SCHOOL FACILITY USE LEASE
(NOT TO BE USED FOR ATHLETIC EVENTS IN STADIUM/TRACK OR FOR REGULARLY SCHEDULED MEETINGS
OF SCHOOL RELATED GROUPS.)
'!his lease is made and entered into this 26thdate of Sept. 1978, between the SCHOOL
BOARD OF PINELLAS COUNTY, FLORIDA, hereinafter called Lessor, and the Clearwater
Parks and Recreation De.parf'mpnf' of the City of Clearwater
State of Florida, hereinafter called Lessee, for use of Please see attached listings

under the following terms and conditions:
1. The Lessee agrees to pay to the Lessor at the time of the acceptance of this
lease, a deposit of fifteen dollars ($15.00) for each day reserved. The
deposit will be forfeited if for any reason that date is cancelled or changed.
The sum of $ 1.00 is due and payable upon the acceptance of this lease. The
total deposit paid will be deducted from the total charge unless a portion of
such deposit has been forfeited. All charges made for the use of school
facilities shall be paid in advance of the date that such facility is to be
used. (See instructions for exceptions.)
All Lessees are required to furnish a Certificate of Insurance (See Items 3 and
4) and are also required to pay a minimum rental fee of one dollar. ($1.00)
2. The Lessee agrees that:
a. All Fire Department regulations must be strictly observed.
b. SmOking may be permitted in the halls with the principalls permission.
There will be no smoking in rooms, auditoriums, gymnasiums, etc.)
c. Concessions will be operated only for the benefit of the school and with the
permission of the school principal.
d. The presence of at least one custodian is required when school facilities
are occupied by any group.
e. All school facilities and equipment used must be returned in as good
condition as when rented. Cost of repairs must be borne by the Lessee.
f. Space will not be available if use interferes in any way with the school
program.
g. Lessee shall inspect the premises and determine that same is in safe and
usable condition.

In consideration of $1.00 and other good and valuable considerations, receipt
of which is hereby acknowledged, the Lessee agrees to indemnify and save and
hold harmless the Lessor and to ac~ept all liability a:ising out of, or re-
sulting from any accident, illness, sickness, or other injuries including
death at any time occurring to persons (other than employees of the Lessor,
while acting in their capacity as employees) on school premises and/or

property damage to school premises (building I content, equipment)
and to property of others during time of rental or rehearsals. The
Lessee agrees further not to incur any debts which may be required or
requested to be borne by Lessor. Lessee's limit of liability shall be
in an amount equal to the limits of liability required in the liability
insurance policy covering this lease.
4~ The Lessee shall furnish to the-Lessor a Certificate of Insurance form ,as
evidence that the minimum . amount of insurance required by this lease will
be in effect during the period of this facility use.
Limi ts of liability for this le~se shall be:
$100,000 Bodily Injury Liability, per person
$300,000 Bodi.l.y Injury Liability, peroccurrence
$50,000 Property Damage per occurrence
OR
$300,000 per occurrence Bodily Injury and
$50,000 per occurrence Property Damage Liability.
A Certificate of Insurance must be attached to and made part of this lease.
5. Special provisions (date and time of use, etc.)

a. This agreement is subject to termination by the Lessor or Lessee upon
ten days notice to the respective party.
b. No improvements shall be made on the property except by modification of
of this lease in written form and signed by the parties hereto.
c. Under no circumstances shall the period of this lease extend for more
than one year.
d. Unforeseen questions shall be decided by Lessee and the Principal of the
facility being leased.
6. The following Rate Schedule is agreed by the parties hereto to be valid,
reasonable and binding on said parties. The Lessor reserves the right to
adjust the lease charges in accordance with the Rate Schedule if the facility'
usage differs from the lease terms.

Specifically excluded herefrom are all personal injuries or
property damage when such are caused by the acts and/or
negligence of any employee, agent or representative of the
Distric~ School Board of Pinellas County, Florida.
