INTERLOCAL AGREEMENT

THIS AGREEMENT is made and entered into this

day of
July
, 1984 by and between PINELLAS COUNTY, a political
subdivision of the State of Florida, and the CITY OF CLEARWATER.
The parties hereto mutually agree to the following:
WHEREAS, the Home Rule Charter for Pinellas County, Florida, Article
III, Section 2.02(e), directs the Board of County Commissioners of pinellas
County, Florida to establish provisions for the protection of human rights
for all people of Pinellas County from discrimination, based upon religion,
political affiliation, race, color, age, sex or national origin; and
WHEREAS, the Board of County Commissioners of Pinellas County, Florida
has enacted an Ordinance relating to the protection of human rights in
housing, employment, and public accommodations; and
WHEREAS, the CITY OF CLEARWATER has existing administrative procedures
and
personnel
for conciliation processing and enforcing
municipal
ordinances relating to human relations within its municipal boundaries; and
WHEREAS, the local laws of the CITY OF CLEARWATER are considered to be
"substantially equivalent" to federal and state laws; and
WHEREAS, this "substantially equivalent" status permits a city's human
relations agency to locally handle any complaints that are reported rather
than having the state or federal government intervene to investigate and
process a complaint; and
WHEREAS, utilization of the existing Human Relations Boards in the
CITY OF CLEARWATER, for the enforcement of the County Ordinance, is in the
best interest of all citizens of the County; and
WHEREAS, THIS Agreement is authorized by the provisions of Section
163.01, Florida Statutes, which authorizes the exercise by agreement of two
or more public agencies of any power common to them.
WIT N E SSE T H:
IT IS HEREBY MUTUALLY AGREED between PINELLAS COUNTY and the CITY OF
CLEARWATER. that
1. PINELLAS COUNTY shall delegate authority for enforcement and
administration of the pinellas County Human Relations Ordinance to the CITY
OF CLEARWATER for that portion of pinellas County north of Ulmerton Road.

Pursuant

County area.
3. PINELLAS COUNTY agrees to allocate funds to the CITY OF CLEARWATER
for additional staff and operational costs due to the increased caseload
associated with serving that portion of Pinellas County.
4. IT IS MUTUALLY AGREED that all personnel employed by the CITY OF
CLEARWATER, with funds allocated pursuant to this contract, shall be
employees of the CITY OF CLEARWATER and not of PINELLAS COUNTY.
5. Amendment: This Agreement may be amended in writing by consent of
the parties hereto, which shall become effective in the same manner as
provided in Paragraph 7 below.
6.
Effective Date:
This Agreement and any amendments hereto shall
become effective upon filing with the Clerk of the Court, Pinellas County,
Florida.
7. Renewal - This Agreement shall continue in force for successive
periods of one (1) year.
Any party hereto may terminate its participation
in this Agreement by notifying the other party in writing by July 1st of
any calendar year of its intention to withdraw from the Agreement at the
end of the then fiscal year.
IN WITNESS HEREOF, the parties to this Agreement have caused their
names to be affixed hereto by the proper officers.
