will identify what development review processes appear to work well for
these communities in relationship to their intended purpose and which processes
could be applied to Clearwater.

3. Recommendations
This third phase will consist of a series of recommendations that address areas of
i..rn.provement, if any, in the development review processes. These
recommendations are intended to improve the current development review process
with respect to its ease of use by the City staff and the public and ensure that these
processes serve their intended purpose.
4. Presentation
This last phase will consist of a presentation of the study scope, findings, and
recommendations to City staff, the Community Development Board, and the City
Council.
D. Work Product- PPC staffwill prepare a draft report for review by the City, make any
revisions requested by the City, and produce a final repOli for copying by the City.
E. Schedule - PPC staff will carry out the work outlined in this Memorandum of
Understanding in a timely manner, and will coordinate this task through the Assistant
Planning Director or other designated City representative. The anticipated schedule
for completing this task is as follows:
· April 11 , 2005 - Begin survey and complete within 60 days (June 10).
· June 19, 2005 - Begin analysis and comparison to be completed within
approximately 90 days (August 19).
· August 22,2005 - Draft recommendations and complete in approximately 30 days
(September 23).
· September 26, 2005 - Available to present draft recommendations to City staff,
the Community Development Board, and City Council, make further revisions as
needed, and transmit a final version to the City.
F. Fee - The fee for this study will consist of time charges based on the hourly rate
charges set forth in the lnterlocal Agreement (Schedule B). The City will be billed for
actual hours expended on the project, not to exceed thirteen thousand five hundred
dollars ($13,500). Incidental material charges, for items such as report covers,
dividers, postage, and copies required for the final document, shall be included in this
amount.
G. City Participation and Cooperation - The City agrees to assist in the preparation of the
study, including making available the requisite personnel and information necessary
for the timely and accurate compilation of data, timely review and comment on draft
materials, and assistance in scheduling and conducting any required meetings.
