This memo is in response to your memo of December 4, 1970 regarding this subject.
The minutes of the Commission meeting of May 19, 1969 regarding this subject are
as follows:
"Commissioner Carlson moved to instruct the City Manager to enter into an agree-
ment with Pinellas County School Board of Public Instruction for the installation of
sidewalks along Palmetto, along Hercules and along Kingshighway and that the proper
City officials be authoriaed to enter into a proper contract or agreement to have the
work done as outlined. "
This agreement was never executed by the School Board inasmuch as it was dis-
covered that they did not have legal authority to spend School Board monies for
sidewalks. Sidewalks were installed, however, to provide the necessary protection
to school children walking to school. ~) '5

The City Commission was made aware of this problem at a wo~ession. In the
negotiations with the School Administration covering the tennis complex at Clear-
water High School, the City was given concession in the agreement for City use of
the tennis complex that had a dollar value far beyond that which the School Board
was supposed to pay as their contribution to the cost of sidewalks. This was done
with the knowledge of the City Commis sion.
