Susan spoke with Jeff Butler at Sylvan Abbey Cemetery and found the following
information regarding costs associated with the above.
The crypts are generally 8 feet long x 40 inches wide x 40 inches tall. They are placed
back to back and are generally four or six units high. In the area that we have available (20 feet
x 34 feet), we can construct a building containing 120 crypts (10 back to back and six high). Mr.
Butler indicated the cost to construct this type of building is approximately $500 per crypt which
equates to $60,000. Such a building would replace 60 urn/baby spaces that presently sell for
$125 each for a total worth of $7,500. Mr. Butler stated above ground crypts sell for $1,700 to
$3,000 at Sylvan Abbey. The architect who designed the building at Sylvan Abbey is David
Wilson, phone number 785-7064.
Susan has researched the sales history that is as follows:

Ordinance #5136-91 was adopted on 10/3/91. This ordinance increased the price of full spaces
from $200 to $500. Apparently the increase in prices has dramatically reduced our sales.
Since it would probably be difficult to recoup an investment of approximately $60,000 in the
foreseeable future, we would not recommend proceeding with this project at this time. In
addition the City has no provision for perpetual care at the cemetery.
We would however, suggest that we consider lowering our prices to $350 or $400 for a
full space and see if additional sales are generated. This would require an amendment by
ordinance.

Block 12; Lot 34; Space 2 because someone owns the space she is buried in.
• In the case of Leander Jones and John Brown in Block 14, Lots 57 and 61,`
they are in each other's spaces.
• Arthur Nellons should be buried in Block 14; Lot 195 but he has been buried
in Block 14; Lot 199. The City owns Lot 199.
• Alice Watts should be buried in Block 14; Lot 201 but she has been buried in
Block 14; Lot 203. The City owns Lot 203.
• Josephine Harris should be buried in Block 14; Lot 317 (which is owned by
Ms. Harris) but she has been buried in Block 14; Lot 315. Marie Laster owns
Lot 315.
• Benjamin Barnes should be buried in Block 14; Lot 341 but he has been
buried in Lot 343 approximately 1-1/2 ft. from the east line of the space. Lot

On January 13, 2001, 1 called your department to
request that you look at some large bushes on the
South end of our cemetery to determine if they were on
city right of way and if so, could they be cut down,
as trash collects under them and my mowing man could
not mow under them.
The people I talked to were very courteous and
helpful. The bushes were cut down and the stumps
were ground. We have smoothed the area, sewn grass
seed and planted a live oak tree further up in the
cemetery. While we were working there, many people
stoped to thank us for cleaning that area as they
felt it was a traffic hazzard.
I want to extend a thank you to all the City
of Clearwater_ workers that helped improve our cemetery.

In our discussion we decided it was best to number the spaces by using the number in the
bottom left corner of the newly created space (i.e. 433, 435, 437, 305. 307, 177, 179, 57, 59,
etc.). We will use the map attached to the memo of 5/23/97 with the additional conversion of
lots 267, 268, 341, and 342 and lots 125, 126, 227, and 228 into two additional full spaces.

Attached is a copy of a portion of the map for Block 14 showing the baby and urn spaces to be
converted to full spaces. I have colored them in alternating blue and green to show each
space and clearly delineate what four spaces make up the new adult space. You and I had
discussed that the spaces could take on the number in the bottom right corner (i.e. 432, 430,
428, 426, 424, 422, 30, 302, 176, 174, 56, 54, 52, etc.). We will note in the computer that
the other 3 spaces became a part of the fourth space. You indicated you did not feel that we
would need to involve Engineering to do a survey to lay out the new arrangement.
According to my calculations, this will createxnew adult spaces with 3 /baby spaces
remaining and V urn spaces.

In response to your memorandum of March 26, 1997, we concur with the
proposal to convert 132 baby/urn spaces to 33 full spaces. However, in
discussing this with Ozell George and Glenn Perry, we recommend the
following which I'm sure you have already considered.
1. Have the Engineering Field Survey Crew identify and outline the
33 proposed spaces. Since two baby/urn spaces are eight feet in
length I would assume this should be expanded to 10 feet for full
spaces. If so, our aisle widths will be reduced from five feet to
three feet. Glenn and Ozell do not see this as a problem.
2. Renumber the new full spaces so as not to change the numbers of
the remaining baby/urn spaces of which some I understand are
occupied.
We think this is a good idea and please let us know of future actions and if
we can be of assistance.

We have only two full spaces available to sell. Several years ago we considered
the possibility of redesignating some of the baby and urn spaces into full spaces.
Attached is a drawing showing the spaces that were removed from the availability list
with the thought they might be converted at a later date. The spaces to be considered
are all in Block 14 and are currently designated as baby/urn spaces 265-344 (80
spaces), baby spaces 421-444 (24 spaces) and urn spaces 163-190 (28 spaces). It
takes four of these spaces to make one full size space. Converting the above listed
spaces would provide 33 more full spaces. Renumbering must be taken into
consideration if the conversion is done since 4 spaces will become one.
We have not sold any baby or urn spaces for quite some time and even with the
conversion of the above listed spaces we will still have approximately 70 baby spaces
and 229 urn spaces.
Please let us know if your Department is interested in this conversion. It is
important to make this decision in a timely manner so that we can make people aware of
what is available.

Per our discussion regarding conversion of baby spaces into adult spaces I
would like to give you the following information.
The baby spaces, as well as the urn spaces, are located in Block 14 and each
space is 2 ft. by 4 ft. It would take four of these spaces to make up a full size
space. Presently, there are 203 urn spaces available for sale and 193 baby spaces.
The urn spaces sell for $100 and the baby spaces sell for $50. A full size adult
space sells for $200.
BABY SPACES
There were 3 baby spaces sold in 1988 and, as far as I can tell from the
records, the last space sold prior to that was in 1983. It does not appear that
it is necessary to have such a large inventory of these spaces. Converting spaces
265 through 344 (80 baby spaces) would provide 20 full size spaces. In addition,
if we converted spaces 421 through 445 (24 baby spaces) we would have 6 more full
size spaces. This would leave 89 baby spaces and provide 26 additional full size
spaces.
URN SPACES
There was one urn space sold in 1989 and several in 1988. Converting spaces
121 through 136 and 217 through 232 would provide an additional 8 full size spaces
replacing 32 urn spaces. Converting spaces 163 through 190 would provide 7
additional full size spaces and eliminate 28 urn spaces. Converting spaces 4
through 23 and 90 through 109 would eliminate 40 urn spaces and provide 10 full
spaces. These conversions would, therefore, provide an additional 25 full size
spaces and eliminate 100 urn spaces leaving 103.
If all these conversions were done it would provide 51 additional full size
spaces to add to the 166 spaces available in Block 15, 101 spaces in Block 16, and
the 18 railroad spaces in Block 16. It would, to some degree, reduce our total
valuation as four urn spaces are currently worth $400 as compared to $200 for a full
size space. There is no difference in value if the baby spaces are converted.
COUNTY SPACES
There are 40 "County" spaces available which have no value. These are located
along the railroad and if we decided to make some of these available for purchase
they should fall in the category of the other railroad spaces. Unfortunately, I
am uncertain whether the City or the County owns these spaces. The last burial in
the county spaces was in 4/88 and the one prior to that was in 1983.
An alternative to converting the urn and baby spaces would be to block Wthe
ones that we are considering for conversion indicating they are not for sale at the
present time. This would leave these blocks of lots in tact for conversion in the
future. It does not appear to be necessary to make this conversion now as there
are still 267 regular full spaces still available for purchase.

The only phone number we had for Coachman was for James W. Coachman. The number was 797-5678 and it has been
disconnected. I checked with Moss Feaster Funeral Home and that's the only number they have also. I don't know of
anything else we can do other than wait for them to contact us regarding the damage, should any of them go to visit the
cemetery. Can you store the brass door and whatever else has been torn loose in the shed out there?.....
The Castagna's (Block 12, Lot 41, Spaces 1-5) spaces are listed under owner William J. Castagna. There is a phone
number in the book for him, 446-3766. 1 called and got an answering machine, so I left my name and number with a brief
message for them to contact me regarding the Clearwater Cemetery and some vandalism done. Hopefully I'll hear back
from them. I'll let you know.

They sawed the brass gate at the Coachman Mausoleum and took one half of gate off, the majority of the gate was left
on the ground, I found small pieces of gate they had sawed off and left across the road. Can you try to locate the
owners so we may report the damage, or their living next of kin? We have brass flower holders that were put here
and there where they do not belong and marble vases are missing- we are working there today, so might find more
things missing, and I will need to report the Block, Lot and Space #'s of all the missing items. Can you contact the
Castanga's(sp?) to check their mausoleum to see if 2 vases were stolen or perhaps they moved them. I will have a
report filled out by end of day today. The City is not responsible for any damage- the owners home owner's
insurance will take care of if we can locate the owners. Police are doing BOLO'S through the Cemetery. I will keep
you apprised. Police report # is 06-14805

The cemetery, originally belonged to a group of heirs of
. P. Aunspaugh who, in turn, deeded it in 1914 to the Clearwater
:emetery Association (a Florida corporation) who deeded it to the
1ty of Clearwater on December 4, 1916. Over the years various
additions have also been deeded to the City.

The resolution does not authorize the Cemetery Superin-
tendent to remove temporary markers after a permitted time
frame. The temporary markers provided by the funeral homes
create problems for the maintenanoe workers at the cemetery and
the Superintendent has requested wording be incorporated into the
resolution to specifically state violations will be removed by
cemetery personnel after a specified time frame. Mr. Maute
requested a time frame of one year for temporary markers.
Paragraph 3(c)(d) addresses removal of flowers, wreaths, and
flags and does state that they will be removed. Apparently, they
have no problem removing those violations, but when they remove a
temporary marker, they have been subjected to verbal abuse by the
relatives. Many times the temporary markers are left on graves
for many years and have deteriorated to such an exent they are
not decipherable.-
At the present time there are no Florida statutes on
municipal cemeteries except for burial after a communicable
disease. I understand there was a bill before the legislature
last year that would have regulated municipal cemeteries, but it
was not adopted. It might be to our advantage to consider
creating a cemetery ordinance as soon as possible to pre-empt any

Nancy Tongel's marker is around 7 inches south of J.Roy Crosby's marker. Many markers at the Cemetery are that
close, others 10 inches, 12 inches ............. My tape measure at the Cemetery walked. We will re measure spaces to see
where markers should be, and re align them if needed. I will let you know when complete.

James Roy Crosby (or it may be J. Roy Crosby on his marker) is buried in Block 15 / Lot 23 / Space 3.
His widow called me today....... very upset because she hasn't been out to his gravesite in quite some time due to her
eye sight diminishing. Her son is visiting and they went there together. She says there is another marker 7 inches
away from her husband's marker. She said the name on it was Mary Congel and she died in 1982, which was prior to
when her husband died (98) and that marker was not there before. She's under the impression that someone was
"moved" next to her husband and the marker is too close.
Now, in Block 15, Lot 23.... there is a Nancy Tongel who died in 1982, buried in space 2, next to J. Roy Crosby.
I think the widow wrote down the name wrong and it was this Nancy Tongel's marker she was looking at.
What I need to know is whether or not the marker for Nancy Tongel is too close to J. Roy Crosby's marker.
Complicated, huh?

This was an action plan developed by then interim Parks Superintendent Jon Russell regarding the cemetery. Most
of the plan relates to maintenance issues at the cemetery. He did suggest that we explore the idea of purchasing the
property to the south for expansion. We have looked at this option in the past and I do not believe that there is
enough property to make it profitable. For now we are not considering this and will certainly inform you if we have

The Clerk's Office has budgeted half of the cost for a new computer
for the Cemetery. This item is listed on page 247 of the Annual
Operating Budget for FY 92/93.
Due to an oversight on my part, I did not include the Parks and
Recreation Department's share in the FY 92/93 budget. Therefore, we
will need to set aside an appropriate amount of money to purchase
the computer. Since, we are ordering only two cash registers
instead of three; sufficient funds are available for our share of
the purchase of the computer. Funds for this item will come from
the same budget code which was to be used for the purchase of the
cash register. Therefore, I would appreciate your adding the cost
approximately $930 to purchase the computer to budget code 010-1-
1601-640.
I realize we will not be able to purchase the com?uter until after
the first quarter amendments have been approved by the City
Commission. Your assistance in transferring the funds at that time
is appreciated.

will go to your dot-matrix printer unless you

Selection Menu option.
Change request: "...switch places with the 'um and history
choices at the top"
Response: The 'um option was added to the original program
code. The way in which it was inserted into the
program makes it impossible to reverse the order
of the jump and history choices without rewriting
the entire edit procedure.
Change request: "...any way to choose next or previous while
saving changes made to the document you were in ?"
Response: Much like the 'lump option, the dialog box that
appears after you save a document (ie. "<Next>
<Previous> <Edit> <Leave>") was an afterthought,
inserted into the program in such a way that
changing the logic sequence in the program impacts
so many things that, again, the edit program would
have to be rewritten.
I regret that the previous two change requests could not be met. Past
additions of options (lump, <Next>, etc.) were difficult since the program
was not designed for them in the first place. I tried to dovetail your
latest change requests into the program also and immediately realized the
ramifications of doing so. It messed everything else up ! Do not
despair, however. When (?) you get more up-to-date hardware (ie. 486 file
server, faster network cards, etc.) you will notice a dramatic difference
in throughput on your network. In effect, the two or three extra
keystrokes you have to press will not take near as long to process. If any
of you would like proof of this, come over to CIS to see your programs run
on a 486 workstation connected to a 486 based network.
Cemetery Tracking
Change request: "have program generate purchase agreement, receipt
for purchase... deed for purchase..."
Response: The only practical way to do this would be
external to dBASE. A WordPerfect "merge" of the
database information could be done to ensure data
concurrency. I will talk to Betsy about this.

Response: The ability to view the lot status and the
inclusion of interment notes on burial permits was
added in June. Both requests were made by Glenn
Perry and you granted permission to do them
(although I do not have a record of when we had
that conversation). Anyway ...the doc changes are

I told Laura Chase about the National Genealogy Society's request for cemetery information.
Attached is her E-mail response. Also attached is a copy of the CIS Automation
Policies/Procedures manual section that concerns Charges for Public Access. Note that
..requests for data ill a format other than a forn in which it is routinely kept" is chargeable.
This means that something as simple as a report form of the database would be chargeable
because it takes a little programming time and a lot of CPU/printer time. Note that custom
programming is $21.00/hour. Per Laura, if they only want the raw data, they can opt to
provide the diskettes, otherwise we charge them at cost. The burial information and
ownership information are kept in separate files. They need to specify which (or both) they
need.
As for distribution of the program itself, that's a Legal department issue that you can pursue
if necessary. I wouldn't "push" the idea of giving them a copy of the program - for two
reasons... (1) it could turn into a support (questions, questions, questions...) burden for CIS
and yourself very easily; (2) from what you've told me, it sounds like they need reports from
the data rather than cemetery space by space screen query capability that the program
provides. They could do their own reports or have us do them.
Let us know how this works out.

Yes, you may download the data for her. If she supplies her own
disk there is no charge. If we use a City disk we charge only
the actual cost of the disk. If she wants the programming logic
we need to refer that question to Legal for review. City's have
the right to copyright software and NOT give it away.. or to
charge for it if it is requested to make up Some development
costs. We have never had a request for our software - either way
she needs to submit a written request for whatever she wants
under the Florida Sunshine Law and we will provide it or refer it
to Legal as appropriate. Please let me know if you need
additional info.
AUTOMATION POLICIES/PROCEDURES
In the case of an on-line, City-wide software package, the owner is designated as
the department with primary user responsibility for the software (i.e., the owner of
Payroll data is DOAS/Finance).
2) Requests for information must be submitted, in writing to the owner of the data.
The owner, in turn, will contact CIS with a written request for the data, including
the signature of the Department Director or his/her designee.
If a department needs access to another department's data on a regularly-
scheduled basis, the owner may submit a blanket memo for that particular job. CIS
will then run that job based on the owner-approved schedule without additional
permission from the owner. The blanket memos will be reviewed on a yearly basis
by CIS.
3) CIS will produce the requested report and generate a bill for the cost of
duplication plus technological resources (if applicable). If the report is produced
for another City Department, the report will be sent to the requesting department
and the bill will be sent to the owner. If the report request came from outside the
City, the bill will be attached to the report and both items will be sent to the
owner.
4) The owner department is responsible for collecting all fees. If the request came
from outside the City, the owner will also forward the report to the requestor.
S) It is the opinion of the City Legal Department that CIS does not have to perform
custom programming tasks in order to provide data under the Sunshine Law. All
existing report formats will be used to provide public access.
Charges for Public Access
As stated in a memo approved by the City Manager September 18, 1990, the CIS
Division may charge a reasonable amount for data access under certain circumstances.
Those circumstances include:
Public records requests for data in a format other than a form in which it is
routinely kept.

do not belong to the requesting department.

I have installed the hardware and software required to bring the Cemetery
online with the Clerk's office. Next week I will get in touch with Glenn
Perry for training on the procedures I have written to download the files
from the Clerk's office to the Cemetery computer.
Jon, there are a few of points that I'd like to bring to your attention:
The CPU is on the floor (in a CPU stand). I was concerned about the
possibility of flooding in the building. Glenn says that the area is
not flood prone.
Glenn could probably use a little more desk space now that the monitor
takes up a third of his desktop. I suggest an extension or new
desktop to make this better.
There aren't enough wall plugs. Solution needed by Monday for
training to take place while the time clock is plugged in. There is
only one 2-receptacle wall plug in the proximity of the desk. The
following items need one plug each:
- time clock
- phone answering machine
- modem
- CPU
- monitor
The most cost effective solution is to replace the 2-receptacle Isobar
with a 4 to 6-receptacle one.
W The time clock needs to be plugged back in and reset by Monday.
When you get a printer for Glenn, please let me know so that I can
test the reporting part of the program. If it doesn't make any
difference, a wide-carriage printer would be best so that I do not
have to rewrite any reports.

He indicated that spaces 167 - 186, 267 - 342, and 421 - 444 could be converted (see
attached map). This would increase our inventory of full spaces by 30 spaces. He
recommended that we not convert them until we run out of full spaces and in the
meantime he will not indicate they are available as infant and urn spaces.
I also spoke with him regarding the value of the plats. He indicated they are
invaluable to him and that he uses them to advise people regarding which spaces are
available rather than digging through the books. He also stated they are helpful
to employees who fill in when he is not available.

On the form that your office uses for the reconveyancing of cemetery property
from one person to another with the consent of the city, please modify the form
to provide the following:
1. Allow a space to type (or write legibly) the name and post office
address of the grantor, immediately beneath the grantor's signature.
2. Allow a space to insert the name of each witness (the address is not
required) beneath the signature of each witness, .
3. Leave a 1.5-inch square at the top right corner.
These requirements are from a 1990 law creating §695.26, F.S., that took effect
July 1, 1991. The requirements will affect deeds conveying cemetery property
from one owner to another.
There is an exception for instruments prepared or executed by any public officer
other than a notary public, so there should be no need for you to change your
standard form cemetery deed where the City is the grantor.
There is also an exception for deeds executed or acknowledged out of state. The
recent reconveyancing deed from Mildred Marie Caldwell to Myrtle Paciorek was
executed and acknowledged in Indiana and does not have to be redone.

stamped upon such instrument.
(2) If a name or address is printed, typewritten, or
stamped on an instrument in a position other than the
position required by subsection (1), the clerk of the cir-
cuit court may, in his discretion, accept the instrument
for recordation if he determines that the connection
between the signature and the name or the name and
the address is apparent.
(3) This section does not apply to:
(a) An instrument executed before July 1, 1991.
(b) A decree, order, judgment, or writ of any court.
(c) An instrument executed, acknowledged, or
proved outside of this state.
(d) A will.
(e) A plat.
(f) An instrument prepared or executed by any pub-
lic officer other than a notary public.
(4) The failure of the clerk of the circuit court to com-
ply with this section does not impair the validity of the
recordation or of the constructive notice imparted by
recordation.

705.103 Procedure for abandoned or lost property.
(1) Whenever a law enforcement officer ascertains
that an article of lost or abandoned property is present
on public property and is of such nature that it can be
easily removed, the officer shall take such article into
custody and shall make a reasonable attempt to ascer-
tain the rightful owner or lienholder pursuant to the provi-
sions of this section.
(2) Whenever a law enforcement officer ascertains
that an article of lost or abandoned property is present
on public property and is of such nature that it cannot
be easily removed, the officer shall cause a notice to be
placed upon such article in substantially the following
form:
NOTICE TO THE OWNER AND ALL PERSONS INTER.
ESTED IN THE ATTACHED PROPERTY. This property,
to wit: (setting forth brief description) is unlawfully upon
public property known as (setting forth brief description
of location) and must be removed within 5 days; other-
wise, it will be removed and disposed of pursuant to
chapter 705, Florida Statutes. The owner will be liable for
the costs of removal, storage, and publication of notice.
Dated this: (setting forth the date of posting of notice),
signed: (setting forth name, title, address, and tele-
phone number of law enforcement officer).
Such notice shall be not less than 8 inches by 10 inches
and shall be sufficiently weatherproof to withstand nor-
mal exposure to the elements. In addition to posting, the
law enforcement officer shall make a reasonable effort
to ascertain the name and address of the owner. If such
is reasonably available to the officer, he shall mail a copy
of such notice to the owner on or before the date of posh
ing. If the property is a motor vehicle as defined in s.
320.01(1) or a vessel as defined in s. 327.02(27), the law
enforcement agency shall contact the Department of
Highway Safety and Motor Vehicles or the Department 1
of Natural Resources, respectively, in order to determine
the name and address of the owner and any person who
has filed a lien on the vehicle or vessel as provided in
s. 319.27(2) or (3) or s. 328.15(1). On receipt of this infor•
mation, the law enforcement agency shall mail a copy
of the notice by certified mail, return receipt requested,
to the owner and to the lienholder, if any. If, at the end
of 5 days after posting the notice and mailing such
notice, if required, the owner or any person interested
in the lost or abandoned article or articles described has
not removed the article or articles from public property
or shown reasonable cause for failure to do so, the fol-
lowing shall apply:
(a) For abandoned property, the law enforcement
agency may retain any or all of the property for its own
use or for use by the state or unit of local government,
trade such property to another unit of local government
or state agency, donate the property to a charitable
organization, sell the property, or notify the appropriate
refuse removal service.
(b) For lost property, the officer shall take custody
and the agency shall retain custody of the property for
90 days. The agency shall publish notice of the intended
disposition of the property, as provided in this section,
during the first 45 days of this time period.

Cemetery fees have not been increased since 1978. We contacted the Cities of
Dunedin and Largo and a private enterprise. Private enterprise charges considerably
more but they do offer perpetual care which we are not in a position to do.
Annual revenue from the cemetery ranges between $4,000 and $5,000 while the
expenditures run from $30,000 to $40,000. Employees of the Parks & Rea-cation
department do they maintenance work on a full time basis.
There are 482 baby spaces remaining to be sold. In the past 2 or 3 years only
recall one being sold anC T suggest we convert a good part of the babi• section to be
used for urns. There are many more cremations now than there used to be and I believe
we could sell them at a slightly lower rate than, a full. space.

At the last Commission meeting the Commission asked
for my recommendation as to the purchase of the above
property at a cost of $600,00,
It is believed that there is no question but that the
spaces could be sold eventually with the City receiving
at least 4730,00 for Uiemugh individual space
sales.0
It is my understanding that the reason the property
has not been sold is that they do not want to dispose
of it by spaces, but want to sell the lot as a whole,
I do not know how the sprinkler system is laid out
on the lot, so cannot tell whether it would interfere
with spaces. Mr, Dobson is checking on this matter
and also as to whether the large oak tree on the
corner would interfere with any of the spaces, If
these items do not interfere, the City would be able
to receive another i146*00 in the *&is of individual
spaces.
I have merely tried to set down the facts of the
matter without making a definite recommendation,

I have spoken today with John Nelson, the attorney for Mr. Michael Hill.
As you probably know by now, Mr. Nelson has sent you a letter indicating that
Mr. Hill will give the City permission to disinter his father, John Keith Hill, on
the condition that the City bear all expenses and that the casket not be opened. I
informed Mr. Nelson that these conditions were acceptable to the City.
In one of our conversations, you indicated that this problem had arisen
previously. I understand that this is a very old cemetery and that the records
available are poor. However, to protect the City from any suit for future
mistakes concerning where certain people should be buried, I urge that you get
together with the Clerk's Office to coordinate and improve the records of the
cemetery. If you have any questions, please contact me.

Dear Mr. Kingsbury:
A proposal for professional land surveying services is being
requested from your firm to perform a boundary survey of
Clearwater Cemetery on South Myrtle Avenue in Clearwater.
The cemetery lies within a portion of the NE 1/4 of Section
21 and the NW 1/4 of Section 22, in Township 29 South, Range
15 East, on either side of Myrtle Ave. and North of Lakeview
Road.
Attached are copies of deeds, surveys, plats, railroad
drawings, etc. of, and adjacent to, the subject property.
The attached atlas sheet shows the approximate boundary of
the tract. Copies of City deeds are also attached. Please
be aware we are unable to locate all of the deeds covering
the property.
Upon receipt and acceptance of your proposal, the City will
have to approve a purchase order, prior to giving you the
notice to proceed. Please provide in your proposal a firm
time period, after notice to proceed, when this work would be
completed.

comes in after 3:30 and wants to open the grave the next morning we have a problem.
I understand from Eleanor that Bob Maute made a statement to her this past
Monday to the effect that Glen Perry is the only person who knows what spaces are
available for sale. I seem to remember on one occasion that Ozell went out there
to help someone. In the instance that occurred this past Monday Eleanor told Bob
that Ozell was at the cemetery and that's when Bob said Ozell wouldn't be able to
show the party what was available and he (Bob) couldn't either. Maybe this is a
problem and not knowing how to work with the books to determine availability as
opposed to not knowing the layout.
It is also my understanding from Eleanor that Bob Maute no longer has a radio
and we must now call Parks & Recreation and leave a message for him and there is
no way of knowing how soon he will get the message.

In order to prove the right of interment in the city cemetery, the most
acceptable evidence is a cemetery deed naming the individual to be interred as
the purchaser of the space.
If the individual to be interred is not named on the deed as the purchaser, but
the purchaser bought more than one space, it is reasonably safe to assume that
the interment of a member of the immediate family (spouse, child or parent) was
intended. Evidence of the family relationship may consist of a birth certificate,
death certificate, or will, but I cannot give you an exhaustive listing of items
which could be used to prove the relationship to the purchaser.
Beyond the immediate family, it is less safe to assume that the individual has
the right of interment. When such cases arise, we will have to review the
claimed right of interment and make a decision upon whatever evidence is offered.
It would be a good idea to develop an interment authorization form to be
completed by the purchaser at the time cemetery spaces are sold, with the
original to be kept on file in your office. In fact, the cemetery deed itself
could contain the notation, "for the interment of , " which
would have the advantage of going into the public records and eliminating the
risk of losing a separate authorization form. The disadvantage is that the
purchaser's plans could change due to changes in the family relationship, for
example. In either event, the purchaser should be notified that it is the
purchaser's obligation to inform your office if the authorization should ever
require modification.
A newspaper advertisement might produce old cemetery deeds to complete your
records, but it might also produce claims which would be impossible to disprove,
and it would generate a loss of confidence in the City's ability to manage its
affairs with respect to a very sensitive activity. I suggest that the money
would be better spent searching the public records in the courthouse to see how
many cemetery deeds were recorded, and comparing the results with your records.

Per our discussion regarding conversion of baby spaces into adult spaces I
would like to give you the following information.
The baby spaces, as well as the urn spaces, are located in Block 14 and each
space is 2 ft. by 4 ft. It would take four of these spaces to make up a full size
space. Presently, there are 203 urn spaces available for sale and 193 baby spaces.
The urn spaces sell for $100 and the baby spaces sell for $50. A full size adult
space sells for $200.
BABY SPACES
There were 3 baby spaces sold in 1988 and, as far as I can tell from the
records, the last space sold prior to that was in 1983. It does not appear that
it is necessary to have such a large inventory of these spaces. Converting spaces
265 through 344 (80 baby spaces) would provide 20 full size spaces. In addition,
if we converted spaces 421 through 445 (24 baby spaces) we would have 6 more full
size spaces. This would leave 89 baby spaces and provide 26 additional full size
spaces.
URN SPACES
There was one urn space sold in 1989 and several in 1988. Converting spaces
121 through 136 and 217 through 232 would provide an additional 8 full size spaces
replacing 32 urn spaces. Converting spaces 163 through 190 would provide 7
additional full size spaces and eliminate 28 urn spaces. Converting spaces 4
through 23 and 90 through 109 would eliminate 40 urn spaces and provide 10 full
spaces. These conversions would, therefore, provide an additional 25 full size
spaces and eliminate 100 urn spaces leaving 103.
If all these conversions were done it would provide 51 additional full size
spaces to add to the 166 spaces available in Block 15, 101 spaces in Block 16, and
the 18 railroad spaces in Block 16. It would, to some degree, reduce our total
valuation as four urn spaces are currently worth $400 as compared to $200 for a full
size space. There is no difference in value if the baby spaces are converted.

COUNTY SPACES
There are 40 "County" spaces available which have no value. These are located
along the railroad and if we decided to make some of these available for purchase
they should fall in the category of the other railroad spaces. Unfortunately, I
am uncertain whether the City or the County owns these spaces. The last burial in
the county spaces was in 4/88 and the one prior to that was in 1983.
An alternative to converting the urn and baby spaces would be to block of?the
ones that we are considering for conversion indicating they are not for sale at the
present time. This would leave these blocks of lots in tact for conversion in the
future. It does not appear to be necessary to make this conversion now as there
are still 267 regular full spaces still available for purchase.
Please let me know if there is anything further I can do in this regard.

On Tuesday, January 12th, 1988, we met to discuss items re-
garding the Clearwater Cemetery. One of these items was
"Burial Permits" which are required each time a gravesite
is needed. It was decided that immediately upon completing
a burial permit, your office would contact our Parks Division
so that the permit could be picked up. Your first contact
would be Mr. Bob Maute. In the event Mr. Maute is not
available, please contact Mr. Ozell George. If Mr. Maute or
Mr. George cannot be reached, Mr. Glenn Perry is to be con-
tacted at the City Cemetery.
The person picking up the burial permit will deliver it to
Mr. Perry at the Cemetery. Both employees will enter the
information in the Cemetery book and stake the gravesite.
In addition to the above, you stated that you would look into
the possibility of securing a part=time senior citizen to
work with Mr. Perry on updating Cemetery records. Further,
you indicated that you would contact the Public Works De-
partment to determine if a new map of the Cemetery could be
prepared.

BACKGROUND:
There have been no changes in cemetery fees or rules since 1974. During
that period the total operating budget for the cemetery has increased
62% due to wage increases, inflation, cost of equipment, etc. Therefore,
it is recommended the price of certain spaces be increased to help defray
these increased operating costs as well as the increase in land values.
To further help reduce operating costs, it is recommended the funeral
directors be responsible for openings and closings, with city personnel
locating the spaces to be used at no charge except on Saturdays, Sundays
and holidays.
Also, for health reasons, outside concrete receptacles should be required
for caskets over 5 feet in length.

has been completed. We have entered the names of approximately 4100 deceased-
people in a dBASE program which we will match against the lot records. A
systems analysis will be performed to develop solutions that will address the
different problems that have been encountered.
With regard to the boundary survey that was agreed upon, it appears that
very little activity has occurred in this regard.
We will keep you informed on the progress of activities conducted to
address the problems of the cemetery and the solutions that are developed.
