JOINT USE OF VARIOUS RECREATIONAL/EDUCATIONAL FACILITIES (14) i I . 'IRIS AGREEMENT, made and entered into this i / y\. day of O~/ FIDRIDA, a rnun cipal , A.D., 1981, by an:l between the CITY OF CLEARWATER, coq:oration, hereinafter referred to as "City", and the SCHOOL BOARD OF PINELLAS COUNI'Y, hereinafter referred to as "Board." WIT N E SSE T H: WHEREAS, the Board is desirous of using various City-<:>wned facilities for various administrative meetings; and WHEREAS, the City is desirous of using various school facilities owned by the Board, for recreational and educational programs; and WHEREAS, the City an:l Board are each willing to =perate in this matter under certain conditions and provisions. likJW, THEREFORE, in consideration of the covenants herein contained and other good and valuable consideration, the Board and City mutually agree to lease their respective facilities as outlined in Exhibit "A" hereto attached and made p3.rt of said a:jreement, under the following terms and conditions: 1. 'Ihe term of this h:1reement shall I:e for a j:eriod of one (1) year cornnencing on January 1, 1981, an:l ending onDecember 31,1981. Said Agreement may be extended from year to year under the same terms and conditions set forth herein, with written Agreement an:l approval by the Board and City. 2. 'Ihe Board agrees to make the described facilities available men the use thereof does not interfere or conflict with the regularly scheduled school programs as outlined in Exhibit "A." Use of said facilities shall not be earlier than 8:00 a.m. nor later than 11:00 p.m. for outdoor use and not later than 12:00 midnight for indoor use. 3. The premises owned by the City shall be used by the Board for various administrative and operations meetings and shall not conflict with any City programs an:l shall confonn with the hours the facilities are normally open to the p..Iblic. 'Ihe ]:arties agree to maintain the facilities and surrounding area in a clean am sanitary condition after use by the parties or any of its agents or invitees. 5. Each ]:arty shall provide its own p:rsonnel for tile supervision of the programs it comucts. 6. Use of the leased premises by private ]:arties or organizations or by business enterprises for profit is prohibited. The Board and City further agree to make no unlawful, improper or offensi ve use of the leased premises and all rights of the leasing party hereunder shall be terminated by the Board or City in the event that such use is made thereof. 7. The parties agree that earn will save the other harmless on account of the negligent acts of its employees, servants or agents or on account of any unsafe conditions that may exist as a result of the negligent operation by the ]:arties of the leased facilities. The Board and Ci ty agree to be responsible for the safety of its own invi tees, licensees or ]:articipants in their respective program in case of accidental injury, except as noted above. The Board and City agree to provide earn other proof of insurance coverage in the amounts required by law tmder section 768.28, Florida Statutes. 8. 'Ihe Board and City will not assign this Lease nor sublet the premises or any part thereof without the written consent of the other party. '!:he Board and City agree that each ]:arty and its officers, agents, am servants shall have the right to enter am inspect the leased premises and the operation being conducted thereon at reasonable times, and that this Agreement may be canceled by either the City or Board with a thirty (30) day written notice. 9. Additional City or School Board facilities may be used at appropriate times and places with written approval of the Superintendent or Ci ty Manager. '!:he joint use agreement may then be amended to reflect the additional uses which are requested am approved. 10. City Usage of School Facilities A. Clearwater High School 1 . Gymnasium a. Program - The Recreation Department runs a youth basketball league for boys. The Recreation Department also utilizes this facility for a summer basketball clinic for youth and adults. b. Times and Dates - The boys youth basketball league runs from the beginning of December until the first week of March. They play every Saturday (with the exception of a be week break around Christmas) from 9:00 a.m. until 1 :00 p.m. The summer basketball clinic operates from the middle of June until the middle of August (eight weeks) during the hours of 3 :00 p.m. until 10:00 p.m., Monday through Friday. The approximate hours of usage for this facility is 332 hours. c. Costs - The Recreation Department will hire a teacher from the high school to ~rk as a referee for the youth basketball and also will help supervise the school. For the summer clinic, a recreation specialist and a recreation assistant are hired to run the program. Ellery attempt is made to hire t~ teachers from the high school for these fOsitions. Any extra custodial ~rk needed because of these t'M:> progranE will l:e perfonred by these City employees. 2. Bobby Walker E\:xll To be addressed by separate contract; not part of this joint utilization contract. 3. Tennis Courts a. Program - The Recreation Department uses the tennis courts, as a facility for public play. b. Times and Dates - The tennis courts can be used year-round by the public during the times of the day when it doesn't interfere with a school program. c. Costs - When the courts were constructed the ci ty paid for the lighting of the courts and the city has continued to pay for the operation of the lights. Besides this, no other costs are incurred. 4. Basketball Courts a. Program - The Recreation Department utilizes the basketball courts similar to the tennis courts which is a facility open for public play. b. Times and Dates - The courts are used for public play year-round, but again, only during the times of the day when it doesn't interfere with a school program. c. Costs - The City paid for half of the construction costs of the basketball courts while the other half was paid for by the school. Another cost which the City pays is the operation of the lights figuring that rrost use at night is done by the open public play and not by school programs. 5. Running Track a. Program - A citywide clinic, track reet, or special program may be run by the Recreation Department 00 this facili ty . The P.A. system and other track equipment may be used by the Ci ty for these events. b. Times and Dates - The number of times this facility is used by the Recreation Department varies, but when events are run, they again do not interfere with school programs. c. Costs - The City contributed $6,000 toward the resurfacing of the track. No other costs are incurred by the city regarding this facility. I I 2 B. Countryside High School 1. Auditorium a. Program - The City's Cultural Arts Section wishes to use the Auditorium three times durin;J the year for a variety of cultural activities, including one large drama production and two smaller musical concerts or performances. All programs will te produced and directed by the staff of the City of Clearwater Recreation Department. b. Ti1Pes and Dates - These may vary and are flexible dependin;J upon scheduled use of the auditorium; however, in general, the times are as follows: Drama Production: (5) days for rehearsal and (6) days for actual r:erformances, weekdays from 4: 00 p.m. to 10: 30 p.m., and on weekends from 1:00 p.m. to 10:30 p.m. Two Musical Concerts: (3) days each, one for rehearsal am the other two for performances; time 7:00 p.m. to 10:30 p.m., Friday and Saturday nights, and 1 :00 p.m. to 10:30 p.m Sunday evening. Approximately eighty hours of use, thirty hours for rehearsals and fifty hours for performance. c. Costs - The City will FClY all extra custodial fees incurred due to event and personnel fees needed in order to keep the auditorium open for r:erformances, e.g., lightin;J and sound technicians. 2. Gymnasium a. Program - The Recreation Department runs a sumner youth basketball clinic for youth and adults. b. Times and Dates - The summer basketball clinic operates fram the middle of June until the middle of August (eight weeks) during the hours of 3:00 p.m. lmtil 10:00 p.m., Monday through Friday. The approximate hours of usage for this facility is (280) hours. c. Costs - A recreation specialist am assistant are hired to run the program. Every attempt is JTlade to hire two teachers fran the high school for these positions. Any extra custodial work needed tecause of this program will te performed by City employees. 3. Tennis Courts a. Program - The Recreation Department uses the tennis courts as a facility for public play. b. Times and Dates - The tennis courts can te used year-round by the public durin;J the times of the day when it doesn't interfere with a school program. c. Costs - The Parks & Recreation Department intends to budget funds for lighting the tennis courts for night use. The City will pay for all utility costs associated with lighting system. School is responsible for net and center strap replacements. 4. Handball Courts a. Program - The Recreation Department uses the handball courts as a facility for public play. b. Times and Dates - The handball courts can te used year-roum by the public durin;J the times of the day when it doesn't interfere with a school program. c. Costs - The Parks & Recreation Department intends to budget funds for lighting the handball courts for night use. The City will pay all utility costs associated with lighting system. 5. Basketball Courts a. Program - The Recreation Department utilizes the basketball courts similar to the tennis courts and handball courts for plblic play. b. Times and Dates - Similar to Tennis and Handball Courts. c. Costs - Similar to Handball Courts - . , I 3 I C. Oak Grove l'1iddle School 1. Gymnasium a. Program - Two programs are held by the Recreation Department at this facili ty . One is an after school playground program which occurs during the school year, but which then turns into an all day program during the surrmer rronths. The second program is a men's basketball league. b. Times and Dates - The after school playground program runs for 1-1/2 hours a day, M:mday through Friday, and for 7-1/2 hours on Saturday. During the surrrner, the program nms for a 8 hours a day, l'bnday through Friday. The men's basketball league takes place during the dates of November 30 to December 15, and January 3 to March 15. The games are played from 6 :00 p.m. until 10 :00 p.m., M::mday through Thursday. The approximate number of hours the facility is used for ooth of these programs is 1392. c. Costs - The City hires tw::> teachers from the school as recreation leaders to run the after school and sunmer programs. The City also hires a teacher from the school as a scorekeeper for the basketball league thereby always providing school leadership and supervision. D. Clearwater Comprehensive Middle School 1. Gymnasium a. Program - There are two programs run by the Recreation Department using this facili ty. The first one is a men I s volleyball league and the other program is a men I s basketball league. b. Times and Dates - The \7Olleyball league is a ten week program and runs from September 15 until November 30. The games are held Monday through Thursday t:etween the hours of 6:00 p.m. and 10:00 p.m. The basketball league is a program which runs from November 30 until December 15, and then again from January 3 until March 15. The games are held on ~day through Thursday. en l'bnday and Wednesday, the games are played t:etween 6:00 p.m. and 10:00 p.m.; while on Tuesday and Thursday they are held t:etween 6 :00 p.m. and 11 :00 p.m. The approximate number of hours the City uses this facility is 376 hours. c. Costs - There is no oost to the City for the use of this facili ty . There is an agreement t:etween the school and Martin Luther King Recreation Center of joint usage of each other IS facilities which takes care of any costs for each party. E. John F. Kennedy Middle School 1 . Gymnasium a. Program - The City's flecreation Department uses this facili ty for its men I s basketball league. b. Times and Dates - The basketball league runs from November 30 until December 15, and from January 3 until March 15. The games are played l'bnday through Thursday between the hours of 6:00 p.m. and 11 :00 p.m. The approximate number of hours the City utilizes this facility is 240 hours. c. Costs - The City hires a teacher from the school to t:e a referee, plus act as a supervisor for the school. F. Kings Highway Elementary School 1 . Basketball Court a. Program - the Recreation Department uses the basketball court as a facility for public play. b. Times and Dates - the basketball court can t:e used year- round when it doesn't interfere with a school program. c. Costs - The City paid for the installation of the lights on this court and is paying for the operation of these lights by use of a separate meter. .' I 4 I II. School Use of City Recreation Facilities A. Frank Tack 1. Ballfields (Clearwater) a. prcgram - Clearwater High School uses the fields at Frank Tack for its varsity baseball teams practices and home games. b. Times and Dates - The varsity baseball team uses the fields from January , 1981, until April , 1981. During this time they will conduct 52 practices l:.etween the hours of 2:30 p.m. and 4:30 p.m., arrl they will play 7 home games with each game cgain lasting approximately 2-1/2 hours. The approximate number of hours both teams will use the facility is 271 hours. c. Costs - None 2. Ballfields (CoLn'ltryside) a. Prcgram - Countryside High School uses the fields at Frank Tack for its varsity baseball team's practices arrl home games. b. Times and Dates - The Countryside Varsity Baseball Team uses the fields from January 3 until April 27. During this time they will conduct approximately 52 practices l:.etween the hours of 2:30 p.m. and 5:30 p.m. arrl they will play 7 home games. The approximate number of hours toth teams will use the facility is 271 hours. c. Costs - None B. Carpenter Field 1. Ballfields (Clearwater) a. Prcgram - Clearwater High School uses the fields for its baseball team for approximately 5 of its hare games. b. Times and Dates - As stated above, the team plays 5 of its home games at Carpenter Field arrl they last approximately 2-1/2 hours. The approximate total number of hours the facility is used is 13 hours. c. Costs - None 2. Ballfields (Countryside) a. Prcgram - Countryside High School uses the fields for its baseball team for approximately 5 of its home games. b. Times and Dates - Five home games approximately 2-1/2 hours in length. Dates arrl times vary. c. Costs - None C. Maryrrount Park 1. Ballfields (Clearwater) a. Program - Girls Softball including practice b. Times and Dates - Approximately 2 to 2-1/2 hours an:l home games. c. Costs- 2. Ballf ields (Countryside) a. Program - Countryside girls SJftball team uses field for practice arrl games. b. Times and Dates - Approximately 2 to 2-1/2 hours r:er day, Monday through Friday, for 12 weeks. c. Costs - None D. Kings Highway Recreation Center 1 . Building a. Program - Kings Highway Elementary School uses the large multi-purpose roan inside the center for music, dance, and other related classes. b. Times and Dates - The school may use this building for its classes Monday through Friday during the months of September to June, which is the school year, as long as it ... :0, , I 5 I D. Kings Highway Recreation Center (continued) b. Times and Dates (continued) - doesn't interfere with a recreation program at the center and as long as a staff member is scheduled to be ~rking at that time. This gives the school an unlimited amount of hours which it can utilize the recreation center. c. Costs - None. The school provides leadership for all classes held in the Center. E. Norton Park Pool 1 . SWinrninq Pool a. Program - North Ward Elementary School uses swimming PJOI' for physical education classes. b. Times and Dates - The school uses the p::lOl for approximately 4 weeks beginning in May from 9: 00 a.m. to 12:00 p.m., 5 days a week for P .E. classes. Red Cross volunteers and P.E. staff accompany children to PJOI and give instructions and supervision. c. Costs - None 2 . SWinrning Pool a. Program - Countryside High School uses the swinrning p::lOl for high school swim practice and for home swim meets. b. Times and Dates - The school uses the PJOI Monday through Friday, 4 :30 p.m. to 6 :00 p.m., from December through April for ~actices and uses the PJOI approximately 6 times for dual meets. c. Costs - None F. Holt Center 1 . Swinrning Pool a. Program - Clearwater Comprehensive Middle School, Palmetto Elementary and Kings Highway Elementary use the PJOI for swimming instruction in connection with their physical education program. b. Times and Dates - The schools use the p::lOl during the rronths of September, October, and May. The program is run on M:Jnday through Friday, between the hours of 9: 30 a.m. c. Costs - None G. Martin Luther King Recreation Center 1. Building a. Program - Palmetto Elementary School uses the recreation center for a Little Peoples program. The school also uses the building for its physical education programs on rainy days. b. Times and Dates - The Li ttle Peoples program runs from September to June, Tuesday through Priday, with a different schedule for each day. On Tuesday they have classes at 10 :00 a.m., 10 :30 a.m. 11 :00 a.m., and 1 :00 p.m. Classes on Wednesday are at 10:00 a.m. and 1 :00 p.m., while on Thursday they have one at 10: 00 a.m. and one at 12:30 p.m. On Friday there is only one class at 10:00 a.m. The approximate nllJ1lber of hours which the sdlool uses the building for this program is 144 hours. The physical education program, which takes place inside the building men it rains, varies as to the am:>unt of hours they use the building during the school year. c. Costs - None 2. Tennis Courts a. Program - Pabnetto Elementary School and Clearwater Comprehensive Middle School roth use the tennis courts for their physical education program. Clearwater High School also uses the tennis courts periodically for its girlS tennis team practice. It. ~. '.~ .' I' I 6 2. Tennis Courts (continued) b. Times and Dates - Both schools use the tennis courts fran September to June, M::lnday through Friday, between the hours of 8:30 a.m. and 4:00 p.m. The courts are not continually used by either school during these times, but instead, they are used at various times of the day during that part of their physical education program where they teach tennis. Clearwater High School's girls tennis team is able to use the courts for practice as long as it doesn't interfere wi th a recreation center program or with a Palmetto Elementary or Clearwater Comprehensive physical education program. c. Costs - None 3 . Playing Field a. Program - Palmetto Elementary School and Clearwater Comprehensive Middle School both use the playing field for their physical education program. b. Times and Dates - Both schools use the playing field from September to June, M:>nday through Friday, between the hours of 8:30 a.m. and 4:00 p.m. The field is not continually used by either school during these times, rot instead, is used when the physical education activities warrant it. c. Costs - None. 4 . Softball Diamond a. Program - Palmetto Elementary and Clearwater Comprehensive Middle School both use the softball diamond for their physical education program. b. Times and Dates - Both schools use the softball diamond from September to June, M:>nday through Friday, between the hours of 8:30 a.m. and 4:00 p.m. The softball field is not continually used by either school during these times, but instead, when the physical education activities warrant it. Each school, Palmetto Elementary School and Clearwater Comprehensive Middle School, have the opportunity to utilize one part of the outside area of G~e Martin Luther King Recreation Center (tennis courts, playing field, and softball diamond) for approximately 1,080 hours. c. Costs - None H. Marshall Street Park 1 . Playground a. Program - Students of Curtis Fundamental Elementary have physical education classes in the park. b. Times and dates - The school uses the playground every day during the school year during school times. c . Costs - None
