BAILMENT CONTRACT
THIS AGREEMENT made by and between CITY OF
CLEARWATER, a Florida municipality, hereinafter referred to as
"Bailor", and THE SCHOOL BOARD OF PINELLAS COUNTY, FLORIDA, a
political subdivision of the State of Florida, hereinafter
referred to as "Baileell.
Term of Bailment
1. Bailee agrees to take possession of one (1) 1960
Ford Segrave 500 gpm pumper 47 truck, 1240-31, Tag #53556, ID No.
M495, for the sole purpose of use by Bailee for the training of
student firefighters of pinellas vocational Technical Institute
for a period of 19 weeks.
Valuation of Property
2. The value of said property is Three Thousand
($3,000.00) Dollars.
Insurance of Property
3. Bailee agrees to be responsible for said property
as a self-insurer to the extent of its declared valuation.
Restrictions on Use of Property
4. Bailee agrees to restrict the use of said truck by
the following restrictions:
a) the truck will only be driven by an instructor of
pinellas Vocational Technical Institute, properly trained,
licensed and experienced to drive said truck;
b) the truck will be used no more frequently than
twice each week with minimum road driving.

Condition of Property
5. Bailee agrees to keep said property in good order
and to return the same at the termination of this bailment in as
good condition as when received, ordinary wear and tear excepted.
Bailee's Indemnity of Bailor
6. Bailee agrees to indemnify and hold harmless Bailor
from any and all claims, demands, rights, and cause of action of
whatsoever kind and nature, arising from and by reason of any and
all known and unknown, foreseen and unforeseen, bodily and
personal injuries, damage to property, and the consequences
thereof, resulting, and to result, from any negligence of Bailee,
or Bailee's employees, or agents, to the extent of the limits set
forth in 5768.28 Fla. Stat., and Bailee further agrees to defend
at its expense any such claim asserted against Bailor if so
requested by Bailor.
Notice of Withdrawal
7. Bailor agrees to give Bailee two days' notice of
intention to withdraw said property.
