INTERLOCAL AGREEMENT FOR RECYCLING GRANTS
This Agreement, entered into this _ day of , 1999, by and between each of
the undersigned municipalities (hereinafter referred to individually as the "CITY" and collectively as the
"CITIES," and the Board of County Commissioners of Pine lIas County, Florida (hereinafter referred to
as the "COUNTY").
WHEREAS, the state of Florida has established goals for the purposes of managing and reducing
solid waste through the 1988 Solid Waste Management Act (the ACn, (part IV, Chapter 403, F.S.); and
WHEREAS, in an effort to reach this goal, the ACT and the AMENDMENTS require counties to
develop and implement recycling and waste reduction programs within their jurisdictions to return
recyclable materials to productive use, to conserve energy and natural resources, and to maximize capacity
at solid waste management facilities; and
WHEREAS, the ACT encourages counties and municipalities to form cooperative arrangements
for implementing solid waste recycling, waste reduction and education programs; and Pinellas
municipalities shall enter into an interlocal agreement for these purposes; and
WHEREAS, the ACT created the Solid Waste Management Trust Fund to provide grants to assist
qualifying counties and municipalities in the operation of recycling, waste reduction and education
programs; and
WHEREAS, Section 403.7095 (3) (c), F.S. provides that no local government matching funds are
required for these grants if the municipalities representing 75 percent of the incorporated population of the
County apply jointly with the County, or, if one of the municipalities has a population exceeding 25
percent of the incorporated population of the County, no match is required if municipalities having at least
75 percent of the remaining incorporated population of the County apply jointly with the incorporated
population of the County to the Florida Department of Environmental Protection (FDEP) for these grants;
and
WHEREAS, in order to apply jointly for the grants the COUNTY and the municipalities must enter
into interloca1 agreements that determine how the grant funds, if awarded, shall be used; and
WHEREAS, grant applications submitted to FDEP must include copies of the interloca1 agreement
between the COUNTY and CITIES; and
WHEREAS, the participation and cooperation of the CITIES and the COUNTY are essential to
the award of state grants and the continued development and implementation of successful recycling, waste
reduction and education programs in Pinellas County: and
WHEREAS, it is the desire of the CITIES that the COUNTY apply to FDEP on behalf of the
CITIES and the residents of the Cities and the unincorporated area of the County for avail~ble recycling
and education grant and waste tire grant programs.

8. The solid waste recycling and education grants provided to the COUNTY and CITIES by
FDEP may be used for any of the following purposes (Chapter 17-716.430, F.A.C.):
a. Recycling program capital costs;
b. Temporary operating subsidies, provided that the CITIES and the COUNTY
demonstrate that such a use is necessary for the success of the recycling program,
and shall show how the subsidy will benefit the program. Recycling grant funds
shall be used for projects to assist local governments in recycling paper, glass and
plastic, steel cans, construction and demolition debris, white goods, and metals and
in composting organic materials and other materials;
c. Promotion of recycling, waste reduction, and proper disposal; and
d. Market development for recyclable materials.
9. The waste tire grants provided to the COUNTY and CITIES by FDEP may be used for any
of the following purposes (Section 403.719, F.S.):
a. Construct or operate, or contract for the construction or operation of, a waste tire
processing facility and equipment purchases therefor;
b. Contract for a waste tire processing facility service within or outside the county or
state;
c. Collect and remove, or contract of the collection and removal of, waste tires from
waste tire piles or other areas within the county. Removal of waste tires may
include transportation outside the county, region, or state;
d. Perform, or contract for the performance of, research designed to facilitate waste
tire recycling and to operate recycling and education programs;
e. Establish waste tire collection centers at solid waste disposal facilities or waste tire
processing facilities;
f. Provide incentives for establishing privately operated waste tire collection centers
for the public; or
g. Perform, or contract for the performance of, enforcement and prevention activities
to prevent the illegal transportation and disposal of waste tires and other solid waste
materials; and
h. Purchase materials and products made from waste tires that are collected and
recycled within this state.
10. Each CJTY for itself agrees to provide a written account of expenditures from the
recycling and education grant and the waste tire grant CITIES agree to provide the
COUNTY with reimbursement reports no later than 15 days after the end of each quarter.
Documentation of expenses is required in sufficient detail to meet the requirements for
reimbursement placed on the COUNTY by FDEP for the grant awards. CITIES agree that
accounting records will be kept for a minimum of three (3) years for audit purposes and that
grant funds will be incorporated in the Annual Audit required by the Single Audit Act
(AI28).
11. The CITIES and the COUNTY agree to continue working on joint project~ through the
Pinellas County Recycling Committee.
12. The goal of recycling and waste reduction programs, designed and implemented by the
