THIS AGREEMENT, made and entered into this

CITY OF CLEARWATER,
to as "City", and
the Diocese of St. Petersburg, Florida, hereinafter referred to as "St.
Cecelia's School".
WIT N E SSE T H :
WHEREAS, St. Cecelia's School is desirous of using various City-
owned recreational facilities for its physical education classes, and
athletic programs, namely Court Street So~cer Field; and
WHEREAS, the City is desirous of using physical education facilities,
owned by St. Cecelia's School for recreational programs, namely St. Cecelia
gymnasium; and
WHEREAS, the City and St. Cecelia's School are each willing to
cooperate in this matter \.mder certain conditions and provisions;
NOW, THEREFORE, in consideration of the covenants herein, contained
and other good and valuable consideration, the City hereby agre.es to
permit St. Cecelia's School to use its recreation facilities, and St.
Cecelia's School hereby agrees to permit the City to use its physical
education facilities under the following conditions and provisions to
wit:
1. The term of the Agreement shall corrnnence >7I....!rW<J."{} J3 *4 , 1981,
and shall continlle until a thirty (]O) da;y notice of termination in writing
is given to either party by the other.
2. The premises owned by the City shall be used by St. Cecelia's
School L~ its physical education program and shall not conflict with any
City programs and shall, conform with the hours the facilities are normally
open to the public. The premises owned by St. Cecelia's School shall be
used by the City in its recreational programs and shall not conflict with
any St. Cecelia's School programs and shall conform with the hours the
facilities are normally open. If one party does desire usage of the other
party's facilities at a time other "han normally open, that party will be
required to pay a fee of $5.00 per hour for said usage. Further, St. Cecelia's
School shall, prior to scheduling or using City facilities, obtain the approv-
al and consent of the Director of Parks and Recreation of the City of

Clearwater to said schedule and use. Further, the City shall, prior to
scheduling and using St. Cecelia's facilities, obtain the approval and
consent of the Administrator of St. Cecelia's School to said schedule
and use.
3. Each party shall provide its own personnel for the supervision
of the programs it conducts.
4. Each party covenants that it will, prior to using the other
party's facilities, obtain and keep in force during the term of this
Agreement a liability and property damage insurance policy coveri,ng said
facilities in the minimum limits of $100,00 bodily injury for each
person, and $300,000 for each occurence; and $50,000 property damage for
each occurence, which said policy shall name the other party as an
additional insured. A copy of said insurance policy shall be furnished
to the City Clerk of the City of Clearwater or to St. Cecelia's School,
as appropriate, prior to the use of one party's facilities by the other
party.
5. All notices hereunder shall be sent to the City of Clearwater
City Ysnager, P. O. Box 4748, Clearwater, Florida 33518, and to St. Cecelia's
School, 400 South Hillcrest Avenue, Clearwater, Florida 33516.
IN WITNESS WHEREOF, the parties hereto have executed this' Agreement
the day and year first above written.

~.. Saint Cecelia's School and the Pine lIas County School Board. As I understand,
Mr. Keyser sent you a copy of the Babe Ruth insurance. I am still trying to
get insurance from the Little League and will send it as soon as I receive it.
Also, in reference to the Slowpitch Softball Association Agreement, I spoke
with Mr. Wilson and he feels we should just cancel the agreement.
