"8 AN ORDINANCE TO BE KNOWN AS THE COMMUNITY AUTOMATED EXTERNAL DEFISRILLA TOR PROGRAM FOR PINELLAS COUNTY; PROVIDING FOR FINDINGS AND PURPOSE; PROVIDING FOR APPLICABILITY; PROVIDING FOR REQUIREMENTS AND PROCEDURES; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Pinellas County, Florida (hereinafter referred to as "the Board"), provides Paramedic Advanced Life Support Services to the citizens and visitors of Pinellas County through its Emergency Medical Services (hereinafter sometimes referred to as "EMS"); and WHEREAS, the American Heart Association has determined one key way to ::; 0 '" improving survival rates from sudden cardiac arrest is to reduce the timePfb d~er -,.:>, ~ I;:~.~ c: t I '-. - r- defibrillation therapy; and r - ._ (/i r~":: I ~__ (.r;":': -.J r:','- WHEREAS, the American Heart Association reports recent breakttlf~gh~in,r., . ;:= -~ ; -L.a. :~'.... a v:' '-0 ''-J technology have resulted in the availability of devices known as automat~iextwal 0-1 l>rrJ - defibrillators ("AED") which are proven to be safe and effective for use by lay persons with minimal training in rapidly delivering a defibrillatory shock; and WHEREAS, the American Heart Association anticipates the widespread availability of AEDs will make sudden cardiac arrest a truly treatable disease and will save hundreds of lives; and WHEREAS, the American Heart Association has determined it is in the public interest to make AEDs readily available within the community and that the public be trained to properly use AEDs and to immediately activate the emergency medical services system I I immediately upon using an AED; and WHEREAS, the Florida Legislature has determined that certain procedures should be implemented to ensure proper use of AEDs and has enacted S401.2915, Florida Statutes, outlining these procedures; and WHEREAS, it is the intent of this Ordinance to set minimum standards for use, training, data collection, and data recovery for the Community Automated External Defibrillator Program; and WHEREAS, the Pine lias County EMS Authority and its contractors and agents who are licensed providers of pre-hospital care will develop and coordinate this program. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF PINELLAS COUNTY, FLORIDA, THAT: SECTION 1. Title And Citation This Ordinance shall be known and may be cited as the "Community Automated External Defibrillator Program Ordinance" for Pinellas County. SECTION 2. Findings And Purpose The Board of County Commissioners of Pinellas County, Florida, is empowered to provide ambulance services and emergency medical services through its EMS Authority. Pursuant to Article VIII of the Constitution of the State of Florida, the Board of County Commissioners of Pinel/as County, Florida, further finds it has the authority to exercise broad home rule powers and, as such, finds it is in the best interest of the citizens of Pinel/as County to enact this Ordinance. It is the purpose of this Ordinance to create the Community Automated External 2 I I .- Defibrillator Program which will establish guidelines for use, train;:], and data collection, as well as requirements and procedures for implementing and using all existing and new AEDs in the community. SECTIOr~ 3. Applicability Notwithstanding any provisions of any other County zoning or other ordinances to the contrary, this article shall apply to, and be enforced in, the incorporated as well as the unincorporated areas of the County. Hospitals, as defined in s395.002(12), Florida Statutes, are exempt from the provisions of this Ordinance. SECTION 4. Requirements And Procedures The following shall be the requirements and procedures for use, training, and data collection of the AED program: (a) No AED shall be used in the incorporated or unincorporated area of Pinellas County without first complying with the requirements and procedures set forth in this section. (b) The purchase or implementation of an AED may occur only after a written notification is made to the Pinellas County Emergency Medical Services Authority by the individual, entity, organization. or company purchasing an AED. The written notification must contain the facility or business name, street address, specific location of the AED, the appropriate annual number of people who work, live at, or visit the location, facility, or business, the total number of persons trained or to be trained in the use of the AEDs, and name of manufacturer, and model number, and description, including color of each AED. 3 I I (c) Prior to implementing an AED, the individual, organization, or c'"\'11pany will obtain and send to EMS proof of standardized training for all intended users of the AED. The training will consist of a class provided by a nationally-recognized, or locally-approved by the Medical Cont"ol Board, training organization, including, but not 'imited to, the American Heart Association, the American Red Cross, and the National Safety Council, following a standardized curriculum. The standardized curriculum shall include, at a minimum: (i) signs and symptoms of sudden cardiac arrest; (ii) cardiopulmonary resuscitation; and (iii) proper use, maintenance, and inspection of AEDs. (d) The owner of the AED will ensure that the use of the AED follows the policies and procedures developed and authorized by the Pine lias County EMS Medical Control Board. (e) Recertification of users, maintenance, and inspection of the AED is the responsibility of the owner and shall be done on a periodic basis. Recertification of users will consist of a class which will review the techniques for using the AED following a standardized curriculum. Recertification training shall be provided as in paragraph (c) above. (f) EMS may conduct a quality assurance review after use of an AED that includes gathering clinical data and information from the person that used the AED and from the AED itself. (g) Any person who uses an AED is required to contact EMS by calling 9-1-1 4 ~ .. I I immediately prior to, or immediately upon use of, the AED. (h) The owner and user of the AED will not withhold consent to the quality assurance review by EMS after the use of an AED or the retrieval of clinical data from the device itself. SECTION 5. Conflict And Severability In the event this Ordinance conflicts with any other ordinance of Pinellas County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by the court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portion. SECTION 6. Inclusion In The Code Of Laws And Ordinances The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Pinellas County, Florida. The sections of the Ordinance may be re-numbered or re-Iettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION 7.
