CONTRACT TO ESTABLISH TELEPHONE SERVICE J ~.u ~ 4. J r T HIS CON T R ACT Made and entered into this /l~f1day of May A. D. 1928, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, party of the first part, and the PENINSULAR TELEPHONE COMPANY, a Florida corporation, party of the second part, WITNESSETH That, for and in consideration of the sum of Ten Dollars ($10.00) cash in hand paid by the party of the second part to the party of the first part, receipt of which is hereby acknowledged by the party of the first ~art and in further consideration of the promises, covenants and conditions hereinafter set forth on the part of the said parties to be kept and performed, IT IS AGREED AS FOLLOWoS: 1.- Party of the second part, the Peninsular Telephone Company, shall be allowed the use of the pole line on the Clearwater Memoria:l Causeway across Clearwater Bay for the purpose of supporting its telephone wires, and it is agreed that said telephone wires are to be supported on malleable iron or steel, castings bolted to the pol!3s, tDe, U8:& ,of sald... I> 0'1 eline' to bfJ "lllm:tt,. ~.t cys1x 'cl;r cui 'to:s ~ . . 2.- The Peninsular Telephone Company, party of the second part shall construct, establish and maintain on the said brackets or castings referred to in paragraph numbered one of this contract one (I) complete metallic circuit of the charac- ~.,__~_.___,.._w,_~________._.,__. .___k",'__.. ~ _'" ,-..c-- ter and quality required by the Southeastern Underwriters Asso- ciation for the purpose of a fire alarm circuit which shall be for the exclusive use of the City of Clearwater for fire alarm purposes, and such.fire alarm circuit shall be used by the City CO-a 3~ (I) ~- J o. , of Clearwater free from any charge whatsoever or other con- sideration except as herein contained. 3.- It is further understood and agreed. that party of the seoond part, the Peninsular Telephone Company, will carry their eleotrical service and equipment.to the west end of the east bridge of theoauseway in submarine cable and will not go on to the causeway proper nor occupy the pole lines of the musewayuntil after having crossed the said east bridge of the causeway and the east channel of Clearwater Bay. It is further understood and agreed that at the option and election of the City of Clearwater, party of the second part shall supply the City of Clearwater with one or more pair of wires in the. '_, ;' shall be co-existent with the requirements of the City of Clear- water to maintain said fire alarm circuit and/or such time as the Peninsular Telephone Company may decide that it is neoessary or advisable to place their cables under ground.
