INTERLOCAL AGREEMENT
This Interlocal Agreement made and entered into this 18th

of County Commissioners.
and
muhicipalities within Pinellas County representing the majority
of the population of the incorporated area of Pinellas County;
WIT N E SSE T H:
\.vHEREAS. this Agreement is authorized by Section 336.025.
Florida Statutes, and other applicable law;,'and
WHEREAS. Pinellas County is authorized by the afore-
mentioned statute to levy and impose a local option gas tax, in
addition to other taxes allowed by law. upon every gallon of
motor fuel sold in Pinellas County and taxed under the
provisions of Chapter 206. Florida Statutes; and
WHEREAS. the Board of County Commissioners of Pinellas
Co~nty has indicated an intent to consider the adoption of an
ordinance imposing a four cent (4~) local option gas tax
pursuant to the aforementioned statute; and
WHEREAS. the local option gas tax. if levied, shall be
effective for a period of five years from September L 1985
through August 3l, 1990; and
WHEREAS. the purpose and intent of this agreement is to
establish a plan for the administration and expenditure of the

proceeds of the local option gas tax. and a distribution
formula for dividing the proceeds of the local option gas tax
imposed
pursuant
to
the
aforementioned
statute

above-referenced ordinance among the county government and all
eligible municipalities within Pinellas County.

Section 1. All the proceeds from the local option g~s tax
imposed by County ordinance upon every. gallon of motor fuel

Chapte~ 206. Florida statutes. shall be distributed by the
State Department of Revenue directly to Pinellas County, by and
through its Board of County Commissioners for placement in a
local option gas tax trust account for subsequent disbursement
in accordance with the Local Option Gas Tax Use Plan attached
hereto as Appendix "A" and incorporated by reference herein.
Section 2. The parties agree that the funds received
pursuant to this ag~eement shall be used and expended only for
those purposes authorized by Section 336.025. Florida Statutes
and referenced
in
the
Local
Option ,Gas Tax Use Plan
(Appendix "A").
Section 3. The parties agree that the Board of County
Commissioners shall administer the Local Option Gas Tax Use
Plan (Appendix "A") and all or any portion of the proceeds
derived from the local option gas tax authorized by Section
336.025, Florida Statutes, and levied and imposed by ordinance'.
adopted by the Board of County Commissioners may be pledged by
the Board of County Commissioners to secure and liquidate
revenue bonds issued by Pinellas County for the. purposes set
forth in Section 336.025. Florida Statutes. and this agreement,
or to develop. implement. and administer any other program or
financial arrangement in accordance with applicable law to
provide for the availability of funds for disbursement in
accordance with this agreement. and any amendments thereto.

collected and received by the Board of County Commissioners in

Option Gas Tax Use Plan (Appendix "7\.").

Section 4. The parties agree that the projects referenced
in the Local Option Gas Tax Use Plan (Appendix "A") may not be
changed or deleted, nor may different projects be substitut(~d
or added, except vlith the express written consent, in advance,
of Pinellas County,
by and through its Board of County
Commi s s ioners, and the governing bod ies of all uni ts of loca 1
government directly affected by the proposed change in the
Local Option Gas Tax Use Plan (Appendix "A").
Section 5. This agreement may be amended, in writing,
upon the express formal consent of the governing bodies of all
the parties.
Section 6. This agreement shall automatically terminate
in the event the Boar.d of County Commissioners of Pinellas
County does not adopt an ordinance imposing a local option gas
tax as provided in Section 336.025, Florida Statutes on or
before September 1, 1985.
Section 7. This agreement' shall be effective for the
purposes stated herein on September 1, 1985 and, except as
otherwise provided herein, shall expire on August 31, 1990.

LOCAL OPTION GAS TAX
FUNDING DISTRIBUTION PROPOSAL
(June 19~5)
During 1983, the Local option Gas Tax (allowed by action of the 1983
Legislature) was not passed in pinellas County largely due to
nonagreement concerning the use and distribution of funds. The following
is a proposal to revise the original funding formula to address what is
felt to be a more equitable distribution of funds, while still reflecting
the basic guidelines established by the Board in June 1983. This formula
includes consideration of three major areas of concern: 1) funds being
set aside for construction and operation of the countywide computerized
traffic control system; 2) funds for local maior road construction and
reconstruction, such distribution based upon the current population in
each jurisdiction; and 3) distribution of remaining county funds to major
areas of Pinellas County, based upon population and needs. Attachment #1
shows the detailed distribution of funds based upon the following formula:
$60,000,000 :: Approximate five-year levy of the full four-cent
Local Option Gas Tax.
$15,339,500 :: Cost to construct the countywide computerized
traffic control system.
$ 2,000,000 =
Local match for the Guideway Project (Clearwater
to st. Petersburg "Corridor) which includes the
Final EIS/Prelirninary Engineering and Design/
Engineering.
$10,665,125 =
25~ of remaining funds allocated for construction
and reconstruction of local maj or streets within
the cities and the County, based upon the 1984
University of Florida population estimates within
each jurisdiction.
$31,995,375 =
75~ of remaining funds expended by the Board
within major geographic areas, based 50~ on popu-
lation and 50~ on need. These funds would be ex-
pended for construction and maintenance of major
roads consistent with Board policy.
Attachment #2 is a map showing projects conunitted to or anticipated
to be conunitted by the Cities and County participating in the Local
Option Gas Tax Program. Attachment #3 is a listing of those projects not
listed on the City/County Local Option Gas Tax map.
