As stated in paragraph 4 on the second page of the agreement, this exchange shall not take effect until right-of-way maps are recorded with the Pine11as County Clerk's office. I I AGREEMENT Between PINELLAS COUNTY and the CITY OF CLEARWATER ~ THIS AGREEMENT made this II day of r. 1979 between ~INELLAS COUNTY, a political sub-division of the State of Florida, and the CITY OF CLEARWATER, a municipal corporation of the State of Florida. WITNESSETH: WHEREAS, Florida Statute 334.03 paragraph 27 states in part, that the County Road System shall consist of all collector roads in the unincorporated areas and all extensions of such collector roads into and through any incorporated area, and; WHEREAS, the Florida Department of Transportation through a statewide functional classification of all public roads has classified Highland Avenue (C.R. 111) from Gulf to Bay Boulevard (SR-60) to Union Street as part of the City Street System, and Nursery Road (C.R. 115) from Highland Avenue (C.R. 111) to SR-5~ (U.S. Highway 19) as a Collector facility on the County Road System, and; WHEREAS, the Florida Legislature has stipulated that maintenance responsibilities will be assigned based upon functional classification of roads to be effective no later than July 1, 1982, and; WHEREAS, the Board of County Commissioners is authorized by Section 335.04(4), Florida Statutes, 1978, to enter into agreements with the Department of Transportation, municipalities, or other political sub- divisions, to provide for acceptance or relinquishment of maintenance responsibilities on public roads, and; WHEREAS, this Agreement designates maintenaJ;lce responsibilities in conformance with the current Florida Department of Transportation's functional classif.ication of public roads, J \;,1 NOW, THEREFORE, IT IS MUTUALLY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: xi.i"~ ~. .~ -....r~- r~" \ ,.",.~ /7.,-> b ,'t~ t:: 1..... The City of Clearwater agrees to require the issuance of a County Utility license for driveway connections and utility installations or adjustments on county maintained roads which lie within the Municipal limits. 2. Nursery Road (C.R. 115) from Highland Avenue (C.R. 111) eastward to SR-55 (U.S. Highway 19) (approximately 2.75 miles) currently maintained jointly by Pinellas County and the City of Clearwater in their respective jurisdictions, and currently designated as a County Numbered Road on the Official Map of Pinellas County, Florida Numbered County Road System, dated April 7, 1970, shall be wholly maintained by Pinellas County with General County Funds. 3. Highland Avenue (C.R. 111) from Gulf to Bay Boulevard (SR-60) northward to the Center Line of Union Street (northerly Municipal limits of the City of Clearwater) (approximately 2.50 miles) currently classified as a County Numbered Road on the- Official Map of Pinellas County, Florida Numbered County Road System dated April 7, 1970, shall be deleted from said Map and shall be subsequently maintained and operated by the City of Clearwater as part of the City Street System with funds of said Municipality. 4. This Agreement shall not take effect until right of way maps covering the road segments have been recorded with the Pinellas County Clerk of the Circuit Court. 5. This Agreement shall continue in full force and effect unless and until mutually terminated by resolution.
