THIS AGREEMENT, entered in'to this the

a municipal corporation of the St.ate of Florida, hereinafter called the
City, party of the first par.t; and the BOARD OF COUNTY COMMISSIONERS OF
PINELLAS COUNTY, FLORIDA, hereinafter called the County, party of the

WHEREAS, the County is engaged in obtaining the necessary right
of way for Belcher Road, County Road 27, f:com State Road 60 south to
Belleair Road, including the right of way of Druid Road for ~ mile west
from Belcher Road; and
WHEREAS, a portion of this necessary right of way is within the
City limits of Clearwater; and
WHEREAS, it would be to the mutual advantage of both parties for
the County to acquire this right of way within the City limits.

terms and conditions contained herein, the City does agree to the following~
That right of way for Belcher Road, County Road 27, from

State Road 60 south to Belleair Road, including the right
of way of Druid Road for ~ mile west from Belcher Road,

within the City limits will be obtained by the County;
that the City will provide the funds required for the
purchase or condemnation of the right of way for Druid
Road within City limits, said funds being limited to
e~ther the negotiated settlement, or the court awarded
value for the Druid Road parcel with the Countybe~ring
any ~dditional cost of acquisition.
That said funds or any portion thereof are to be provided
by the City within 10 days of request by the County so th~t
they may be u!i(~d to satisfy a sett.lement ag1.'0ement. OJ: to ma!;c'
deposit in the r(~gistry of t.hc Circuit Court.

It is recogIlzed that by making the abole mentioned repayment,

the City will satisfy its responsibility on this project, and any
additional expense in obtaining the right of way will be borne by the
County.
