undersigned municipalities (hereinafter referred to individually
as the "CITY" and collectively as the "CITIES"). and the Board of
County Commissioners of Pinellas County. Florida (hereinafter
referred to as the "COUNTY").
WHEREAS.
the
Legislature
of
the
State
of
Florida
("LEGISLATURE") has found and determined that the failure or
inability to economically recover material and energy resources
from solid waste results in the unnecessary waste and depletion of
our natural resources: and
WHEREAS~ the Legislature has declared recycling. and reuse of
material resources to _be a goal_.of Florida: and

WHEREAS. pur-sua'nt .to and incompliance with Chapter 403 . Part
IV. Florida Statutes (1988 Supp.) ("ACT"). the Board of County
Commissioners of the County duly adopted on April 18.
. 1989.
its ReSOlution No. 89-152 . a copy of which is attached hereto (the
"RESOLUTION"). adopting a Recyclable Materials Recycling Program
("RECYCLING PROGRAMIl) in the County: and
WHEREAS. pursuant to and in compliance with the Act.- the
County in the Resolution resolved to jointlY develop. to the
maximum extent possible. the Recycling Program with Cities in the
County through interlocal agreements: and
WHEREAS. it is the desire of the Cities and the County to
jointly develop the Recycling Program.
NOW THEREFORE. the County and the Cities hereby agree as
follows:

SECTION 1. AUTHORITY. This

pursuant to Section 163.01. Florida Statutes: Article VIII.

SECTION 2. DEFINITIONS.
Unless the context otherwise
requires. capitalized terms used herein shall have the following
meanings:

MACT" means Chapter 403. Part IV, Florida Statutes
(1988 Supp.).
"CITY RECYCLING PLAN" means the Plan described in
Section 3 hereof.
"COLLECTION CENTER" means a place to which a Person may
bring Designated Recyclable Material.
"COLLECTION CENTER PROGRAM" means that part of a City
Recycling Plan which utilizes Collection Centers.
"CURBSIDE COLLECTION PROGRAM" means that part of a City
Recycling Plan whereby Designated Recyclable Material is deposited
by the generator of such material at curbside for collection.
"DEPARTMENT" means the Department of Solid Waste
Management. Pinellas County. Florida.
"DESIGNATED
RECYCLABLE
MATERIAL"
means
Recyclable

"PERSON"
means
any individual.

partnership,
corporation, joint venture. municipality, or other public or
private entity.
"PET" means polyethylene terepthalate and is a plastic
resin used to produce certain plastic container products.
"PET
BEVERAGE
CONTAINER"
means
plastic
beverage
containers made with PET.
"RECYCLABLE MATERIAL" means those materials which are
capable of being recycled and which would otherwise be processed
or disposed of as solid waste.
"RECYCLING" means any pI:ocess by which Solid Waste. or
materials that would othefwise become solid waste. are collected.
separated. or pI:ocessed and reused or returned to use in the form
of raw materials or products.
"TIPPING FEES" means ,the- -fees charged to municipalities
and private solid waste haulers in Pinellas Country for the
disposal of solid waste at the Facility.
SECTION 3. CITY RECYCLING PLAN.
On or before September 1.
1989. and on or before September 1 thereafter. each City shall

submit to the Department a City Recycling Plan setting forth the
following:
(1) A description of its public education program on
recycling:
(2) The amount and type of materials from the solid
waste stream that were recycled:
(3)
The
percentage
of
the
City's
population
participating in various types of recycling activities instituted:
(4)
A
description
of
the
recycling
activities
attempted. their success rates. the perceived reasons for failure
or success. the recycling activities which are ongoing and most
successful and how such activities will be increased:
(5) The combined cost of collection. transportation.
storage and disposal of Recyclable,Material by Recycling.

If a Curbside Collection .pro,gram is used. that

scheduled collection dates as well as a contract. letter of intent
or other document outlining the scope of the City's Curbside
Collection Program:
(7) If a Collection Center Program is used. the
locat ion( s) and hours of operat~on of the Collection Center or
Centers. which location(s) shall be accessible to the general
'. public and which hours of operation shall be at least six (6) days
a week during normal business hours: and
(B) If a recycling program is used other than a
Curbside Collection Program orfollection Center Program. but

A City may amend its City Recycling Plan. and shall
submit such amended Plan to the Department for review.

SECTION 4 . COLLECTION PROGRAM TO BE ESTABLISHED. Each City
hereby agrees that it shall establish or cause to be established a
Collection Center Program or a Curbside Collection Program. or a
combination thereof. or a recycling program that achieves the
purpose of either a Collection Center Program or a Curbside
Collection Program.
SECTION S. RECYCLING EFFORT. At a minimum. each City shall
collect or cause to be collected Designated Recycling Material for
reuse or resale. A City may effect the collection of Designated
Recyclable Material in phases so that the goals of the Act are"
achieved by 1994. Each City shall be responsible for the ultimate
disposition of Recyclable Material collected in the City.
SECTION 6. REPORTING PROCEDURES.
1.. Effective September 1. 1989. each City, shall submit
interim quarterly reports to the Department certifi~d by the City

(i) the quantity. by weight. of each type of Recyclable Material
collected within the jurisdiction of said City during the previous

2. To aid the Cities and the County in meeting quarterly
reporting requirements. the Department shall. wi thin sixty (60)

days of the effective date of this Interlocal Agreement. develop
and make available a standardized report form suitable for use by
all Cities and the County.
SECTION 7. EFFECTIVE DATE.
This Interlocal Agreement shall
become effective upon filing with the Clerk of the Circuit Court
of Pinellas County. Flori~a.
