SECOND AMENDMENT TO EMPLOYMENT AGREEMENT .' , I SECOND AMENDMENT TO EMPLOYMENT AGREEMENT ~ This Second Amendment to Employment Agreement is entered into this I ~ day of j)~G;t'l.Jcu'^'-- , 1997, by and between the CITY OF CLEARWATER, FLORIDA ("City") and PAMELA AKIN (Employee"). WHEREAS, City and Employee entered into an Employment Agreement on August 30, 1994, to employ the services of the Employee to serve as City Attorney, and said agreement was subsequently amended on August 28, 1997; and WHEREAS, it is the desire of the City and the Employee to change certain benefits as originally provided in the Employment Agreement; now, therefore, Section 1. Section 4, Salary, Retirement, Vehicle, and Other Benefits, of the Employment Agreement between the City and the Employee as amended is further amended as follows: Section 4. The Emoloyee may include deoendent coverage under the orogram at the city emoloyee arouo rate if desired and subiect to such limitations and available ootions as orovided in such orogram. 2. The City shall orovide life insurance. disability. dental and other insurance as is orovided to City SAMP emoloyees. 3. The Emoloyee will be provided with 10 oaid holidays each year taken in accordance with oractices utilized for other executive managerial oersonnel. 4. The City agrees to oay travel and subsistence exoenses of the Emoloyee for professional and official travel. 5. The Emplovee shall be oiven "general leave" in lieu of vacation. sick leave and floating holidavs at a rate of thirty-five (35) days per year to be credited on October 3 of each year beoinnino on October 3. 1997. Accumulation of general leave shall be capped at 90 days. When Employee reaches the caP. the Commission agrees to consider an increase to the cap or buy back of leave. Existing accrued vacation and sick leave shall be converted to general leave. E. I* The City agrees to budget and pay the dues and subscriptions of the Employee necessary for full participation in national, regional, state, and local associations and organizations necessary and desirable for the good of the City. The Employee shall establish residence within the City within one year of appointment to the City Attorney position. The City shall pay all direct moving expense related to the moving and relocation of the Employee's family. * * * * * Section 2. All other terms and conditions of the Employment Agreement shall remain in full force and effect.
