WITNESSETH:
WHERE1\S, the Board is desirous of usin; various Ci ty~ed
facilities for various administrative meetings; and
lvlmREAS, the Ci ty is desirous of using various school facili ties
owned by the Eoard, for recreational and educational programs; and
WHERE1\S, the City and Board are each willing to =perate in this
matter under certain conditions and provisions.
NJW, THEREFORE, in consideration of the cov-enants herein contained
and other good and valuable consideration, the Board and City mutually

agree to lease their respective facilities as outlined in Exhibit "A"
hereto attached and made I=Brt of said a;reement, under the following terms
and conditions:

2. '!he Board agrees to make the described facilities available ....nen
the use thereof does not interfere or conflict wi th the regularly scheduled
school programs as outlined in Exhibit "A." Use of said facilities shall
not be earlier than 8:00 a.m. nor later than 11:00 p.m. for outdcor use and
not later than 12:00 midnight for indoor use.
3. The premises owned by the City shall l:e used by the Board for
various administrative and operations meetings and shall rot conflict with
any City prcgrams and shall confocn wi th the hours the facili ties are
normally open to the p.lblic.

4. The parties agree to maintain the facilities and surrounding
area in a clean arrl sanitary conditien after use by the parties or any of
its agents or invitees.
5. Each party shall provide its own p::rsonnel for the supervision
of the programs it ccrrlucts.
6. Use of the leased ~emises by ~ivate parties or organizations
or by business enterprises for profit is prohibited. The Board arrl City
further agree to make 00 tmlawful, improper or offensive use of the leased
premises arrl all rights of the leasing party hereunder shall be teDllinated
by the Board or City in the event that such use is made thereof.
7. The parties agree that each will save the other harmless on
account of the negligent acts of its employees, servants or agents or en
acccunt of any unsafe conditions that may exist as a result of the
negligent operation by the parties of the leased facilities. The Board and
City agree to be responsible for the safety of its own invitees, licensees
or participants in their respective program in case of accidental injury,
except as noted above. The Board arrl City agree to provide each other
~oof of insurance coverage in the amounts required by law under section
768.28, Florida Statutes.
8. The Board and City will rot assign this Lease oor sublet the
premises or any part thereof without the written consent of the other
party. The Board and City agree that each party and its officers, agents,
arrl servants shall have the right to enter arrl inspect the leased premises
and the operation being ccnducted thereon at reasonable tilnes, and that
this Agreement may be canceled by either the City or Board with a thirty
(30) day written ootice.
9. Mditional City or School Board facilities may be used at
appJ:'Opriate tilnes arrl places with written approval of the Superintendent or
Ci ty Manager. The joint use agreement may then be amended to reflect the
additional uses which are requested arrl approved.
10. The &:lard and City agree that in the event of unforeseen
questions arising out of the use of the said facilities or questions of
use, questions shall be settled in writing between the Superintendent and
the City Manager or its specific designee for resolution of such questions
concerning this Lease.

1. Ci ty Usage of School Facili ties
A. Clearwater High School
1 . Gymnasium ,
a. Program - The Recreation Department runs a youth
basketball league for boys. The Recreation Department
also utilizes this facility for a surrmer basketball clinic
for youth and adults.
b. Times and Dates - The t:oys youth basketball league runs
fran the beginning of Decanber until the first week of
March. They play every Saturday (with the exception of a
b.o \\leek break around Olristmas) fran 9:00 a.m. until 1 :00
p.m. The smnner basketball clinic operates fran the
middle of June until the middle of August (eight \\leeks)
during the hours of 3 :00 p.m. until 10:00 p.m., M:lnday
through Friday. The approximate hours of usage for this
facility is 332 hours.
c. Costs - The Recreation DepartJnent will hire a teadler fran
the high school to -..ork as a referee for the youth
basketball and also will help supervise the school. For
the summer clinic, a recreation specialist and a
recreation assistant are hired to run the program. Every
attempt is made to hire t-..o teachers fran the high sdlool
for these positions. Any extra custodial -..ork needed
because of these t-..o programs will be performed by these
Ci ty enployees.

3 . Tennis Courts
a. Proqram - The Recreation DepartJnent uses the tennis courts
as a facility for public play.
b. Times and Dates - The tennis courts can be used year-round
by the public during the times of the day when it doesn't
interfere with a school program.
c. Costs - When the courts \\Iere constructed the ci ty paid for
the lighting of the courts and the city has continued to
pay for the operation of the lights. Besides this, no
other ccsts are incurred.
4. Basketball Courts
a. Proqram - The Recreation Department utilizes the
basketball courts similar to t..'1e tennis courts which is a
facili ty cpen for plblic play.
b. Times and Dates - The courts are used for public play
year-round, but again, only during the times of the day
when it doesn I t interfere with a school program.
c. Costs - The City paid for half of the construction costs
of the basketball courts while the other half was paid for
by the school. Another ccst which the City pays is the
operation of the lights figuring that lTOst use at night is
done by the open P-Jblic play and not by school programs.
5. Running Track
a. Program - A citywide clinic, track meet, or special
program may be run by the Recreation Department on this
facility. The P.A. system and other track equipment ll\3Y
be used 'by the Ci ty for these events.
b. Times and Dates - The number of times this facility is
used by the Recreation Department varies, but when events
are run, they again do not interfere with school
programs.
c. Costs - The City contributed $6,000 toward the resurfacing
of the track. No other costs are incurred by the city
regarding this facility.

B. Countryside High School
1. Auditorium
a. Program - The City's CUltural Arts Section wishes to use
the Auditorium three times durin::l" the year for a variety
of cultural activities, including O1e large drama
prcduction am t...o smaller musical concerts or
performances. All programs will te produced and directed
by the staff of the City of Clearwater Recreation
Department.
b. Times and Dates - These may vary and are flexible
deperxhng upon scheduled use of the auditorium, however,
in general, the times are as follows:
Drana Production: (5) days for rehearsal am (6) days for
actual ];erformances, weekdays from 4: 00 p.m. to 10: 30
p.m., am 01 weekends from 1:00 p.m. to 10:30 p.m.
Two Musical Concerts: (3) days each, one for rehearsal
am the other t...o for performances, time 7: 00 p.m. to
10:30 p.m., Friday and Saturday nights, and 1: 00 p.m. to
10:30 p.m Sunday evening.
Approximately eighty hours of use, thirty hours for rehearsals and
fifty hours for performance.
c. Costs - The City will P=lY all extra custodial fees
incurred due to event am personnel fees needed in order
to keep the auditorium open for ];erformances, e.g.,
lighting am sound technicians.
2. Gymnasium
a. Program - The Recreation Department runs a sumner youth
basketball clinic for youth am adults.
b. Times and Dates - The sumner basketball clinic operates
fran the middle of June until the middle of August (eight
weeks) during the oours of 3:00 p.m. until 10: 00 p.m.,
Monday through Friday. The approximate hours, of usage for
this facility is (280) hours.
c. Costs - A recreati01 specialist am assistant are hired to
run the program. Every attempt is JIlade to hire two
teachers fran the high school for these positions. Any
extra custodial ;,ark needed tecause of this program will
te performed by City employees.
3. Tennis Courts
a. Program - The Recreation Department uses t.\1e tennis courts
as a facility for public play.
b. Times and Dates - The tennis courts can te used year-round
by the public durin::l" the times of the day when it doesn't
interfere with a school program.
c. Costs - The Parks & Recreation Department intends to
budget funds for lighting the tennis courts for night use.
The City will P=lY for all utility costs asscciated with
lighting system. School is responsible for net and center
strap replacements.
4. Handball Courts
a. Program - The Recreation Department uses the handball
courts as a facility for public play.
b. Times and Dates - The handball courts can te used
year-roum by the public durin::l" the times of the day when
it doesn' t interfere with a school program.
c. Costs - The Parks & Recreation Department intends to
budget funds for lighting the handball courts for night
use. The City will pay all utility costs asscciated with
lighting system.
5. Basketball Courts
a. Program - The Recreation Department utilizes the
basketball courts similar to the tennis courts and
handball courts for plblic play.
b. Times and Dates - Similar to Tennis and Handball Courts.
c. Costs - Similar to Handball Courts

Oak Grove i'liddJ School

1 . Gymnasium
a. Program - T'NO programs are held by the Recreation
Department at this facili ty . One is an after school
playground program which occurs during the school year,
but which then turns into an all day program during the
sLlll1ller ronths. The second program is a lIEn I s basketball
league.
b. Times and Dates - The after school playground program runs
for 1-1/2 hours a day, /lbnday through Friday, arxl for
7-1/2 hours on Saturday. During the surrmer,the program
runs for a 8 hours a day, /lbnday through Friday. The
lIEn's basketball league takes place during the dates of
November 30 to December 15, and January 3 to March 15.
The games are played fran 6 :00 p.m. until 10 :00 p.m.,
/lbnday through Thursday. The approximate number of hours
the facility is used for both of these programs is 1392.
c. Costs - The City hires tWJ teachers fran the school as
recreation leaders to run the after school and sllllmer
programs. The City alsc hires a teacher fran the school
as a scorekeeper for the basketball league thereby always
providing school leadership and supervision.
D. Clearwater canprehensive Middle School
1 . Gymnasium
a. Program - There are two programs run by the Recreation
Department using this facili ty. The first one is a lIEn I s
volleyball league and the other program is a lIEn I s
basketball league.
b. Times and Dates - The volleyball league is a ten M:ek
program and runs from September 15 until November 30. The
games are held Mcinday through Thursday between the hours
of 6 :00 p.m. and 10 :00 p.m. The basketball league is a
program which runs fran November 30 until December 15, and
then aga,in from January 3 until March 15. The games are
held on M:Jnday through Thursday. On M:Jnday and Wednesday,
the games are played between 6 :00 p.m. and 10 :00 p.m.;
while on Tuesday and Thursday they are held between 6:00
p.m. and 11 :00 p.m. The approximate number of hours the
City uses this facility is 376 hours.
c. Costs - There is no cost to the City for the use of this
facili ty. There is an agreement between the school and
Martin Luther King Recreation Center of joint usage of
each other's facilities which takes care of any costs for
each party.
E. John F. Kennedy Middle School
1. Gymnasium
a. Program - The City's Recreation Department uses this
facili ty for its men I s basketball league.
b. Times and Dates - The basketball league runs fran
November 30 until December 15, arxl from January 3 until
March 15. The games are played /lbnday through Thursday
betM:en the hours of 6 :00 p.m. and 11 :00 p.m. The
approximate number of hours the City utilizes this
facility is 240 hours.
c. Costs - The City hires a teacher fran the school to be a
referee, plus act as a supervisor for the schcol.
F. Kings Highway Elementary School
1 . Basketball Court
a. Program - the Recreation Department uses the basketball
court as a facility for public play.
b. Times and Dates -the basketball court can be used year-.
round when it doesn't interfere with a school program.
c. Costs - The City paid for the installation of the lights
on this court and is paying for the operation of these
lights by use of a separate meter.

A. Frank Tack
1 . Ballfields (Clearwater)
a. Program - Clearwater High School uses the fields at
Frank Tack for its varsity baseball teams practices and
home games. '
b. Times and Dates - The varsity baseball team uses the
fields from January , 1981, until April , 1981.
During this time they will oonduct 52 practices between
the hours of 2:30 p.m. and 4:30 p.m., an:l they will play 7
home games with each game again lasting approximately
2-1/2 hours. The approximate number of hours both teams
will use the facility is 271 hours.
c. Costs - None
2. Ballhelds (Countryside)
a. Program - Countryside High School uses the fields at Frank
Tack for its varsi ty baseball team I s practices an:l home
games .
b. Times and Dates - The Countryside Varsity Baseball Team
uses the fields from January 3 until April 27. During
this time they will conduct approximately 52 practices
between the hours of 2:30 p.m. and 5:30 p.m. an:l they will
play 7 home games. '!he approximate number of hours toth
teams will use the facility is 271 hours.
c. Costs - None
B. Carpenter Field
1. Ballfields (Clearwater)
a. Program - Clearwater High School uses the fields fur its
baseball tean for approximately 5 of its hare games.
b. Times and Dates - As stated above, the team plays 5 of its
hane games at Carpenter Field an:l they last approximately
2-1/2 hours. '!he approximate total number of hours the
facility is used is 13 hours.
c. Costs - None
2. Ballfields (Countryside)
a. Program - Countryside High School uses the fields for its
baseball team for approximately 5 of its hare games.
b. Times and Dates - Five home games approximately 2-1/2
hours in length. Dates an:l times vary.
c. Costs - None
C. Maryrrount Park
1. Ballfields (Clearwater)
a. Program - Girls Softball including practice
b. Times and Dates - Approximately 2 to 2-1/2 hours an:l home
games.
c. Costs - None
2. Ballfields (Countryside)
a. Program - Countryside girls s::Jftball team uses field fur
practice an:l games.
b. Ti.mes and Dates - Approximately 2 to 2-1/2 hours fer day,
Monday through Friday, for 12 weeks.

D. Kings Highway Recreaticn Center
1 . Building ,
a. Program - Kings Highway Elementary School uses the large
IIUllti-purpose roan inside the center for music, dance, and
other related classes.
b. Times and Dates - The school may use this building fur its
classes Monday through Friday during the months of
September to June, which is the school year, as long as it

recreation program at the center and as long as a staff
member is scheduled to be IoOrking at that time. This
gives the school an unlimited amount of hours which it can
utilize the recreation center.
c. Costs - None. The school provides leadership for all
classes held in the Center.
E. Norton Park Pool
1 . Swimming Pool
a. Program - North Ward Elementary School uses swimming p:lOl
for physical education classes.
b. Times and Dates - The school uses the p:lOl for
approximately 4 weeks beginning in May from 9:00 a.m. to
12:00 p.m., 5 days a week for P .E. classes. Red Cross
volunteers and P .E. staff accompany children to pool and
give instructions and supervision.
c. Costs - None
2. Swimming Pool
a. Program - Countryside High School uses the swirrming p:lOl
for high school swim practice and for horre swim meets.
b. Times and Dates - The school uses the p:lOl Monday through
Friday, 4 :30 p.m. to 6 :00 p.m., from December through
April for practices and uses the pool approximately 6
times for dual meets.
c. Costs - None
F. Iblt Center
1 . Swirrming Pool
a. Program - Clearwater Comprehensive Middle School, Palmetto
Elementary and Kings Highway Elementary use the p:lOl for
swimming instruction in connection with their physical
education program.
b. Times and Dates - The schools use the p:lOl during the
mnths of September, October, and May. The program is run
on M:lnday through Friday, between the hours of 9: 30 a.m.
c. Costs - None
G. Martin Luther King Recreation Center
1. Building
a. Program - Palmetto Elementary School uses the recreation
center for a Little Peoples program. The school alsc uses
the building for its physical education programs on rainy
days.
b. Times and Dates - The Li ttle Peoples pro:jram runs fran
September to June, Tuesday through Friday, with a
different schedule for each day. On Tuesday they have
classes at 10:00 a.m., 10:30 a.m. 11:00 a.m., and 1:00
p.m. Classes on Wednesday are at 10:00 a.m. and 1:00
p.m., while on Thursday they have one at 10 :00 a.m. and
one at 12:30 p.m. On Friday there is only one class at
10 :00 a.m. The approximate number of hours which the
sdlool uses the building for this program is 144 hours.
The physical education program, which takes place inside
the building \>hen it rains, varies as to the arrount of
hours they use the building during the school year.
c. Costs - None
2. Tennis Courts
a. Program - PaLlletto Elementary School and Clearwater
COmprehensive Middle School both use the tennis courts for
their physical education program. Clearwater High School
also uses, the tennis courts periodically for its girls
tennis team practice.

hours of 8 :30 a.m. and 4 :00 p.m. The courts are rot
continually used by either school during these times, but
instead, they are used at various times of the day during
that part of their physical education program where they
teach tennis. Clearwater High School's girls tennis team
is able to use the courts for practice as long as it
doesn't interfere with a recreation center program or with
a Palmetto Elementary or Clearwater Comprehensive physical
education program.
c. Costs - None

a. Program - Palmetto Elementary School and Clearwater
Comprehensive Middle School both use the playing field for
their physical education program.
b. Times and Dates - Both schools use the playing field from
September to June, r-bnday through Friday, between the
hours of 8 :30 a.m. and 4:00 p.m. The field is not
continually used by either school during these times, but
instead, is used when the physical education activities
warrant it.
c. Costs - None.
4 . Softball Dii3llOnd
a. Program - Palmetto Elementary and Clearwater Canprehensive
Middle School both use the softball dianoncl for their
physical education program.
b. Times and Dates - Both schools use tbe softball diarrond
fran September to June, r-Dnday through Friday, between the
hours of 8 :30 a.m. and 4 :00 p.m. The softball field is
not continually used by either school during these times,
but instead, when the physical education activities
warrant it. Each school, Palmetto Elementary School and
Clearwater Comprehensive Middle School, have the
oIJP:)rtunity to utilize one part of the' outside area of the
Martin Luther King Recreation Center (tennis courts,
playing field, and softball diarrond) for approximately
1,080 hours.

H. Marshall Street Park
1 . Playground
a. Proqram - Students of Curtis Fundamental Elementary
have physical education classes in the park.
b. Times and dates - The school uses the playground every day
during the school year during school times.
